An employee is entitled to no less than 4.3 yuan per work hour, said a rule released by the Guangzhou city government last November. The hourly pay averages 7.5 yuan in the city. An unnamed source in Guangzhou told the New Express newspaper that the contract violated the legal rights of employees. "Once administrative departments discover acts of violations, officials will order these enterprises to revamp and compensate the employers for their losses," the source told the Guangzhou-based paper. "If the problem is so grave that a punishment will be handed out," the source said without giving details. The source also cast doubts on the probation system implemented by the fast-food giants. "Part-time employees don't need to undergo a one-month probation period." McDonald's and KFC have nearly 3,000 outlets all over China and a work force of nearly 200,000, according to a state media report. Zhu Yongping, a Guangzhou lawyer, has begun to move for the rights of employees. He told the paper that the work contracts have 'seriously violated' the legal rights of employees. A Lin, a McDonald's employee in Guangzhou, regarded McDonald's as a respectable foreign-funded enterprise before starting to work there. But the working experience has changed her mind. "I don't have enough rest. It seems that I was overly exploited." Cui Minghuan, Manager of KFC'S Guangdong market, refuted the claims of rights violations, saying the current rule of the minimum hourly rates of pay for the non-full-time employees implemented in the province is not applicable to the part-time employees working for KFC. China is planning to adopt an unemployment law that aims to build an unemployment benefit system. The draft law is aiming at promoting employment around the country. The law states that the government will implement new policies, such as boosting professional training and increasing financial investment in employment promotion. As discrimination turns rife in China, the draft law contains a clause on anti-discrimination in an effort to provide employment equality in the country. The clause states that discrimination against job seekers with respect to their background, ethnicity, gender, religious beliefs, age, or physical disability, will be prohibited. The government is also taking actions to set up trade unions in foreign-funded enterprises in China. Up to date, about 26 percent of China's 150,000 overseas-funded enterprises have established trade unions, with a total membership of 4.29 million, previous media report said. However, McDonald's and KFC have not set up unions so far.

According to Shi, China has about 100 million registered religious believers, most of whom are Buddhists and Taoists. "They form an indispensable force to construct a harmonious society," he said. Shi said the ritual was suspended for 300 years because the altar where the ritual was held was destroyed. The 26-meter-high three-storey alter was restored last year at the temple, located in Dengfeng, Central China's Henan Province. The 600 Buddhists were selected out of 1,000 pious Buddhists nationwide. Shi said that only Buddhists who have passed a long-term inspection and are believed to have a "pre-destined lot" with Buddhism will be allowed to take the ritual and admitted by the temple. "Only Buddhists who practice Buddhism to a high level can be tonsured and allowed to take the ritual," Shi said. The ritual will last 28 days during which time the 600 monks will listen to doctrines, learn Buddhism rituals and manners in the temple. Both Buddhism and Taoism seem to be attractting more believers. An international forum on the "Daode Jing", a classic of Taoism, was held last month and lured 300 Taoists from around the world who wanted to explore the true essence of the classic text.

The newly approved Labor Contract Law will not undermine the investment environment although it will better protect workers' interests and rights, China's top trade union body said yesterday. Liu Jichen, director of the law department at the All-China Federation of Trade Unions, denied that the law - which goes into force from January 1 next year - is biased toward employees. "It not only protects workers' interests and rights, but also equally protects employers'," he told a press conference. The law, passed on Friday by the Standing Committee of the National People's Congress, the top legislature, had raised concerns that stricter contract requirements could raise business costs and give companies less flexibility to hire and fire employees. Liu, however, said that the law takes into account employers' interests. For example, he said, employers can sign non-competition contracts with workers, with a non-competition period of not more than two years to encourage innovation and ensure fair competition. So an employer can rest assured that an employee does not walk out at the end of the contract period and join a direct competitor. It also softens the terms under which employers can cut staff - if an enterprise switches to other production, adopts a major technological innovation or changes its mode of business. Liu stressed that the law will help create a harmonious labor relationship. "Labor protection is a worldwide trend," he said. "With working conditions improved and rights protected, employees will feel more secure, which leads to a higher productivity." Liu pointed out most labor disputes result from violations of workers' rights. Because of the huge supply of labor force, workers are in a disadvantaged position, he said. Liu said the federation has succeeded in keeping most of the items on protecting workers' rights and interests in the law. For example, the law makes mandatory the use of written contracts and strongly discourages fixed- or short-term contracts. It also stipulates severance be paid if a fixed-term contract expires but is not renewed without an appropriate reason. The law requires all employers to submit proposed workplace rules or changes for discussion to the workers' congress - concerning pay, work allotment, hours, insurance, safety, holidays and training. Employers and trade unions will then jointly decide on workplace agreements. It stipulates trade unions have the right to sign collective contracts with employers on behalf of workers. In a position paper released yesterday, the European Chamber of Commerce in China said it welcomes the law and its aim of improving labor conditions and creating workplace harmony. "A more mature legal environment should be considered as an advantage in attracting foreign investment," the statement said. However, the chamber said the key challenge remains compliance by employers and the enforcement by authorities of the existing laws.

"It is not surprising that in each of the meetings, the issue of Taiwan came up. It is clearly a fundamental issue with China," he said. Asked about the possibility of a conflict over Taiwan, he said: "I believe there are good faith efforts among all the leadership to prevent that." Pace said he had repeated US President George W. Bush's position that the US leader "would not support Taiwan independence" and that Washington wanted the issue to be handled peacefully. Pace's visit follows a US announcement last month that it plans to provide over 400 missiles to Taiwan.China's military is proposing officer exchanges and other confidence-building measures with the US Army and may be inching closer to setting up a "hotline" for emergency communication with Washington, according to Pace. Pace said he immediately agreed to study the proposals put forward Friday by Gen. Liang Guanglie, chief of the PLA's General Staff Department. "To me this was a very good, open discussion and one that I found very encouraging," Pace told reporters in Beijing. Liang's proposals included sending Chinese cadets to the Army academy at West Point as well as participating in joint exercises and humanitarian and relief-at-sea operations "that might be able to build trust and confidence amongst our forces." Military exchanges were largely suspended following a collision between a US spy plane and a Chinese jet fighter over the South China Sea in 2001.  Pace said the sides agreed to keep discussing setting up a "hotline" between either military or civilian leaders that would help ease any future friction. "The Chinese military understands as well as I do that the opportunity to pick up the phone and talk to somebody you know and smooth out misunderstandings quickly is a very important part of relations between two countries," Pace said.
