The Miami Police Department says what began as disagreement about masks led to an assault on Sunday evening.According to a statement from the Miami Police Department, the incident began at Latin Cafe, a ventanita or coffee shop near Miami International Airport. Surveillance video shows five people milling about outside of the cafe.The Miami Police Department says a few patrons got into an argument about mask compliance. Video shows one customer, wearing a mask and a red shirt, gesturing toward cafe employees and appearing to speak in exaggerated tones toward another customer without a mask.The customer without a mask stepped toward the man in the red shirt, and then a struggle ensued. Additional security footage shows the man in the red shirt falling to the ground. That man's girlfriend saw the incident from her car and ran to help. Police say she was also hit during the scuffle.Miami Police Officer Kiara Delva told WSVN-TV in Miami that the fight left the man in the red shirt "disoriented."Police say they're searching for four people in connection with the incident. It's unclear how many of those people could face charges.Miami currently requires the use of masks in public to prevent the spread of the coronavirus. First-time offenders are issued warnings, while repeat offenders could face fines. 1325

The Justice Department responded to CNN's lawsuit over the revocation of Jim Acosta's press pass on Wednesday, saying in a court filing that the White House rejects the idea that it can't pick and choose which journalists can be given a permanent pass to cover it."The President and White House possess the same broad discretion to regulate access to the White House for journalists (and other members of the public) that they possess to select which journalists receive interviews, or which journalists they acknowledge at press conferences," lawyers say in the filing.Both CNN and Acosta are plaintiffs. Kelly, a Trump appointee, has scheduled a hearing for Wednesday at 3:30 p.m.CNN and Acosta are asking Kelly for a temporary restraining order and a preliminary injunction that would restore his access right away.Lawyers for CNN and Acosta are arguing that time is of the essence because his rights are violated every day his pass is suspended.They are also seeking a declaration that Trump's action was "unconstitutional, in violation of the First Amendment and the Due Process Clause of the Fifth Amendment." This could protect other reporters against similar actions in the future."This is a very, very important case," Ted Olson said. Olson, a Republican heavyweight who successfully argued for George W. Bush in Bush v. Gore, is representing CNN along with another prominent outside attorney, Theodore Boutrous, and the network's chief counsel, David Vigilante.Olson said Tuesday that it was Acosta whose press pass was suspended this time, but "this could happen to any journalist by any politician."He spoke forcefully against Trump's action. "The White House cannot get away with this," he said in an interview with CNN anchor Brooke Baldwin.CNN's lawyers say the case hinges on Acosta and CNN's First Amendment rights; the shifting rationales behind the ban; and the administration's failure to follow the federal regulations that pertain to press passes, an alleged violation of Fifth Amendment rights.Tuesday's lawsuit rejected the White House's claim that Acosta acted inappropriately at a press conference last week. The suit says this is really about Trump's dislike of Acosta.The "reasonable inference from defendants' conduct is that they have revoked Acosta's credentials as a form of content- and viewpoint-based discrimination and in retaliation for plaintiffs' exercise of protected First Amendment activity," CNN's lawsuit alleges.Many media law experts, unaffiliated with CNN, believe the network has a very strong case.Judge Andrew Napolitano, the top legal analyst on Trump's favorite network, Fox News, said the same thing on Tuesday. "I think this will be resolved quickly," he said, adding "I think it will either be settled or CNN will prevail on motion."If there is no settlement, CNN is requesting a jury trial.In an interview with Wolf Blitzer, Boutrous said the government officials are being sued in their "official capacity," but "there is a possibility of damages claims," which would mean suing them personally.Blitzer pointed out that the officials would have to "go out and hire their own attorneys."It is incredibly rare to see a news organization suing a president.Fox News supports CNN in lawsuit against White House, network's president saysFred Ryan, the publisher and CEO of the Washington Post, expressed his support for the action Tuesday night. "We support CNN in its effort to restore the press credentials of its White House reporter," Ryan said. "It is a journalist's role to ask hard questions, hold the powerful to account and provide readers with as much information as possible."The White House Correspondents' Association is also standing behind CNN. The Mid-American Conference announced on Saturday that it would be canceling the fall season for all sports due to COVID-19 concerns. They become the first league competing at college football's Division I level to cancel their fall season over Covid-19 concerns. The Council of Presidents unanimously voted to cancel the fall season, citing the health and safety of the student athletes, coaches and communities as its top priority.With the MAC’s 12 schools facing a significant financial burden by trying to maintain costly coronavirus protocols, the conference’s university presidents made the decision to explore a spring season for football.MAC schools rely heavily on revenue from playing road games against power conference teams. Most of the power conference football games were canceled when other conferences went to exclusively or mostly in-conference games. Without the out-of-conference games, the strain of trying to implement all that it would take to keep players and staff safe during a pandemic became too much.Football isn't the only sport being canceled. All fall sports in the MAC, including men's and women's cross country, field hockey, men's soccer, women's soccer and women's volleyball, will not be played this season.Kent State University sent a message to its student's athletes regarding the MAC's decision to cancel fall sports this season, stating that all student athletes who receive a scholarship will get to keep it and that the school is reaching out to the NCAA to request an additional year of eligibility for those who would like it.Nine of 13 conferences at Division I’s second-tier of football, the Championship Subdivision, have already postponed their fall football seasons, with an eye toward making them up in the spring.The MAC has not announced a decision for winter sports at this time.The conference is working to plan for the 2021 spring semester and said it will continue to consult with its Medical Advisory Panel and will monitor COVID-19 developments as it makes its decision. 2038

  

The plane behind Lion Air's crash off Indonesia was one of Boeing's newest and most advanced jets. It was just two months old and with 800 hours under its belt, so experts are baffled as to what exactly caused the 737 MAX 8 to crash.While no information has been released yet as to why the brand-new plane crashed into the sea 13 minutes after takeoff,?FlightRadar24 has published data that shows the plane behaving erratically during takeoff. When a plane would normally be ascending in the first few minutes of flight, the Lion Air jet experienced a 726-foot drop over 21 seconds.Aviation expert Philip Butterworth-Hayes told CNN that the data was unusual -- especially since takeoffs like this are typically controlled by the plane's automatic systems."This doesn't fit an automatic flight profile," Butterworth-Hayes said while studying the data. "Unless, the aircraft was trying to correct itself at the time for a number of reasons.""This shows an unusually unstable vertical flight profile," he added."Exactly at the same time as the speed increased there was an altitude dip, which meant that at that point there was quite some loss of control."The plane, which has only been in operation since August 15, was carrying 181 passengers as well as six cabin crew members and two pilots, bound for Pangkal Pinang on the Indonesian island of Bangka.Former US National Transportation Safety Board air crash investigator and CNN aviation analyst Peter Goelz told CNN the data clearly showed issues with both the speed and altitude of the plane."There is something obviously wrong in both the air speed and the altitude which would point to the flight control systems," he said. "These are fly-by-wire systems -- highly automated -- and pilots may not be able to troubleshoot failures in a timely manner." 1818
