TAMPA, Fla. -- A woman who visited Hamburger Mary's in Tampa is suing the establishment for .5 million after she says she was injured by a drag queen's breast while at dinner with friends in 2015.Neldin Molina says she was with friends and family at the restaurant for dinner to celebrate a friend's birthday on May 30, 2015, according to the complaint. The suit says this was the first time Molina had ever visited the restaurant in Tampa. She claims when she entered the establishment, she didn't see any signs of any special events.She was eating her fish n' chips dinner at approximately 8:45 p.m. when she heard music and heard someone begin to speak and then the crowd cheered and clapped. She turned her chair around to see what was going on and saw a person dancing on the stage that was in the restaurant behind her to the left. She started watching and overheard another table say that the drag queen show was starting.At approximately 9:40 p.m., Molina turned around and saw performer Amanda D'Hod point at her and start to walk toward her table. Molina claims she immediately turned around to ignore the performance. A few minutes later, Molina felt someone touch her shoulders from behind her.According to the complaint, D'Hod walked in front of Molina and unexpectedly grabbed Molina's head and "wiggled her breast against the Plaintiff's face and head 8 times." D'Hod reportedly grabbed Molina's face and pushed it to the left and right before "violently pounding" it against D'Hod's chest "up to nine times." The complaint says Molina let a restaurant manager know that she was in "excruciating" pain and she was getting a headache and she filed a complaint. The manager told Molina he would notify and give the complaint to the owner who was not currently at the restaurant. Molina later went to the emergency room at Memorial Hospital of Tampa for "excruciating cervical pain and uncontrollable headaches."The manager called Molina weeks later and gave her Insurance information for her to follow up on the complaint. Molina is seeking .5 million for medical costs and expenses for the past, present and future, including the pain and suffering she physically and mentally endured. The complaint also states that Hamburger Mary's failed to advise anyone of the possible dangers while dining at the restaurant.   2431

Tacked onto the coronavirus stimulus bill is new legislation tackling one of the most controversial practices in health care – surprise medical bills.That's when you go to the hospital or have an elective procedure and then later find out some of the doctors or facilities were out of network, meaning you could owe tens or hundreds of thousands of dollars.The most impactful part about the legislation is that patients would no longer get those surprise out-of-network bills for emergency care or for a planned procedure. They will instead be billed an in-network rate.Out-of-network providers would have to give patients a heads up on estimated charges, at least three days.Air ambulance companies would also not be able to charge more than in-network costs. Ground ambulances were not included.Insurance and providers have to go to arbitration to work out the final payment. It's a complex solution advocates say could end up costing Americans more in the long run.“So, a mediation process that some states have put in place, but research has shown that it increases the likelihood that consumers face higher premium costs on the back end,” said Clare Krusing with the Coalition Against Surprise Medical Billing.That Coalition had been pushing for policies that, in their simplest form, would have essentially made in and out-of-network rates the same. Savings that in-part would have funded community health centers.“Not only is that approach the cleanest way of dealing with this, but it also saves the patients and taxpayers the most money, who are going to save billion over 10 years.The group plans to continue to push for more terms around that arbitration process to prevent abuse, driving up costs.None of the new surprise medical bill legislation takes effect until January 2022. 1803

Texas State University moved to suspend all fraternity and sorority activities Tuesday, a day after a 20-year-old fraternity pledge died following an off-campus social event.San Marcos police said they were called at 11:35 a.m. Monday to respond to a person not breathing at an apartment complex. Matthew Ellis, a pledge for the Phi Kappa Psi fraternity, was found unresponsive and declared dead less than an hour later. Police said he was discovered by friends just after 11 a.m.An autopsy is being conducted, but a preliminary investigation indicates alcohol may have been a factor in his death, police said. 618

TAMPA, Fla. — Seconds after 17-year-old Lexi Banks was born, she was rushed into surgery. The 4-pound newborn was turning gray, struggling to breathe with doctors pulling her out of her mother’s embrace to perform an emergency tracheotomy.“Your daughter needs this or she will die,” Lexi’s mom, Kim Cashman, remembers doctors telling her.  That would be the first of many surgeries Lexi would have to endure throughout her childhood and teenage years. The surgeries haven’t stopped. But, Lexi’s Dr. Ernesto Ruas is hopeful the recent surgeries he’s performed on Lexi will be the last.“I’m hoping in a couple of years she will be done,” Ruas said. Ruas is harvesting a bone from her fibula (calf bone) and taking her peroneal artery to make sure her new jaw has enough blood flow and circulation to survive.   “The whole procedure depends on two little vessels that measure 1.5 mm to 2 mm. If those vessels get plugged up we are in trouble. She is not in trouble. The procedure is in trouble,” Ruas said.  When Lexi was 6-years-old, Ruas tried a similar procedure. Ruas said her body rejected her bone and over time it disintegrated. Now that she is an adult, Ruas hopes this surgery will be the big break Lexi and her family have been waiting for.Lexi wasn't able to eat solid food until she was 16-years-old. She had a tube inserted in her stomach for her entire life and until recently she lived with a trach tube. In the past two years, she has come a long way. Able to eat solid food and breath without the help of a trach. Not only will the surgery give Lexi the jaw she was never born with. But, it will help her breath better on her own and be able to finally eat food like everyone else.Lexi was born with a rare condition called Goldenhar?disease. According to the U.S. Department of Health and Human Services, "it is a condition that is present at birth and mainly affects the development of the eye, ear, and spine."“Everything just stopped developing for a moment, and at that moment that’s when everything stopped, particularly on her one side", Cashman said. “So, the blood vessels just stopped for a moment, her ear stopped developing, her jaw.”Lexi was born without a right ear, and her jaw was deformed, almost detached from her face.“I want to just be happy about myself and people accept me,” Lexi said.  Scripps station WFTS in Tampa talked to her before her first surgery, her speech impaired because her mouth was partially wired shut to keep her jaw in place for the upcoming surgery.“People normally are nice but there’s always people out there mean, and people stare at me and say bad names to me,” Lexi said.  Lexi has bone conducting hearing aids implanted in her cochlear, multiple surgeries on her face, surgeries on her gastrointestinal tube so she could eat, and numerous surgeries over the course of her life that have culminated in two major surgeries that will change her life.“Because she is missing half her jaw she can't bite correctly, she can’t chew correctly, she can’t maintain her airway,” Dr. Ernesto Ruas said.  Ruas, a plastic surgeon in Tampa, performed his first surgery on Lexi when she was just 5-months-old.“She is a tough little cookie. As I said, she rolls with the punches she does very well,” Ruas said.  In January, Ruas rebuilt Lexi’s upper jaw using a cadaver harvested from her leg. On April 16, Ruas performed a second surgery on Lexi to rebuild the entire bottom part of her jaw.  Lexi, hands trembling, talked about her dreams of having a face that looked similar to everyone else.“I want them to know I am a strong girl and I want to share people my story so they understand what I go through,” Lexi said. “I don’t have to hide away and not share my story but be out there in the world.”After more than 14 hours of surgery, Lexi was in the ICU for several days and released over the weekend. She has to walk with crutches for a month and undergo extensive physical therapy.  Her surgery was one of the toughest the family has ever gone through. Teachers in the San Diego Unified School District say they may have to strike if they can't reach an agreement on a new contract with the district."It's not something we ever want to do," says Lindsay Burningham with the San Diego Education Association, the union that represents teachers. "But it's something that we will do if the district doesn't show the respect our students and educators deserve."Teachers first brought up the threat of a strike at this month's school board meeting, where they urged board members to hear their demands.The two sides have been in negotiations since June when the last contract expired. Since then, teachers in the district have been working without a contract.
