SAN DIEGO (CNS) - A former La Jolla Country Day School teacher pleaded guilty Thursday to having sex with a 17-year-old female student and faces up to one year in local custody.An Oct. 21 sentencing date is scheduled for Jonathan Sammartino, 37, who also could face lifetime sex offender registration and be prohibited from teaching again at any school.San Diego County Superior Court Judge Charles G. Rogers, who took Sammartino's plea to a felony count of unlawful sexual intercourse with a minor, said he was "not inclined" to impose sex offender registration, but still might do so at the sentencing hearing.As part of the plea agreement, felony counts of oral copulation of a minor and digital penetration of a minor were dismissed.Sammartino, the son of U.S. District Judge Janis Sammartino, remains out of custody, pending the sentencing hearing.The victim, identified only as "Jane Doe" in court proceedings, testified earlier this year at Sammartino's preliminary hearing that the first sexual encounter happened in the early part of 2016, when he arrived at her home unannounced around midnight. She said she went outside to meet with him in his car, at which point he told her he didn't trust himself around her.Sexual encounters occurred that night in his car and on several other occasions in his vehicle and his house over the next few months, she testified.The victim, who went on to attend UC Berkeley, filed a report with campus police in the summer of 2018. Charges were filed later that year.In a recorded phone call played during the preliminary hearing, Sammartino admitted to the past encounters with the victim."Why did you do it? You knew I was 17," Doe says on the recording. "You knew I was your student. You knew it was my first time and I lost my virginity to you.""I don't have a good answer, because I wasn't thinking through what I was doing," he replied, apologizing to her several times throughout the call. "I can't believe that I did that."At the preliminary hearing, defense attorney Eugene Iredale unsuccessfully argued to have the charges reduced to misdemeanors, and introduced evidence regarding a 2015 bicycling accident in which Sammartino hit a pothole while riding in La Jolla and landed on his head. Sammartino was hospitalized and had to re-learn some functions before going back to the classroom, according to the defense attorney.Iredale argued that the brain injury affected his emotions and ability to make reasonable judgments, playing "a significant factor" in the commission of the charged acts.Rogers ruled against the defense request in January. Though he said he believed Sammartino had been affected by the injury and was unlikely to re- offend, he stated that the sexual nature of the defendant's relationship with the teen was entirely his idea."She wanted an emotional relationship with Dr. Sammartino. SALEM, Idaho -- A neighbor who lives across the street from Chad Daybell is describing what he saw in the months after two children went missing. The remains of those children were discovered on Daybell's property.Family members confirmed the remains recovered by Rexburg police and the FBI belong to Joshua JJ Vallow and Tylee Ryan. JJ would have recently turned 8 years old, and Tylee was 17.Both disappeared at different times from Rexburg, Idaho, last September.Matthew Price said he's lived across the street from Chad Daybell, the entire time Chad and his family have lived in Idaho. He's been following the investigation into the missing children, and the suspicions that centered on his neighbor."We've been very concerned the whole time for JJ and Tylee," Matthew said.He watched out his windows and from his yard as law enforcement spent two days digging in Chad's yard, and searching the property.Matthew recognized the area where investigators brought in a backhoe to dig a deep hole, where it appears they recovered the children's remains.Now that he thinks back, he is remembering some incidents that stand out in that exact spot."We noticed they were having a few bonfires that were kind of out of the ordinary," he explained. "They had a big bonfire last fall, and they had two or three big bonfires this spring."Last fall, no one knew about the disappearance of JJ and Tylee. Matthew described that things seemed okay, aside from the bonfires, but that he did have one weird interaction with Chad.He said Chad and his late wife, Tammy Daybell, came over to his house to buy pumpkins."He was strange, he was different," Matthew described. "He didn't talk a lot, didn't make eye contact with us very much. Normally he would."Matthew said it was very out of character, but he figured Chad was having a bad day. He said Tammy died a week later.Eventually, Matthew learned about the search for JJ and Tylee, and the investigation into Chad Daybell and his new wife Lori Vallow Daybell, JJ and Tylee's mother.After Lori ended up in jail in nearby Madison County, Chad returned to his Salem home. Matt recalled that Chad kept to himself for the last couple of months, barely leaving the house.He said when Chad did leave the house, it was late at night.Tuesday morning at 7 a.m. Matthew was standing outside when he said he saw a convoy of law enforcement coming down the road to serve a search warrant. They surrounded the home, he said, and made all of Chad's adult children leave the house. Chad also left, but Matthew said Chad sat in his car for hours. Then suddenly, Matthew saw Chad try to leave."I saw his car take off down the road headed south towards Rexburg," Matthew said. "Just seconds later, the marked police cars had their lights and sirens, and floored it to go catch him."Now, Matthew's neighbor of several years is in jail, and police have made a devastating discovery right across the street from Matthew's home.Wednesday evening, police turned the home back over to the adult Daybell children. They were seen packing up and moving furniture out of the home, loading it onto a trailer and into truck beds. SAN DIEGO — Two of San Diego's biggest restaurant groups are sounding the alarm over state Coronavirus regulations.Owners of the Brigantine Family of Restuarants and the Cohn Restaurant Group say indoor capacity limits aren't sustainable. Currently, a restaurant can only seat 25 percent of its capacity indoors. “If we stay open and as we enter the fall and winter months, our restaurants cannot survive on 25 percent," said Leslie Cohn, of the Cohn restaurant group.The Cohn Group spent more than 0,000 creating social distancing in 16 of its restaurants - before the 25 percent capacity limit was instituted. Their employment is now down 40 percent to about 1,200 workers.“We should be concentrating on positive test percentages, hospital capacity, ICU and PPE availability and of course mask wearing, social distancing and employee screening,” Cohn said.Her frustrations, echoed by Mike Morton, who heads the Brigantine Family of Restaurants, where employment is off 20 percent to 1,000 workers. Morton said there are now waits every Friday, Saturday and Sunday - due to the capacity restraints.“Guests are going to get tired of that, and what else is that going to do? It allows us to employ less people due to limited capacity,” Morton said.The 25 percent cap will last at least another three weeks. SALT LAKE CITY, Utah (KGTV) - The man accused of brutally beating a Salt Lake City teen and his father will not face a hate crime charge, the Salt Lake Tribune reported Monday. Salt Lake City Police said Alan Covington, 50, walked into Lopez Tires the morning of Nov. 27 and said “I’m going to kill someone.” Witnesses also heard Covington say he wanted to “kill a Mexican person”, KTVX reported.Covington waved a square metal pipe at the men inside the business, who escaped onto the front sidewalk, police said. 19-year-old Luis Lopez was struck in the head, according to Lopez’ family.The right side of Lopez' face was shattered and a titanium plate was inserted, his sister reported. Lopez’ father Jose was also injured and suffered a bruised back, family members said. He also needed eight stitches in his arm.Salt Lake City Police told the Salt Lake Tribune it appears Covington was under the influence of drugs during the attack and had some “mental health issues”.
