SAN DIEGO (KGTV) -  A popular Thai restaurant in the College Area has been broken into for the second time in three weeks.At Sala Thai, there are sizzling entrees and simmering frustrations. "Saw the mess on the floor and thought what's going on?" said owner Chira Svangvitaya.A look at the surveillance video gave Svangvitaya the answer. Just before 5:30 Monday morning, a man in a hoodie is seen creeping into through the back door. He heads right to the cash register but finds it empty.He grabs some paperwork, empties the change dish and moments later, he leaves. It isn't for long. "He walked in and out three times, like he's not afraid of anything," said Svangvitaya.Two more trips nets him armfuls of stuff, including a computer, iPad, iPod, checkbooks and a case of soda. Near the end, he takes off his hood - and Svangvitaya's heart sank."I feel so sad and annoying. I don't know what I did to him," said Svangvitaya.The intruder is a stranger to her, but appears to be the same man who broke into the restaurant early Halloween morning. On that occasion, he used a crowbar to mangle the lock and damaged the register while grabbing 0 in cash. He also nabbed five tablets and a computer, crippling her online delivery business.Svangvitaya spent 0 to add a deadbolt after the Halloween break-in. This time, the intruder destroyed the repaired lock and the new deadbolt and went right on in. SAN DIEGO (KGTV) -- A former Yuma Police officer charged with raping a woman in San Diego is coming face to face with his accuser’s mother. Jared Elkins didn’t flinch in court Tuesday as his wife’s cousin accused him of raping her over and over in her Kensington home. The woman says she didn’t yell because the former officer threatened to kill her. After the rape, the victim said in court that she ran into her mother’s room and escaped out a window. Her mother’s 911 call played in court Tuesday. Elkins’ wife was asleep across the hall. Police body cam footage showed the accuser hysterical in the back of the police car. The woman can be heard telling the officer how afraid she was. Elkins argued that the sex was consensual and the rape charges were made out of guilt. Elkins pleaded not guilty. His attorney said he used bad judgement but the sex was consensual and the two were drinking.He’s facing nine felony counts including forcible rape and could serve 14 years in prison if convicted. Elkins resigned from the Yuma Police Department in 2017. 1066

SAN DIEGO (KGTV) -- A .2 million judgment against the San Diego Rock ‘N’ Roll marathon over injuries suffered by an elite wheelchair athlete was recently upheld.Craig Blanchette was born without legs due to a birth defect, but that has not stopped him pursuing his passions. He is a wheelchair racing champion. At 20-years-old, he won a bronze in the 1988 Summer Olympics and over the years, set more than 20 world records. “Wheelchair racing just fit me,” Blanchette said. He eventually took a break to compete in hand cycling, but was preparing to return to wheelchair racing. Court documents said he did everything to prepare for the 2014 Rock ‘N’ Roll marathon, including studying the course map and virtual tour several times. Documents state Competitor Group, which operates the marathon, eliminated a lane on Eleventh Avenue an hour before the race—a move that changed Blanchette’s life. “I wasn’t racing recklessly. I was definitely going to make the corner,” Blanchette said. “When it’s too late to do anything about it, I realized the course had been narrowed by 13 feet. It was significant.” Blanchette was not aware of the change and crashed into a car. He was going more than 20 miles per hour at the time, according to court documents. “It’s the crash that ended my career,” Blanchette said.He filed a civil case against Competitor Group. A jury ruled in his favor and the Court of Appeal recently upheld a judgment of .2 million in his favor. “It’s the best they can offer because they can’t me my racing career back,” he added.It was bittersweet for Blanchette, who had to undergo surgery and several months of recovery. “The doctors basically told me that if I went back to racing and I injured it again, they wouldn’t be able put it back together like I did the first time,” he said.Blanchette now hand cycles, which uses different muscles, and spends time helping other athletes. He has been part of the National Wheelchair Sports Camp for years and this year, Blanchette’s attorney is also helping out. “This case was very eye-opening for me,” said attorney Russel Myrick. “With the proceeds from the case, we intend to make big improvements to the camp and we’re really looking forward to working with the kids.” They hope this ruling will help other athletes with disabilities. “They didn’t accommodate for us in the way that we deserved,” Blanchette said. “[You] want to treat us the same in value, but not the same in function.” Competitor Group did not return Team 10’s request for comment. 2529

SAN DIEGO (CNS) - The wife of an active-duty Marine stationed at Camp Pendleton is due in court Thursday on charges of sexually abusing a 15-year-old foreign exchange student who was living with her family on the base.Nicole Marie Wilson, 22, is accused of engaging in sex acts with the unidentified teen on Sept. 20 against his wishes, according to court documents.A detention hearing is scheduled Thursday morning for Wilson, who pleaded not guilty Tuesday to a single count of sexual abuse of a minor in San Diego federal court.Court documents allege Wilson sat next to the boy on the living room couch and asked him to promise that he wouldn't tell her husband, no matter "whatever happens tonight."After their initial encounter made him uncomfortable, the boy told investigators he went to sleep and awoke to Wilson touching him, then performing oral sex on him. She asked him twice whether she should continue, and one time he said, "No," yet she continued anyway, then later had sexual intercourse with him, according to the criminal complaint.She later "apologized" to him "and acknowledged" that it was not consensual, the documents allege.Wilson allegedly told Naval Criminal Investigative Service investigators she had been drinking on Sept. 20 and "blacked out" while watching television with the boy, but denied anything sexual occurred. But a search of her cell phone revealed WhatsApp messages between herself and the teen that confirmed the sexual encounter, court documents allege.It was not clear how long the teen had been living with the family, nor what country he traveled from as part of the foreign exchange program. 1648
