A federal judge ruled Monday Pennsylvania’s Governor Tom Wolf’s COVID-19 pandemic restrictions are unconstitutional.Four counties in the state filed a lawsuit claiming the governor’s orders closing non-life-sustaining businesses and limiting outdoor gatherings, and stay-at-home orders were unconstitutional. They stated the orders were "arbitrary, capricious and interfered with the concept of 'ordered liberty' as protected by the Fourteenth Amendment."Plaintiffs included hair salons, a drive-in theater, other businesses, as well as state representatives and congressman Mike Kelly.In his ruling, the judge says the governor’s actions likely had good intentions, “to protect Pennsylvanians from the virus," but that "even in an emergency, the authority of government is not unfettered."U.S. District Judge William Stickman IV ruling reads, “"(1) that the congregate gathering limits imposed by defendants' mitigation orders violate the right of assembly enshrined in the First Amendment; (2) that the stay-at-home and business closure components of defendants' orders violate the due process clause of the Fourteenth Amendment; and (3) that the business closure components of Defendants' orders violate the Equal Protection Clause of the Fourteenth Amendment."In his written opinion, Judge Stickman continued his explanation of his ruling."There is no question that this country has faced, and will face, emergencies of every sort. But the solution to a national crisis can never be permitted to supersede the commitment to individual liberty that stands as the foundation of the American experiment. The constitution cannot accept the concept of a 'new normal' where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures,” Stickman wrote."Rather, the Constitution sets certain lines that may not be crossed, even in an emergency. A Boynton Beach, Florida woman accused of shooting her husband five times over HOA complaints will not be charged with attempted murder.State prosecutors declined to file charges against Lisa Barreca Thursday morning. Police arrested Barreca last month, saying she shot her husband and caused wounds to his head, both his arms, his right leg and back.Barreca planned to use the stand your ground defense.A spokesperson for the Palm Beach County State Attorney's Office said the agency did not complete their investigation within the 30-day mandatory filing period. The SAO is able to file charges in the future, if they choose to do so.The Boynton Beach Police Department completed their investigation into the case, according to Public Information Officer Stephanie Slater.Barreca was ordered to be released on her own recognizance following a Thursday morning court hearing and the case was closed in court records. Barreca, who lives on Aspen Leaf Drive, was talking about HOA complaints with her husband Eric Barreca in their kitchen when he told police that the situation started to escalate.  The police report said that Lisa Barreca then went into the garage, retrieved her gun and shot him. Lisa Barreca was hospitalized and then was taken to the Palm Beach County Jail. She was later released on ,000 bond.That bond will be discharged since the case is closed, court records show.  1426

A convent in Livonia, Michigan, is mourning the loss of 13 nuns to the coronavirus. The Congregation of the Sisters of St. Felix of Cantalice, or Felician Sisters, lost 12 nuns to the virus between April 10 (Good Friday) and May 12, according to the Global Sisters Report publication.A 13th nun succumbed to the illness in June. Additionally, 18 sisters at the convent contracted the deadly novel coronavirus."We couldn't contain the grief and the sorrow and the emotional impact," Sr. Noel Marie Gabriel, director of clinical health services for the Felician Sisters of North America, told a reporter with Global Sisters Report. "We went through the motions of doing what we had to do, but that month was like a whole different way of life. That was our most tragic time. A California high school student has been charged with two counts of battery stemming from a fight involving a Donald Trump "Make America Great Again" cap, according to KOVR-TVCell phone video of the fight shows a Union Mine High School student confronting and yelling at a fellow student wearing a red MAGA hat in support of President Trump. After yelling at her classmate, she reportedly grabbed the hat off his head and threw it on the ground and left the classroom, according to the El Dorado Sheriff's Office.The student later returned to the classroom and again removed the student's hat. The teacher escorted the girl out of the classroom, and she reportedly slapped him on the arm as he led her out. A school resource officer arrested the girl in the hallway. She was taken to a local juvenile detention center and suspended from school, according to KTXL-TV. The girl was charged with two counts of battery, once against the student with the MAGA hat, the other against the teacher."“…student and staff safety is our highest priority and the UMHS administration will continue to cooperate with the El Dorado County Sheriff’s Office as the incident is being investigated,” the school said in a statement, according to KTXL.Alex Hider is a writer for the E.W.
