SAN DIEGO (KGTV) — Cat Kom spent Tuesday morning leading Studio Sweat’s spin and sculpt fusion class, a half-hour of spin, and a half-hour of strength.“It is hard but it feels so good,” Kom said after the session.The other thing adding to her jubilance: the fact that she could finally open her boutique gym's new location in Rancho Bernardo.She said it seems like a long time coming.Kom’s outlook was a lot different when she first spoke to 10News in April in the midst of the coronavirus shut down.She couldn't open her new gym, was still paying rent for the old 4S Ranch location, and, like many small business owners, was shut out from a federal stimulus Paycheck Protection Program loan.“We didn't lay a single person off,” she said at the time. “That was our plan and that's what we hoped to do. Now we're kind of going, oh my gosh I might have to lay people off.”Fast forward to Tuesday. Studio Sweat was in its fifth day of operation after restrictions lifted.Kom ultimately got an ,000 PPP loan and never had to lay anyone off.Still, hours are reduced as membership is only at 65% pre-coronavirus levels and she still owes full rent.“I kind of had these grand dreams that we were going to open up and everybody was going to come back, but that's just not the case,” Kom said.Kom spent a couple of thousand dollars outfitting studio sweat for safety, including more sanitation stations.She says, however, that if there does happen to be a second wave in the future, studio sweat will be more prepared to handle it and rebound faster.The governor's guidelines for gyms to reopen include physical distancing, and for patrons to bring their own towels. 1668

SAN DIEGO (KGTV) -- As drugmakers race to develop a vaccine against the coronavirus, several legal questions are emerging: could the government require people to get it? Could people who refuse to roll up their sleeves get banned from stores or lose their jobs?The short answer is yes, according to Dov Fox, a law professor and the director of the Center for Health Law Policy and Bioethics at the University of San Diego.“States can compel vaccinations in more or less intrusive ways,” he said in an interview. “They can limit access to schools or services or jobs if people don’t get vaccinated. They could force them to pay a fine or even lock them up in jail.”Fox noted authorities in the United States have never attempted to jail people for refusing to vaccinate, but other countries like France have adopted the aggressive tactic.The legal precedent dates back to 1905. In a landmark U.S. Supreme Court case, Jacobson v. Massachusetts, the court ruled Massachusetts had the authority to fine people who refused vaccinations for smallpox.That case formed the legal basis for vaccine requirements at schools, and has been upheld in subsequent decisions.“Courts have found that when medical necessity requires it, the public health outweighs the individual rights and liberties at stake,” Fox said.In 2019, New York City passed an ordinance that fined people who refused a measles vaccination.That said, recent protests over face coverings show there could be significant backlash to a vaccine mandate, Fox said. Just because states have the power to do it, doesn’t mean it’s the best public policy, he added.Although states would have the authority to mandate vaccinations, there’s more doubt about whether Congress could enact a federal requirement.The most likely federal vaccination requirement would come in the form of a tax penalty, but Fox said given the current composition of the Supreme Court, a federal vaccine requirement would likely be found unconstitutional.Opponents of a federal mandate would cite the Supreme Court’s 2012 decision on the Affordable Care Act, Fox said. In that case, the justices ruled that Congress could not use its powers to regulate interstate commerce to require people to buy health insurance, even though the ACA’s individual mandate was ultimately upheld on separate grounds.That means the U.S. could have a patchwork of different vaccine requirements in different states.States that explore a vaccine requirement should only do so if the vaccine is widely and readily available, Fox said.“Otherwise you create an underclass of people who are less safe and without access to the basic means of society,” he said.States would need to allow exemptions for people with legitimate medical risks, like pregnancy, but not exemptions on religious or philosophical grounds, he said.“Religious exemptions are not constitutionally required by the First Amendment’s Free Exercise clause, provided that the vaccine mandates don’t single out religion; they’re not motivated by a desire to interfere with it,” he said.In the workplace, private employers would have a lot of flexibility to require vaccinations and fire workers who refuse them for anything but legitimate medical concerns.As long as employers show there are significant costs associated with having unvaccinated workers, they would not need to offer religious exemptions to employees, Fox said.Under the 1964 Civil Rights Act, employers are not required to accommodate religious employees if doing so would pose more than a “de minimis,” or minimal cost. 3561

SAN DIEGO (KGTV) -- Chula Vista City Councilman Steve Padilla, who last week announced he contracted coronavirus, has been hospitalized at UCSD Medical Center after experiencing difficulty breathing, his family announced Thursday.Ashleigh Padilla, Padilla's daughter, said her father "was admitted to UCSD Thornton Hospital ICU where he is receiving additional treatment, including a respirator to aid with difficulty breathing associated with COVID-19."“I know his amazing doctors and nurses are doing everything they can to send him home healthy when this is all over," said Ashleigh Padilla.No further details about his condition were given at this time, but Padilla did issue a warning to the public through his daughter.“My father asked me to pass on a message: Everyone needs to take COVID-19 seriously. Please follow the advice of our public health professionals to reduce spread of the virus and take precautions to keep your families and our community safe," said Ashleigh Padilla.Padilla, who represents Chula Vista's District 3, made the announcement in video last Saturday that was published on his Facebook page."After recently experiencing symptoms, I was diagnosed as being positive for the COVID-19 virus, also known as the coronavirus," he said last Saturday.Padilla appeared in the video to be in good spirits as he told viewers that he was doing "very well" and "feeling well."In a follow up statement later that night, he described having a fever, body aches, headaches, chills, that "came on very rapidly." SAN DIEGO (KGTV) — As hundreds of Regal Cinemas in the United States face the potential for closure, other movie businesses are thriving.Cineworld, the parent company for Regal Cinemas, tweeted Sunday, saying “We can confirm we are considering the temporary closure of our U.K. and US cinemas, but a final decision has not yet been reached. Once a decision has been made we will update all staff and customers as soon as we can.”Conversely, a locally owned San Diego theater is thriving during this time. Douglas Yeagley owns Cinema Under the Stars, a small, outdoor Mission Hills movie theater. You can’t do live music, you can’t do anything like that, you have to be in your car or something like that to see a performance of some nature, so this particular works well because you are super safe here, open-air,” said Yeagley.He said they’ve had to change a few aspects of business, including cutting seats from 62 to 42 per showing, spacing seats out for social distancing, cleaning seats twice between each showing, and also requiring face masks when standing. Even with the changes, they sell out most nights.Yeagley said he’s been to a few indoor movies since the pandemic and noticed the lack of others inside the theater, noting that there are a few key factors keeping people away from the indoor movie setting. The indoor location is a large factor, but also the delay of the release of major pictures is keeping people away.“There’s got to be a reason to come to that movie and you have to have an interest in that movie,” he said.The announcement from Regal Cinemas comes shortly after the announcement that the release of the latest Bond film would be delayed from November of 2020 to April of 2021 and the filming of many major pictures is delayed.In San Diego County, indoor movie theaters are able to operate at either 25% capacity or 100 people, whichever is fewer. While the indoor movie industry is taking a hit right now, Yeagley said he expects it to bounce back eventually, however it will take time and could look different once it recuperates.“I think so because people like to escape and that’s what you do in a movie. You quit thinking about it, are present for two hours, focused on something. That’s enjoyable. I can’t imagine people not wanting that.” 2581

SAN DIEGO (KGTV) — As a woman lay paralyzed from a horrific accident, police say someone was inside her car, stealing from her.  The search for that thief is now turning to San Diego County."She was the nicest, most wonderful person I've ever known," said Don Nelson.Nelson says his wife of 27 years, Terri, was on her way to pick up her father for a hospital trip in August when a truck rear-ended her car at a stoplight in Riverside.  As she lay with her neck broken, amid the commotion of bystanders and first responders coming to her aid, police say someone got into her car and stole her purse.Detectives say within days of the accident, surveillance images show her using Terri's credit cards and writing checks in her name. Nelson says as some ,000 worth of purchases were made at various businesses, from fast food restaurants and Albertsons to Costco."I think that's the lowest form of life that could possibly be. You have to be a sorry person to do something like that," said Nelson.For three months, Terri was paralyzed and on a ventilator, until she passed last week from complications from the accident.  Her husband's grief is not the only emotion that consumes him. There is also anger. He's still dealing with collection agencies seeking money from the thief's shopping spree.  During that crime spree, police believe the woman rented a Nissan Rogue in Terri's name, before the CHP pulled that car over on a highway in San Diego County. The two men inside the car have yet to lead detectives to the woman, but police hope tips from the public will."I just can't believe a lightning bolt didn't strike the person.
