SAN DIEGO (KGTV) -- A San Diego man with Down syndrome met the man who saved his life by donating a kidney for the first time Wednesday. James Wellman met his donor, Paul Williams, for the first time after having his life-saving surgery.Wellman was diagnosed with Down syndrome when he was born, and in 2017 his kidneys were functioning at only 12 percent.His family grew concerned after he was rejected for a transplant by several programs in Southern California. 477

SAN DIEGO (KGTV) -- An attorney for a man charged with killing a South Bay music producer told a jury that her client took steps to dispose of the 28-year-old’s body out of fear of being accused of the murder, but did not actually carry out the brutal stabbing himself.Both the defense and the prosecution gave closing statements Monday in the high-profile murder trial of 54-year-old Timothy John Cook. Cook is charged with killing his Chula Vista housemate, Omar Medina, whose body was found in a 55-gallon drum floating in San Diego Bay in 2017.RELATED: Family of man found in barrel works to find closure, thanks Chula Vista PD for their efforts“Just because someone disposes of somebody, or even if they moved a couple things or tried to clean up a couple things, that does not mean the person killed them,” said deputy public defender Kara Oien. “He was trying to avoid the very predicament that we're in today.”Prosecutors have largely built their case against Cook on evidence of his activities after the murder, saying he launched a “monumental effort” to cover his tracks, clean up blood, and dispose of the body.Deputy District Attorney Cherie Somerville said cell phone evidence and other records show Cook lied about his whereabouts, and surveillance video shows him and co-defendant Derrick Spurgeon hauling the 55-gallon drum to San Diego Bay.RELATED: Man whose body was found in a barrel had been stabbed 66 times; suspect pleads not guiltySpurgeon is charged with being an accessory for allegedly driving the boat used to dump the victim's body. SAN DIEGO (KGTV) -- A state review board will decide Tuesday whether to grant parole to a former skateboarding star from Carlsbad who has spent nearly three decades behind bars for a brutal rape and murder.Mark “Gator” Rogowski was a world champion skateboarder in the 1980’s who drew comparisons to Tony Hawk. He parlayed his fame into endorsements and promotional videos until he entered a guilty plea to the 1991 rape and murder of Jessica Bergsten, whose body was found buried in the desert.“This was a horrific, heinous, monstrous crime by an individual who really doesn’t want to admit that he took out transferred rage on another innocent individual,” said Deputy District Attorney Richard Sachs, who will represent the state at Tuesday’s hearing.Rogowski was denied parole in 2011 and 2016, but his case was granted another review ahead of schedule, Sachs said. The parole board will determine if Rogowski remains a threat to the community based on a psychological assessment and other factors.In a promotional video by the prison rehabilitation non-profit Getting Out by Going In (GOGI), Rogowski said he’s taken accountability for the crime and found a higher power.“My identity as a man was skewed. I thought what it meant to be a man was to be a womanizer, to have a lot of relationships,” he said.In 1991, the former skateboarding celebrity invited Bergsten to his Carlsbad apartment. Bergsten was a friend of the girl who had just dumped Rogowski.In a fit of what he called “misplaced revenge,” Rogowski clubbed the young woman over the head, cut her clothes off with scissors and sexually assaulted her for hours. When she screamed for help, Rogowski covered her with a surfboard bag and strangled her through it. He then drove two hours into the desert and buried her naked body in a shallow grave.“Certain crimes are so horrible they shock the conscience and this is one of them,” Sachs said.Sachs said prosecutors will strongly oppose parole on public safety grounds, although he acknowledged he could not predict the board's decision. "We never know how they’re going to view somebody," he said.If the board grants parole, he said the DA’s office will appeal the decision to Governor Gavin Newsom. 2224

SAN DIEGO (KGTV) - A serial flasher who exposed himself to seven women near University of California San Diego was sentenced Thursday, according to City Attorney Mara Elliott. Nicholas Saienni, 34, pleaded guilty to four misdemeanor charges of indecent exposure and received a sentence of 180 days of custody, three years of probation, a waiver of his Fourth Amendment search and seizure rights, and court fines and fees. He was also ordered to register as a sex offender and get counseling. If he violates his probation, he could face an additional year and a half in jail, according to prosecutors. San Diego Police arrested Saienni after eight separate incidents between January and March 2019. Prosecutors said Saienni exposed himself to the women while dressed as a jogger and wearing a hooded sweatshirt to conceal his identity. Saienni confessed to the indecent exposure and admitted he had been convicted of similar acts in Delaware in 2018, Elliott reported.
