(AP) — As the political battle to overturn California's gas tax increase intensified, the state transportation agency coordinated frequently with the public affairs firm working to block the repeal on behalf of unions, construction companies and local government groups, emails obtained by The Associated Press show.The California State Transportation Agency and Sacramento-based Bicker, Castillo & Fairbanks organized news conferences and other efforts to promote legislation to raise the tax to fund road and bridge repairs, which passed the Legislature in April 2017. After Gov. Jerry Brown signed it, the agency and firm continued planning events and coordinating social media posts as opponents gathered signatures for repeal.Three ethics experts interviewed by the AP said the emails raise concerns that the agency's relationship with the firm was too close, but none saw a clear violation of campaign laws, which prohibit the use of public resources for political campaigns.REPORT: Gas tax funds reportedly being used to campaign against Prop 6The repeal qualified for the November ballot in June. GOP Congress members — including House Speaker Paul Ryan of Wisconsin, Majority Leader Kevin McCarthy of Bakersfield and Orange County's Mimi Walters — are among the repeal's biggest financial backers.Leaders of the repeal campaign have asked the federal government to investigate their claims that public resources have been used against them, based on emails and other documents that show local government workers discussing the repeal effort. Those documents are different from the ones the AP obtained. Opponents also circulated a video of a Caltrans contractor passing out anti-Proposition 6 fliers to drivers.The California Department of Transportation, known as Caltrans, falls under the state transportation agency.Melissa Figueroa, the agency's deputy secretary for communications and strategic planning, said it's the agency's job to inform the public about the impact of laws, and it has done so in the past, including for California's "motor voter" registration law."We're trying to be good stewards of taxpayer dollars," Figueroa said.The agency communicated much less frequently with the firm and stopped coordinating social media posts once the official anti-Proposition 6 campaign started, Figueroa said."Prior to that point, it was more of a collaborative effort because they were not in campaign mode," Figueroa said.BCF partner Brandon Castillo said the coalition registered as a fundraising committee in December and officially became a ballot measure campaign in March to support Proposition 69.BCF and other gas tax supporters routinely asked the agency for information, but they did not coordinate on creating campaign materials, Figueroa said. The agency also fulfilled numerous public records requests filed by gas tax opponents, she said.However, an undated memo outlining agency and coalition plans from March through the primary election shows the firm and the agency coordinated the timing of announcements and events. It details plans for the state to tout new construction projects while the coalition campaigned for Proposition 69.The agency and coalition coordinated their schedules, but the agency wasn't involved in campaigning for Proposition 69, Figueroa said.Castillo sent the email about op-eds focused on GOP candidates Sept. 20, 2017."Hey Melissa — We're penning opeds (sic) targeting the following congressional republicans," he wrote. He identified Reps. Jeff Denham, Steve Knight, Walters and Issa and asked Figueroa for information about projects funded by the gas tax increase in their districts.At the time, the coalition was working to persuade California's influential Republican congressional delegates to reject the repeal.Several days after Castillo's email, Figueroa suggested she or Brian Kelly, then the agency's leader, help find an author for the piece targeting Issa, considered the most vulnerable California incumbent before he decided against seeking re-election.Castillo responded saying coalition members were working on it and asked: "Do you have anyone in mind that could influence Republicans/Issa?"The documents obtained by the AP don't include further exchanges on the issue. In interviews, Castillo and Figueroa said the agency never suggested an author. Figueroa said she offered help because the op-ed would educate people in Issa's district.The piece ultimately was written by the mayor of Encinitas, a suburb north of San Diego, and ran the following month in the San Diego Union-Tribune. It touted projects in the district funded by the gas tax increase but didn't mention Issa.Levinson found the exchange surprising because it seemed to directly reference campaign activities."I don't want to say it's a smoking gun, but that is so much more explicit than I ever would have predicted they would be," she said.Prominent gas tax repeal supporters, including gubernatorial candidate John Cox and conservative activist Carl DeMaio, criticized the agency's activity."It's against the law, and it also shows that you can't trust them with money," DeMaio said. (AP) — California voters could decide in 2020 whether it should be easier for their local governments to raise taxes and issue bonds for affordable housing, road improvements and other public projects.A constitutional amendment proposed Wednesday would lower how much voter support communities need to raise money for infrastructure projects from two-thirds to 55 percent.Assembly Democrats say the current threshold allows a minority of voters to derail needed projects."These two-thirds thresholds are meant to enable a boisterous minority to impede progress," said Assemblyman Todd Gloria of San Diego.But taxpayer advocates said it would make things more expensive for homeowners in particular because it could lead to more parcel taxes, a flat tax levied on property owners."If this passes it's going to be devastating for property owners," said David Wolfe, legislative director for the Howard Jarvis Taxpayers Association.Constitutional amendments need support from two-thirds of lawmakers to land on the ballot, and the backing of a simple majority of voters to become law.Assemblywoman Cecilia Aguiar-Curry, a Democrat sponsoring the amendment, said she hopes to place it on the November 2020 ballot. That would coincide with the presidential election, which usually draws the highest voter turnout and millions more Democrats than Republicans.It would apply to projects including affordable housing, wastewater treatment, fire and police buildings, parks, public libraries, broadband expansion, hospitals and more.Local governments typically fund those projects through bonds or special taxes, like the parcel tax or a dedicated sales tax.The 55 percent threshold would still be higher than the simple majority communities need to raise general taxes, such as sales taxes not dedicated to special projects.Democrats highlighted projects that have narrowly missed the two-thirds threshold to make their case, such as a recreation center restoration in Millbrae and road repairs in Eureka."I have heard about deteriorating buildings, decrepit community facilities and our extreme lack of affordable housing," said Aguiar-Curry, a former mayor of a small rural California city. "This will empower communities to take action at the local level to improve the economies, neighborhoods and residents' quality of life."But Wolfe, of the taxpayers association, said the list of allowable projects is broad and could lead to a slew of new tax and bond proposals from cities and counties that could saddle taxpayers for years."These are pretty encompassing categories and there's no limit," he said. Gavin Newsom moved Friday to bypass environmental regulations to prepare for the next wildfire season, a move he said was necessary to prevent further loss of life even as it frustrated activists in a state viewed as a national environmental leader."The increasing wildfire risks we face as a state mean we simply can't wait until a fire starts in order to start deploying emergency resources," Newsom said in a statement ahead of declaring a state of emergency.California experienced two of its most destructive and deadly wildfire seasons in 2017 and 2018 and experts say climate change increases the risks. Newsom said clearing dead trees at a quick pace is essential to diminishing future threats. President Donald Trump has blamed California fires on poor forest management, though experts say climate change caused by people is more of a factor.Newsom is taking recommendations from the California Department of Forestry and Fire Protection, but one environmental group likened it to actions by Trump."Gov. Newsom should reject the Trump approach of logging and rolling back critical environmental protections," said Shaye Wolf, climate science director for the Center for Biological Diversity.Newsom also pledged million for fire preparedness in low-income communities and asked the private sector to bring forward innovative proposals.The center and other environmental groups said focusing on retrofitting and creating defensible space around homes is more effective than thinning forests. Sierra Club California said clearing trees might create more danger by loosening soil that could lead to mudslides.Newsom's order will apply only to 35 projects covering nearly 141 square miles (365 square kilometers) of land, allowing state fire officials to go around multiple state regulations. They include provisions of the California Environmental Quality Act, one of the nation's strictest state-level regulations. Administration officials would need to give the go ahead to each individual project and it's unclear exactly which regulations each individual project would forego.Newsom said moving through the normal process would drastically slow down the state's ability to act."Some of these projects quite literally, not figuratively, could take two years to get done, or we could get them done in the next two months," he told an audience in Lake County, the site of several massive wildfires in recent years.The union representing state firefighters praised Newsom's plan."These circumstances are unusual, unpredictable, unseen in our lifetime, and courageous decisions that sometimes go against the political winds need to be made," said Tim Edwards, president of CAL Fire Local 2881.Republican state Sen. Pat Bates also praised Newsom for acting with urgency ahead of the wildfire season."I stand ready to assist the Governor with any legislative action to eliminate bureaucratic roadblocks that could slow these projects," she said in a statement.While environmental groups bristled at Newsom's plan, they still align with him on a wide range of issues.
