A Glendale, Arizona mother is speaking out after her daughter’s class was subject to an odd punishment. Brittany Trofy says her 7-year-old daughter and classmates were forced to walk in a circle on the Luke Elementary School playground last week as punishment. It was around noon that day and temperatures were likely in the high 90’s or even warmer.Trofy claims the march lasted anywhere from 20 to 30 minutes. She says her daughter told her about the punishment when she came home that day.According to Trofy’s daughter, several kids complained of headaches and cramps. "The school stripped me of my right to nurture my child when she didn't feel good by not letting me know she didn't feel good,” Trofy said. The Dysart Unified School District confirmed to KNXV that they are reviewing the teacher’s actions that day. We’re told that the practice is not “district approved.” However, a spokesperson says it only lasted around five minutes. Students were checked by a school nurse and none displayed any signs of heat exhaustion. The Dysart Unified School District would not elaborate if the teacher would be facing punishment or has a history of questionable decision making. A spokesperson told us they cannot discuss personnel matters. "My daughter is right now scared to go back to school for fear of seeing the teacher that got frustrated with them,” Trofy said. A police officer was informed of the incident. A California coffee shop refused service to a customer last week after he insulted a Muslim woman and her headscarf.According to KTLA-TV, the video was shot inside of a Coffee Bean & Tea Leaf store in Riverside, California on Friday. The video opens with a man standing in line for coffee."I said, 'Is this Halloween or something?" the man says."Why did you say that?" the woman filming asks."Why wouldn't I? Why wouldn't I?"The woman filming the encounter then pans over to show herself wearing a niqāb, a Muslim headscarf worn by women that covers all but a woman's eyes."What's wrong with me?" the woman asks again."I don't know, you tell me what's wrong with you," the man says.  705

A federal judge has dismissed several charges against Dr. Jumana Nagarwala in the historic female genital mutilation case, ruling that the federal law against female genital mutilation is unconstitutional.U.S. District Court Judge Bernard Friedman ruled that Congress did not have the power to enact a federal law that banned female genital mutilation in the United States.Instead, Friedman made the argument that the law was too broad and it violated Congress' powers, as the law does not stand up to scrutiny under either the Necessary and Proper Clause or the Commerce Clause of the US Constitution.He also found that laws penalizing Female Genital Mutilation should be handled at the state level, similar to laws regarding Criminal Sexual Conduct, battery or child abuse.  Shannon Smith is the Defense Attorney for Dr. Nagarwala.  She says the ruling is "absolutely a huge victory. When you actually studied the law they enacted, there was no constitutional basis for them to enact the law. It’s really an issue that should be left to the states."Smith also claims the doctors did not perform Female Genital Mutilation, saying instead they performed a mild form of female circumcision."What Dr. Nagarwala was doing, if we had gone to trial, would have been vindicated that she was not mutilating little girls. While we’re happy with the victory and we’ll certainly take it, there’s a part of me that’s a little disappointed that the public isn’t going to see the evidence brought out at a trial to see that she was never guilty of it in the first place," Smith said.The ruling comes after Friedman also dismissed a "conspiracy to transport minor with intent to engage in criminal sexual activity" charge in January. That was the only count that could have lead to life in prison for both Nagarwala and Dr. Fakhruddin Attar.Friedman's ruling leaves two counts in place in the case. A Brooklyn woman whose racist, profanity-laced tirade on the New York subway was captured on video this week has been charged with felony assault after she struck a fellow passenger, authorities said.The dispute between Anna Lushchinskaya, a 40-year-old white woman, and the 24-year-old passenger, a woman of Asian descent, began after Lushchinskaya bumped into the woman early Tuesday, the New York Police Department told CNN.Lushchinskaya yelled profanities at the victim on the northbound D train, hitting her with an umbrella and keys, the NYPD said. On video captured by witnesses, Lushchinskaya can be heard calling the woman a racial slur.Lushchinskaya was apprehended at the 36th Street Station and arrested, the NYPD said.CNN could not reach Lushchinskaya or her attorneys for comment Friday.Lushchinskaya was arraigned in Kings County Criminal Court following the incident, according to Brooklyn District Attorney spokesperson Oren Yaniv. One person threatened to call the police.The video shows Lushchinskaya striking the woman several times with her umbrella and her keys and again kicking her."She's not even fighting you back," one person is heard saying.At least two subway riders tried to wrestle the umbrella away.Lushchinskaya is seen spitting in the direction of the victim before yelling more profanity and a racial slur.Juan Ayala, who was filming the incident, said he decided to intervene, but Lushchinskaya lashed out at him. A video posted by another user shows Ayala talking to Lushchinskaya."Do not spit at me," Ayala says in the video, to which Lushchinskaya replies, "What are you, her attorney?
