(KGTV) - Nearly six years after it passed, Proposition B will be in front of two courts this week, with the future of San Diego pension reform on the line.Prop B was on the ballot in June of 2012 and passed with 65% of the vote. It promised to solve San Diego's pension crisis by giving new City hires a 401(k) style retirement plan instead of a pension. The change went into effect for all city hires except police officers.Since then, it's been mired in legal challenges.Shortly after it passed, union leaders sued, arguing that any changes to union employment agreements have to be negotiated first before they're placed on a ballot. They said that then-Mayor Jerry Sanders violated that rule when he openly campaigned for the Proposition in 2012.In 2015, the State Labor Board agreed with the union claims.That ruling went to the California 4th District Court of Appeals, who overturned the Labor Board's findings in 2017.In 2018, the State Supreme Court reversed the 4th District's ruling. The Supreme Court sent the issue back to the lower courts to decide what an appropriate "remedy" would be to Sanders' improper campaigning."They did not say 'Overturn Prop B.' They could have," says Reform California's Carl DeMaio, who wrote Proposition B. "They said, 'Hey, district court, find out how you punish the City of San Diego for this violation.' What’s the punishment? A slap on the wrist, a speeding ticket?"The 4th District will hold an open session on Monday, March 11 to begin that process. DeMaio says if the District Court rules to overturn Prop B, he plans to appeal that decision."Do you think they’ll actually overturn the citizens initiative? If they do, we will counter-sue on the punishment phase," says DeMaio.Meanwhile, the US Supreme Court will also look into the Proposition this week. On Friday, they'll decide whether or not to hear a case based on the First Amendment. Supporters of Prop B say the California Supreme Court's ruling violated Mayor Sanders' First Amendment rights of free speech and his ability to openly support or oppose items on a ballot."The issue is whether for not elected officials have first amendment rights," says DeMaio. "Can an elected official actually give an opinion on a ballot measure? I think yes. Even if I disagree with that opinion, it is their constitutional right. But to him, the most memorable birth is the one that didn't happen on his watch.Huber was helping people evacuate from the terrifying wildfire that tore through the Northern California town of Paradise on Nov. 8 when he heard on the scanner about a pregnant woman going into premature labor.Anastasia Skinner's baby wasn't due for another month, but she began to feel contractions as she grabbed her mother's two dogs and raced to escape the fast-moving blaze. The flames had already hit her car by the time she fought the panic-driven traffic jam out of town and reached a gas station, honking the horn and screaming for help."I knew I wasn't going to make it," Skinner, 25, said during a phone interview on Friday. "I called my husband and told him goodbye, tell all the kids I love them and make sure they remember me."A motorcyclist who saw Skinner in distress flagged a police officer who helped her move to the back seat of her Honda Pilot. Several women who were stuck in the traffic jam brought her blankets and pillows, A retired fire chief came to her aid and someone requested a helicopter to airlift her to the hospital.Huber, the assistant chief of operations for Butte County Emergency Services, was two miles away but had to get through 30 minutes of gridlock to get to Skinner. When he arrived and evaluated her condition, he knew she couldn't wait much longer for a helicopter."The smoke was thick, and the winds were blowing. The helicopters were having a hard time fighting the fire let alone airlifting patients," Huber said.Because Skinner was having a high-risk pregnancy after suffering two miscarriages and other complications related to an inherited disorder, Huber said she may not have made it if she went into full-blown labor.He arranged a caravan that included three police vehicles to rush Skinner to an ambulance. Then he jumped in the back seat, where he kept her calm until she reached a hospital where her labor was stopped."He was sweet. He told me, 'I'm a guy. I don't know what this feels like for you, but I'll try to help you get you through it,' " Skinner said. "Then he would yell at people outside of the car, waving his hat and telling them to get out of the way.""My goal was to keep her breathing and get her down the hill," Huber said. "Two of my ambulance crews were trapped by the fire moments before I got to Anastasia so there was a lot of doubt, a lot of worry."Skinner said a doctor later told her smoke inhalation put her body under stress and triggered the contractions.On Dec. 12, more than a month after the fire began, Skinner gave birth via C-section to a full-term, healthy girl and named her after the man she believes saved her life."She's a blessing in every way including what happened at the Camp Fire," she said about her daughter, Zoele (rhymes with Noel) Mickey Skinner.Skinner and her husband, Daniel, have three other children, ages 8, 6 and 4.After getting Skinner to the ambulance, Huber helped with the mass evacuation until the next day. He said he was shocked and honored when he learned the baby was named after him."That day was full of a thousand different emotions but that is the strongest memory of the day for me," Huber said.More than 50,000 people in Paradise and the neighboring communities of Magalia and Concow were forced to quickly flee the towering, wind-driven flames that burned an area about the size of Chicago — 240 square miles (622 square kilometers) — and became the deadliest U.S. wildfire in at least a century. At least 86 people were killed and 14,000 homes destroyed.Skinner and her husband, Daniel, lost their home; her mother lost hers too."All of our history and what we were as a family, everybody knowing your name and all the things about being in a small town are just gone," Skinner said.When her children get sad about the things they lost in the fire, she said she reminds them to count their blessings, including the baby sister who made it alive."All of us, including our animals are out. SAN DIEGO (KTGV) - The City of San Diego could be looking at spending hundreds of thousands of dollars to figure out what to do next with a vacant city-owned building in the downtown area.A letter obtained by 10News shows the city is looking into proposals for additional services regarding the building at 101 Ash St.The Aug. 14 letter to the deputy director of architectural engineering and parks division outlined a proposal with costs for services estimated at 2,000."I think this is a ridiculous waste of money," said Council President Pro Tem Barbara Bry. "What I proposed on Aug. 6 at the council meeting is still what I think the city should be doing, and that is to get into a room and negotiate with all the parties that have a financial interest."The downtown building at 101 Ash St. has been sitting vacant for most of the last four years, and as it continues to sit empty, taxpayers are footing the ,000 per day bill. As 10News previously reported, in 2016 the city approved a lease-to-own agreement for the building, valued at million.The idea was to move upward of 1,100 city employees into the facility. But officials quickly discovered a series of problems requiring major renovations to the site's 19 floors. In December 2019, the city finally began moving workers into the building, only to vacate them a month later when the county found traces of asbestos.This month, City Council leaders voted 5-4 — with Council Members Vivian Moreno, Monica Montgomery, Barbara Bry, and Georgette Gómez voting in opposition — to request monthly updates on the building's status and costs for several options presented by Mayor Kevin Faulconer's office.According to the latest proposal letter, "The City has requested Kitchell to identify potential cost and schedule savings through further studies and investigations. Kitchell has added Jackson and Blanc Power Systems Testing to our team to perform diagnostic testing of the HVAC and Electrical systems to establish a baseline of operation. Upon completion of the diagnostic testing, Kitchell will develop four options for improving 101 Ash Street."The letter outlined several options that would eventually be presented to the city if leaders went with the proposal, including bare requirements to reoccupy the building, fire/life/safety recommendations, and potentially demolishing and replacing the existing building.The mayor's options for this building have included putting millions of dollars more into the building for the needed repairs, buying out the lease, pursuing a new landlord, trying to renegotiate its lease, or walking away entirely, the last of which could risk litigation and credit damage.When asked about the proposal letter obtained by ABC 10News, the mayor's office responded that the city's Communication Department provided information.A spokesperson for the city told ABC 10News, "Many documents, including this letter, may not be final. It appears you have documents that are not final and should not be treated as such."In an emailed response to questions, the spokesperson said, "The letter sent to Elif Cetin was a proposal, and anything within it should be considered draft and negotiable, including the fees, scope of work, etc. That is a proposed figure from the consultant and is still subject to negotiation."When asked about what type of consultations the city looking for and if Is there’s an approved dollar amount the city is looking to spend a city spokesperson also noted, "The City is pursuing all legal and financial options to protect taxpayers, recoup costs, hold accountable the contractors who worsened the building's condition, and implement new levels of accountability. SAN DIEGO, Calif. (KGTV) -- A fishing shop in Kearny Mesa was burglarized early Sunday morning. The break-in was caught on the San Diego Tackle Traders' surveillance cameras just before 4:30 a.m. The video shows two suspects, wearing masks and gloves, getting into the shop using a crowbar. The two people can be seen walking into the business, on Convoy Court, with a cooler and some type of container, heading towards the back of the shop. The owners of San Diego Tackle Traders say the suspects got away with several fishing reels and rods, a total value of ,000 to 0,00. The owners tell 10News this is a big blow to their small business. They say they work by appointment only and don't advertise their address online because of the value of the items they sell. The owners are now hoping people will keep an eye out for anyone trying to sell brand new fishing equipment. Anyone with information is asked to call the San Diego Police Department. 964
