SAN FRANCISCO — A California appeals court has upheld an order requiring Uber and Lyft to treat their California drivers as employees instead of independent contractors, less than two weeks before voters will be asked to exempt the ride-hailing giants from the state’s gig economy law. The two companies have more than 400,000 drivers in California alone. Treating Uber and Lyft drivers as employees would guarantee benefits such as overtime and sick leave.Uber and Lyft had appealed an August ruling by a San Francisco judge, but the appellate ruling found "no legal error" and allowed the earlier ruling to stand. The legal fight started after state lawmakers passed a law that says companies can classify workers as contractors only if they perform work "outside the usual course" of the company's business. Thursday's decision won’t have any immediate impact because it doesn’t take effect for at least 30 days, well after the Nov. 3 vote on Proposition 22.Uber and Lyft, along with DoorDash, have heavily bankrolled the ballot measure.Proposition 22 on the California ballot this fall asks voters to create a special designation for drivers of app-based companies to be excluded from the new state law. 1216

SAN DIEGO (KGTV)- Hospitalizations related to COVID-19 continue to increase across San Diego County.The county’s latest numbers show 458 patients hospitalized, while 178 are in the Intensive Care Unit.“It is not quite what we’re seeing in Florida and Houston, but we are seeing an increase for sure,” said Dr. Julie Phillips, the medical director of Sharp Grossmont’s Emergency Department.“Almost every ER in the county has their tents set up, and they never took them down despite us not needing to utilize it for a number of weeks, if not even about six weeks, then starting last week it is back in use,” said Phillips.Currently, Sharp Grossmont has 27 hospitalized COVID-19 patients, while Sharp Chula Vista has 44, and Sharp Memorial has 29.Phillips said most local hospitals are well equipped to handle the surge.“All of us have staffed up beds by 150 percent awaiting for this,” she explained. “We know a lot more; we feel better about knowing how it’s transmitted, we feel better about our PPE, especially our N95 masks. Flattening the curve gave us time to get what we needed ready to go, so now we’re ready.”On Friday, Scripps Health reached a single-day all-time high number of hospitalized COVID-19 patients.At its five locations, a total of 126 people were hospitalized. Earlier that week, the number was still in the 90s.Both Scripps Mercy in San Diego and Chula Vista had 38 patients hospitalized at each facility.The numbers were the highest for a single day since the pandemic began.Infectious disease specialist for UCSD Health, Dr. David Pride, tells 10News UCSD’s hospital system is also seeing an increase.“Going back to early June, we admit between 1 and 6 new patients per day. The rolling average is a bit higher the last couple of weeks,” said Pride via email. “We are operating near our capacity, but largely because we accept outside hospital transfers readily who need a higher level of care than their hospitals can provide. We still maintain surge capabilities, so we could admit many more patients should the situation get more dire.”A spokesperson for Palomar Health said they had seen an increase in patients in the last couple of weeks, but still have plenty of capacity.Kaiser Permanente has also seen a recent rise in COVID-19 related hospitalizations.The following statement was sent to 10News.“Consistent with other San Diego County hospitals, Kaiser Permanente has seen a recent rise in COVID-19-related hospitalizations. Most notably, we are seeing an increase in a younger, less acute population. We remain confident in our ability to provide care to all our members and are grateful to the San Diego community for continuing to practice social distancing and wearing a facial covering when outside of their homes.”As the Fourth of July gets closer, Phillips wants to remind people it is crucial not to let your guard down, and to continue taking safety precautions is they do choose to gather with friends or extended family.“I understand people are tired of it, but we’re not over it,” she said. “You have to take precautions, you must wear a face mask, you need to social distance, and you need to wash your hands.” 3166

  

SAN DIEGO (KGTV)-- Today is the peak travel day for the Thanksgiving holiday. AAA expects more than 54 million Americans to travel more than 50 miles from home this season. While many are dreading the drive, others have chosen to take the rails.Gary Green was visiting his friend in San Diego for the last few days. But he is making the trip back to Los Angeles on the Amtrak Pacific Surfliner. "The car is a painful experience. The 405 is obnoxious. The 101 is obnoxious. People are miserable, and it's the wrong time of year for that," Green said. While motorists are thankful that gas is about SAN DIEGO (KGTV)- When the pandemic hit city leaders opened the San Diego Convention Center doors to house those living on the streets. But as that time will soon come to an end, the San Diego Rescue Mission is working to give those in need a safe place to stay.The transition during the pandemic was not easy.“For people experiencing homelessness, the rates of COVID have been very low, but it was absolutely a struggle,” says Paul Armstrong with the San Diego Rescue Mission.The City of San Diego recently announced its plan to close the convention center by December. The state has reserved funds to help the city buy at least one hotel to house the homeless. Unfortunately, the hotel’s 340 units won’t be enough space for everyone.“As they ramp down their operations there, we have to be mindful to make sure we’re giving as many opportunities to the people in the convention center,” says Armstrong.The San Diego Rescue Mission is stepping in to help. Team members visit the convention center a few times during the week to notify the people of their programs.Their emergency shelter is available for women and children.They also have a year-long “Mission Academy.” It’s a three-semester program. Semester one focuses on wellness. Semester two is center around education and training.“Semester three is really preparing them, letting them focus on housing and building up,” says Armstrong. “Working and building up that savings so that they can transfer into a successful, sustainable life.”The Rescue Mission says they have seen a large success rate from the students who have completed Mission Academy. 1617.25 / gallon cheaper than a month ago, lower gas prices, mean more drivers are on the roads. Jessica Windell said she is not taking any chances on missing family time. "Especially with all the crazy fires going on lately, there are a lot of closures. She lives walking distance from San Diego's Santa Fe station, and the train will take her into Burbank.According to Amtrak, last year,  Santa Fe Station saw a 57% increase in riders the Wednesday before Thanksgiving and a 55% increase the Sunday following the holiday. "We're actually using every available fleet possible to accommodate all of our extra passengers," Amtrak spokesperson, Olivia Irvin said. That means every seat, including coach class requires a reservation. Even with a strict timetable, Amtrak admits, they are not perfect. If they experience delays, the company notifies passengers on Twitter. Earlier we saw announcements ranging from 20 to 48 minutes delay. Anything more than that, they say they have a Plan B."We often give passengers food packs and water," Irvin said. "If it's necessary, we'll bring in bus services to accommodate passengers."The hope is it never gets to that point.
