A New York judge dismissed count 6 of Harvey Weinstein's criminal indictment Thursday, which was a criminal sexual act in the first degree. The count stems from charges brought forth against the disgraced movie producer in May by Manhattan District Attorney's Office.A source familiar with the investigation told CNN at the time that the criminal sex act charge was from a case involving aspiring actress Lucia Evans, who alleged Weinstein forced her to perform oral sex on him in his Tribeca office in 2004. She first spoke out about the alleged incident to Ronan Farrow in the New Yorker last fall.Carrie Goldberg, an attorney for Evans, spoke to reporters outside the court in lower Manhattan following the dismissal, and said the prosecution "jumped ship" and "ultimately she was caught between the middle of a feud between the NYPD and the DA's office."Goldberg added that despite District Attorney Cy Vance not opposing a motion to dismiss the charges against Weinstein, her client's claims remain and this "does speak to a system desperate in need of reform.""People always ask why don't sexual assault survivors come forward, this is why. Today is why," Goldberg said. Goldberg detailed how prosecutors used Evans for months and "put her through needless torture."The attorney said her client will continue her fight in other venues."Victims are becoming warriors and this is just the beginning," she added.Weinstein had previously pleaded not guilty to the six sex crimes he's been charged with in New York, including two counts of rape.Weinstein's bond was set at million and he is required to wear a GPS monitoring system and is only allowed to travel within New York state or Connecticut.Weinstein is also under investigation for alleged sex crimes in Los Angeles and London.CNN has reached out to Weinstein's representatives for comment. 1861

A terrifying email scam using stolen passwords and sextortion is trying to scare many out of their money. There are variations of the blackmail threat, but in most cases, a password that someone once used or is still using appears in the subject line of the email. The hackers claim to have "evidence of your secret" after installing malware on adult video sites. The email explains web cameras were hacked and recordings were made of the person watching the pornography. The hackers then demand anywhere from ,000 to ,600 in bitcoin or the video will be released to all contacts, including family members and co-workers."It's a non-negotiable offer, thus please do not ruin my personal time and yours," one hacker wrote. "The clock is ticking.""It's really electronic blackmail," cybersecurity expert Tim Dimoff said. "This is a very well-structured blackmail. Boy, it looks believable."However, it's all a nasty scam. There are no videos and the hackers may have one of your passwords, but they don't have all of your information."If you look in the body of the email, they're not using your name. They're not saying what specific website you might be going to and they don't have a screenshot of you," said Christy Page, the president and CEO of the Better Business Bureau in Akron.Page said more than 130 complaints have reported nationwide through BBB's scam tracker. It's not clear how many of those people gave up the ransom, but it's estimated 0,000 has been paid this year by people frightened by the threat."The fear of embarrassment can be very powerful to get you to part with your money," Page said.Dimoff and Page said the hackers likely used the dark web to buy passwords that were stolen during data breaches and the hackers can be very difficult to track.Page said anyone who receives the email should not pay any money or respond to it. However, passwords should be changed immediately. In addition, Page said people should consider using a password manager and a web camera cover for extra peace of mind. Some BBB offices offer the covers for free.Consumers who want to find out if their passwords have been compromised can go to the security website Have I been Pwned which collects information on data breaches. 2272
A massive cloud of Sahara Desert dust is blanketing the Caribbean as it heads toward the U.S. with a size and concentration that experts say hasn’t been seen in half a century. The thick dust cloud, known as the Saharan Air Layer, is making a 5,000 mile trip from the northern Africa desert to North and Central America along the east to west Trade Winds along the equator. The Saharan Air Layer is between 5,000 and 20,000 feet above the Earth's surface, and dust plumes travel over the Atlantic Ocean several times a year between spring and fall. This year's dust plume is thicker than normal, the concentration of particles in Puerto Rico are the highest in decades. Air quality across most of the Caribbean region fell to record “hazardous” levels Monday and experts who nicknamed the event the “Godzilla dust cloud” warned people to stay indoors and use air filters if they have one. 896
