LOS ANGELES (CNS) - The company that operated the helicopter that crashed in Calabasas in January, killing Laker legend Kobe Bryant and eight others, is fighting back against lawsuits over the tragedy, filing a suit of its own contending air-traffic controllers are to blame for the crash.The suit, filed last week as a cross-complaint to litigation against Island Express Helicopters, contends the crash was "caused by a series of erroneous acts and/or omissions" by a pair of air-traffic controllers at Southern California TRACON, or terminal radar approach control.Ian Gregor, a spokesman for the Federal Aviation Administration, which operates the facility, said the agency "does not comment on pending litigation."The helicopter, a 1991 Sikorsky S76B piloted by Ara Zobayan, crashed amid heavy fog on Jan. 26 on a Calabasas hillside, killing the pilot and his eight passengers, including Bryant and his 13-year-old daughter Gianna.At least four lawsuits have been filed against Island Express Helicopters in the months since the crash, including one by Bryant's wife, Vanessa, and others by relatives of other passengers aboard the aircraft.In its cross-complaint, attorneys for Island Express contend that Zobayan contacted the SoCal TRACON facility and requested "flight following," or radar assistance. The request, however, was denied by an air-traffic controller who said, "I'm going to lose radar and comms probably pretty shortly," according to the lawsuit."This denial was improper because radar contact had not been lost and services were being denied based on the possibility that they might be lost at some point in the future," the lawsuit states. "The fact that (the pilot) was able to contact (TRACON) four minutes later, and its transponder was still observed by the controller, proves that the prediction of lost contact was not accurate and services could and should have been provided continuously."The lawsuit claims that the air-traffic controller who initially spoke to Zobayan was relieved a short time later by a second controller. The first controller, however, failed to inform his replacement "as to the existence" of the helicopter, even though he had never "terminated radar services" with the helicopter, leading the pilot to assume "he was still being surveilled and being provided flight following."It was at roughly that point that Zobayan reported his plan to begin climbing above the clouds and fog while banking to the left. A short time later, the helicopter plunged rapidly into the ground, resulting in the fiery crash that killed all aboard, according to the lawsuit.The suit accuses the initial air-traffic controller of "multiple errors," including "failure to properly communicate termination of radar flight following, incomplete position relief briefing and lack of knowledge of current weather conditions." Those failures added to the pilot's stress, workload and distraction, and "significantly impacted the pilot's ability to fly the aircraft."The suit seeks unspecified damages. 3039

LOS ANGELES (CNS) - A pair of active-duty U.S. Marines stationed at Camp Pendleton were arrested Tuesday morning on a federal grand jury indictment charging one of the Marines and three civilians with conspiring to distribute narcotics -- including oxycodone pills laced with fentanyl -- to civilians and members of the Marine Corps, one of whom suffered a fatal drug overdose in May.Lance Cpls. Anthony Ruben Whisenant, 20, and Ryan Douglas White, 22, were expected to make their initial appearances Tuesday afternoon in U.S. District Court in Los Angeles. Whisenant allegedly distributed narcotics to fellow Marines, including the one who overdosed, and White is charged with being an accessory after the fact for allegedly attempting to hinder the apprehension of Whisenant and an alleged drug supplier named in the indictment.The 14-count superseding indictment also charges:-- Jordan Nicholas McCormick, 26, of Palmdale, the lead defendant and the conspiracy's alleged supplier of LSD, ecstasy, cocaine and oxycodone pills laced with fentanyl to co-conspirators-- Gustavo Jaciel Solis, 24, of Sylmar, who allegedly distributed McCormick's drugs to civilians and military personnel-- Jessica Sarah Perez, 23, of Pacoima, who allegedly distributed narcotics, including fentanyl and cocaine, to civilian customersOn Aug. 11, Solis and Perez were indicted on fentanyl and cocaine distribution charges, and Solis was indicted on firearms-related charges. They have pleaded not guilty and their trial date is scheduled for Oct. 27. Solis is in federal custody and Perez is free on ,000 bond.Tuesday's updated indictment adds McCormick -- who is also in federal custody -- Whisenant and White as defendants, in addition to adding charges to the original indictment. According to the indictment, the conspiracy lasted from last November through this month and involved multiple sales of fentanyl- laced oxycodone to an undercover buyer, often for amounts exceeding ,000 per buy.On May 22, Solis sold 10 pills of oxycodone laced with fentanyl to an active-duty Marine who died of a drug overdose in the early morning hours of May 23, the indictment alleges.In addition to the conspiracy charge, McCormick, Solis, Whisenant and Perez face substantive charges of distribution of narcotics, including fentanyl. McCormick and Solis are also charged with possessing firearms in furtherance of drug crimes.If convicted, McCormick and Solis would face a sentence of 10 years to life in federal prison, and Whisenant and Perez would each face up to 20 years behind bars. White, if convicted, would face up to 10 years in federal prison. 2637

The agency began investigating conditions at the plant on June 19 after being notified by a "concerned health care provider."According to the department, investigators asked the company for a list of all employees so it could be compared with testing results, but the company failed to provide it.In late June, inspectors found violations at the facility of distancing requirements and infection-control protocols, according to the department, noting that the company was using cardboard as a barrier between workers.On July 4, the company sent the department an "incomplete list" of employees, and by then 198 positive cases had been reported. But as of Friday, that number had risen to more than 300, according to the public health agency.Health officials said that despite the company being ordered closed in late June, LA Apparel reopened the factory with new employees, and company officials tried to prevent health inspectors from entering the facility. 2309

LOS ANGELES (AP) — Georgia Engel, who played the charmingly innocent, small-voiced Georgette on "The Mary Tyler Moore Show" and amassed a string of other TV and stage credits, has died. She was 70.Engel died Friday in Princeton, New Jersey, said her friend and executor, John Quilty. The cause of death was unknown because she was a Christian Scientist and didn't see doctors, Quilty said Monday.Engel was best known for her role as Georgette on "The Mary Tyler Moore Show," whose character was improbably destined to marry pompous anchorman Ted Baxter, played by Ted Knight.Engel also had recurring roles on "Everybody Loves Raymond" and "Hot in Cleveland." She was a five-time Emmy nominee, receiving two nods for the late Moore's show and three for "Everybody Loves Raymond."Engel's prolific career included guest appearances on a variety of shows, including "The Love Boat," ''Fantasy Island," ''Coach" and "Two and a Half Men." Her "Hot in Cleveland" role reunited her with Betty White, her co-star in "The Mary Tyler Moore Show."She appeared on Broadway in plays and musicals including "Hello, Dolly!", "The Boys from Syracuse" and, most recently, "The Drowsey Chaperone" in 2006-07.Engel's final credited television appearance came last year in the Netflix series "One Day at a Time." 1299
