Jurors have found Border Patrol Agent Lonnie Swartz not guilty on the Second Degree Murder charge of shooting through the border fence and killing 16-year-old Jose Antonio Elena Rodriguez.Jurors could not come to an agreement on a verdict on the two lesser charges, voluntary manslaughter and involuntary manslaughter.If they wish, prosecutors can retry Swartz on the lesser charges only.Friday jurors told Federal Judge Raner Collins they could not agree on a verdict.  The judge told them to continue deliberating. They could choose to convict Swartz on lesser charges of Voluntary Manslaughter or Involuntary Manslaughter.Swartz testified he was protecting himself and other officers from rocks thrown over the border fence by people on the Mexican side trying to interfere with efforts to arrests smugglers who were trying to climb over the fence and into Mexico.In closing statements to the jury, prosecutors said in his two years as a Border Patrol Agent, Swartz had rocks thrown at him six or seven times, and each time had responded by using less lethal weapons. Border Patrol may use items like guns that shoot an irritating pepper.But the night of October 10, 2012, Swartz had been on duty at the DeConcini Port of Entry.  He had only his gun and used it to fire 16 rounds through the fence. Ten shots hit the 16-year-old Mexican teen.Prosecutors say the threat against Swartz and other officers was not severe enough to justify deadly force and that they could have easily removed any threat by taking cover.They say other agents took cover but Swartz was fed up with rockings, wanted to send a message, and did it by calmly walking to the border fence, taking careful aim, and firing 16 shots into Mexico.Defense attorney Sean Chapman told the jury rocks are enough of a danger to justify deadly force and that there is no evidence to conclude Swartz fired out of anger over rock attacks. KANSAS CITY, Mo. – A Kansas City, Missouri Police officer shot a pit bull Friday afternoon after the dog bit a USPS mail carrier.Officers and Animal Control responded around 4:30 p.m. local timeFriday to the 1500 block of NE 79th Street on the call.According to police notes, they located two “large, aggressive pit bull dogs” on the scene.While the animal control officer attempted to capture the dogs, one of them charged toward the officer, prompting the officer to open fire on the dog, striking it in the shoulder.The second dog ran away back to the residence it had escaped from where it was eventually captured.A few minutes after being shot, the dog jumped up and ran around a house where animal control captured it.During the course of the investigation, officers spoke with the owner of the two dogs.The owner was “belligerent” and did not want to accept responsibility for the dogs running loose in the neighborhood, according to police.  977

(KGTV) - In Jamul, community members are banding together to help a family-owned farm decimated by the Valley Fire.Cheryl Skidmore, the owner of Hidden Haven Ranch, was on the phone with workers on site."Very, very smoky fire. Hit the ridge and then came down very fast," said Skidmore.Some animals were evacuated, but the damage was heavy at the 16-year-old farm known for sustainable farming.All 125 chickens were killed. Most of the crops were destroyed: half of the orchards, from apples to apricots, and all of the industrial hemp fields. The flames also burned a trailer and much of the farm equipment."Everything is just devastated. We have to start over," said Skidmore.Skidmore says she tried to get wildfire insurance but was denied, partly because she’s in a fire-prone area. The total loss was about 0,000. Shutting down the farm became very possible."It's overwhelming," said Skidmore.The word 'overwhelming' could also be used to describe the outpouring of support."The community has been donating hens. Hopefully, we will be doing egg production next month," said Skidmore.The farm asked for help and the community responded with dozens of volunteers at three cleanup efforts, including one on this day. Volunteers have done everything, from raking ash and trimming trees, to moving dirt and cleaning horse stalls. Jordyn Brewer is one of those volunteers."When I saw the pictures of the devastation, it made me upset. If I were in that situation, I would want people to help me," said Skidmore.Skidmore says that help will mean the difference between shutting down and keeping the farm going."No way I could have done this myself ... Just to see people so willing to help others, just makes me feel so good," said Skidmore.A lot of cleanup remains at the 52-acre farm. KANSAS CITY, Mo. — The man whose wife was found dismembered in two ice coolers has been charged in connection with dismembering and abandoning her body. Justin Rey is accused of abandonment of a corpse and endangering the welfare of a child.  Lenexa police officers went to U-Haul on October 24 to check on Rey and his two children, who were reportedly sleeping in a storage unit. During the investigation, a woman’s remains were found in the unit. Court documents officially identified the remains as Rey’s wife. The documents said Rey’s wife, who family identified as Jessica Monteiro Rey, was found dismembered in coolers. According to court records, Rey was dragging several containers at the U-Haul facility when police spoke to him. Rey told officers his wife died after childbirth several days earlier, and her body was in the two containers. Court documents said Rey told police he spent two days with his wife’s body before dismembering her. Rey told detectives his two children were in the hotel room as he dismembered and disposed of his wife’s body. Prosecutors requested a bond of 0,000 cash. Rey is in custody in Johnson County. The Jackson County Prosecutor’s Office said the case remains under investigation.  1281

JOHNSON COUNTY, Kansas — Roughly 5,000 mail-in ballots will be tabulated in Johnson County Friday.The results from the mail-in ballots will be released beginning at 8 a.m. and continue until 5 p.m.The ballots could widen the margin between the two leading Republican primary candidates for governor: Secretary of State Kris Kobach and Gov. Jeff Colyer.When polls closed on Tuesday, slow reporting in Johnson County delayed results. Once the numbers came out the following morning, Kobach led by fewer than 200 votes.Since then, the numbers have been contested, but a 41 Action News county-by-county tally shows Kobach still in the lead.The Secretary of State’s office said it should have all the advance ballots that were mailed in, and any other unofficial election results that were not previously reported on election day.Provisional ballots will be reviewed and counted next week by individual counties. They must certify the results between Monday, Aug. 13 and Monday, Aug. 20.Colyer has asked Kobach to recuse himself from giving local election officials advice. 1081
