SAN DIEGO (KGTV) – Californians voted to pass Proposition 22 – reclassifying rideshare drivers as independent contractors. But, companies like Uber and Lyft are still battling lawsuits from the state claiming billions in wage theft.The legal battle over rideshare drivers did not end with the passing of Prop 22. The California Labor Commissioner is still suing gig companies for not following current law which classifies drivers as employees instead of independent contractors.The Labor Commissioner’s Office is seeking billions for unpaid minimum wage, overtime, sick leave, and business expenses.Nicole Moore with Rideshare Drivers United led the fight against Prop 22. She says since the new law is not retroactive those lawsuits still stand.“This is about back pay that under the law as it was over the last three years, those drivers are still owed that money,” said Moore. “It was .3 billion that were owed to those drivers. Half of that is damages but the other half is just straight pay that under labor law.”Some drivers had to file for unemployment when the pandemic hit, including those with pre-existing conditions hoping to limit exposure to the virus. Others are unable to drive since they have to stay home with kids now out of school for distance learning.Moore says those unemployment protections won’t last once the new law takes over.“If you don’t have unemployment that’s when people become homeless, that’s when kids go hungry. We need that safety net as workers,” said Moore.As San Diego moves into the state’s purple tier, Tonje Ettesvoll says she’ll have to limit hours to reduce her risk of exposure. She says the move for her own safety may prevent her from qualifying for benefits under Prop 22.“I will not be doing my 60 hours a week. I’ll be doing maybe 30 so I may be one of those people who don’t qualify and will have to be on Medi-Cal,” said Ettesvoll. “And that is an expense that’s not Uber’s and Lyft’s. That is an expense that’s the taxpayer’s and I think that’s very unfair.”Uber and Lyft both declined to respond to our inquiry on the pending lawsuits. Uber did send us this statement: 2136

City governments are coming up with different ways to help local businesses stay afloat.Rediscovering the great outdoors has been a roller coaster ride for city tacos owner, Gerald Torres."We kind of did a 180 and closed it all down, and now we're doing a 180 again and opening up for patios," Torres said about his La Mesa location. This comes after the city of La Mesa enacted an Executive Order on Thursday, which allows businesses to use outdoor spaces for dining, displaying products, and other services.Meanwhile, Coronado waived its alcohol prohibition in city parks, just ahead of this weekend's Spreckels Park Outdoor Dining Room event. This is a move to get people to buy local take-out, and picnic outdoors.Coronado also approved gyms to hold classes at Spreckels Park, Bradley Field, and the beach."We feel fortunate that we live in a town where we can just jump out into the park and do yoga," Stephanie Anderson with Island Yoga Coronado said.Tuesday, San Diego Mayor Kevin Faulconer signed an Executive Order waiving permitting requirements for sidewalks and parking lots for restaurants expanding outdoors.On the same day, Chula Vista approved plans to block off car traffic on Third Avenue on weekend evenings. This will help diners expand their businesses onto the entire street, not just on sidewalks and parking lots. The Third Avenue Village Association will discuss details and the start date at a special meeting next Wednesday.On Wednesday, Poway approved its Shared Outside Spaces (SOS) program, which lets houses of worship and gyms to hold activities at city parks. The city began accepting applications Friday morning. The city says we could be seeing yoga classes at parks as early as Monday.Both local governments and businesses must stay nimble to fight through the pandemic."There is no quit in my team," Torres said. "Everyone has stepped up to the plate. We find out what the rules of the game are now, and operate within those rules."All local governments say in order to operate outdoors, businesses must still follow all health guidelines set by the county and state. 2252

SAN DIEGO (KGTV) - By a unanimous vote, the San Diego City Council voted Monday to hike pedicab fees, making it nearly twice as costly to be a pedicab driver.      Police say the increase for annual operator fees from 2 to 9 is needed because of extra enforcement, including aggressive inspections and undercover operations targeting price gouging.Ali Horuz, who manages four different pedicab companies, says the higher fees will be a hardship, especially for drivers getting into the business.  He says right now, the local market is short about 50 drivers."It's going to be harder to find qualified drivers. We're competing against Uber and Lyft. It's definitely going to affect the market, where we are going to see fewer pedicab drivers," said Horuz.While the number of drivers is shrinking, the regulations may be increasing.  Citing complaints from the community, Councilman Chris Ward wants the city to set a uniform rate structure, while banning loud horns, flashing lights and amplified music. Horuz says the lights and loud horns are needed safety precautions, while overly loud music is a product of a few bad drivers.A council committee will look at the proposal Wednesday. 1240

SAN DIEGO (KGTV) - As the San Diego Padres reopened training camp - this time at Petco Park - a Padres fan is hoping to share one of the only seats in town for baseball.For the past eight years, Chip Messenger has leased a unit on the 15th floor in the Legend building, overlooking Petco Park."The view never disappoints. Everyone is always amazed," said Messenger.The view is about to become even more priceless because the Padres aren't expected to open up the stadium to fans when they start the season later this month. Messenger will have one of the only seats in town to watch live baseball."Looking for forward to it. I think people have been isolated and bored. Ready for something positive to happen," said Messenger.In late June, Messenger tweeted a photo of his view of Petco Park, sparking thousands of likes and hundreds of replies."They tell me, 'I'll bring the beer. I'll bring the fish tacos. Do you remember me from first grade? Do you need a new best friend?'" said Messenger.Messenger will be making a lot of new frends. This season, he plans to share his balcony with other baseball fans."This is a unique opportunity, and I'm happy to share it with people who won't get a chance to watch baseball," said Messenger.He hasn't figured out how he'll divvy up the invites. The financial planner says he won't be accepting money, but probably won't turn down food or adult beverages. He's hoping his plans will also benefit the Padres. He counts about a hundred nearby balconies facing the stadium, which could translate into a lot of cheering."Probably going to be one of the few places in the country where we fans can actually watch our team play. Who knows, maybe the Padres could have a home field advantage. Could be pretty cool," said Messenger.Messenger is planning COVID precautions for his Padres viewing days.Only a handful of teams has similar views outside their stadium. SAN DIEGO (KGTV) - Cal Fire is battling a brush fire near East San Diego County on the U.S.-Mexico border. The flames broke out after 11 a.m. near the Cottonwood Creek area off SR-94, not far from Barrett Junction. 100 acres burned in the U.S., with the fire spreading to 650 acres in total by 7:30 p.m. It is 10 percent contained.The fire has a moderate rate of spread and was burning light brush, Cal Fire confirmed to 10News. There is no immediate threat to structures, officials said.Images from an SDG&E camera appeared to show heavy smoke over the area.Check 10News Pinpoint Weather conditionsEast County is under an Excessive Heat Warning due to high pressure.
