A Cape Coral, Florida woman is in jail on a DUI charge after police say she bought more wine after crashing in a Publix parking lot.50-year-old Lisa Lehman is facing charges of DUI and Hit and Run.According to Cape Coral Police, around 8 a.m. Sunday, a customer came out of the Publix on Cape Coral Parkway to find her parked vehicle damaged.As the victim talked to police at the scene, Lehman arrived, placed a brown bag in her car, and identified herself as the driver of the car.  She admitted that she had hit and damaged the victim's car. Officers noted that Lehman was having balance issues and smelled of alcohol.EMS checked Lehman and found no medical issues, and officers conducted a DUI investigation, during which she failed several sobriety tests, according to a police report.Lehman was arrested and booked into the Lee County Jail.A search of her vehicle revealed an empty Chardonnay bottle under a seat, and the brown bag contained a bottle of Moscato she had just purchased from Publix. 1040

A federal judge ruled Monday Pennsylvania’s Governor Tom Wolf’s COVID-19 pandemic restrictions are unconstitutional.Four counties in the state filed a lawsuit claiming the governor’s orders closing non-life-sustaining businesses and limiting outdoor gatherings, and stay-at-home orders were unconstitutional. They stated the orders were "arbitrary, capricious and interfered with the concept of 'ordered liberty' as protected by the Fourteenth Amendment."Plaintiffs included hair salons, a drive-in theater, other businesses, as well as state representatives and congressman Mike Kelly.In his ruling, the judge says the governor’s actions likely had good intentions, “to protect Pennsylvanians from the virus," but that "even in an emergency, the authority of government is not unfettered."U.S. District Judge William Stickman IV ruling reads, “"(1) that the congregate gathering limits imposed by defendants' mitigation orders violate the right of assembly enshrined in the First Amendment; (2) that the stay-at-home and business closure components of defendants' orders violate the due process clause of the Fourteenth Amendment; and (3) that the business closure components of Defendants' orders violate the Equal Protection Clause of the Fourteenth Amendment."In his written opinion, Judge Stickman continued his explanation of his ruling."There is no question that this country has faced, and will face, emergencies of every sort. But the solution to a national crisis can never be permitted to supersede the commitment to individual liberty that stands as the foundation of the American experiment. The constitution cannot accept the concept of a 'new normal' where the basic liberties of the people can be subordinated to open-ended emergency mitigation measures,” Stickman wrote."Rather, the Constitution sets certain lines that may not be crossed, even in an emergency. Actions taken by defendants crossed those lines. It is the duty of the court to declare those actions unconstitutional." 2007

A federal judge has sentenced a Louisiana man to 25 years in prison for setting fires at three churches in the state in 2019.Earlier this year, Holden Matthews admitted that, between March 26 and April 4, 2019, he intentionally set fire to three churches in with predominantly Black congregations near Opelousas, Louisiana — Greater Union, Mt. Pleasant and St. Mary Baptist Churches — in an effort to raise his profile as a "Black Metal" musician by copying similar crimes committed in Norway in the 1990s.On Tuesday, Matthews was sentenced to 15 years in prison for intentional damage to religious property. He was then sentenced to 10 years in prison for a charge of using fire to commit a felony. Matthews did get 18 months credit for time already has served.The judge also asked the Bureau of Prisons to ensure he is placed in a facility near his family and that he receives substance abuse counseling and mental health treatment.Matthews was also ordered to pay restitution of 0,246 to St. Mary, 0,213.30 to Greater Union, and .1 million to Mt. Pleasant."These churches trace their origins to the post-Civil War Reconstruction period and, for generations, were a place for predominantly African American Christians to gather, pray, worship, and celebrate their faith," Assistant Attorney General Eric Dreiband said in a statement. "The churches survived for nearly 150 years but did not survive this defendant's warped act of hatred. I extend my sympathy to the victims of this defendant's arson spree, the congregants of St. Mary Baptist Church, Greater Union Baptist Church, and Mt. Pleasant Baptist Church. A fire broke out at Trump Tower on Saturday, leaving one man dead and six firefighters injured, the New York City Fire Department said.Police identified the man killed as Todd Brassner, 67, a resident of the building's 50th floor.
