CARLSBAD, Calif. (KGTV) — Prosecutors Wednesday say two transients accused of a deadly home invasion robbery this week stabbed the victim 50 times in the face, neck, and back.Ian Bushee, 37, and Malissa James, 26, are both accused of breaking into a home in the 1800 block of Outrigger Lane just after midnight Monday. During the break-in the victim, identified as 63-year-old Marjorie Gawitt, was stabbed multiple times.Gawitt was still able to call 911 to report the incident and was conscious and breathing when police arrived. She was taken to Scripps La Jolla Hospital, where she died of her injuries.RELATED: Police identify suspects in deadly Carlsbad stabbing, burglaryBushee and James fled the scene in Gawitt's vehicle, according to police. The vehicle was found in San Marcos and the two were arrested in the 4800 block of Park Drive later Monday.Each has been charged with homicide, burglary, conspiracy, and auto theft. Bushee was also charged with accessory after the fact. James also also charged with torture. The pair was already on probation in San Bernardino for residential burglary.Both defendants pleaded not guilty of all charges.Bail was not set for Bushee or James, as they were determined to be a threat to the community.Both face the death penalty. A readiness hearing is scheduled for March 21, and a preliminary hearing is set for March 27. 1377

An official with a group that supported the project says the sign was unveiled in Pittsboro and funded by residents in the city. CARLSBAD, Calif. (KGTV) - The Orange County father who tied up his daughter and gagged her in an attempt to force her into drug rehab in Mexico could face charges. California Highway Patrol officers pulled over the car Monday night on Interstate 5 off of Cannon Road in Carlsbad after getting calls from drivers about a possible kidnapping. "Received a report of a woman bound and gagged in the back seat, kidnapped essentially," said CHP Sgt. Mike Morrin. The 17-year-old girl was with her 57-year-old father and 21-year old sister. According to the CHP, both the father and sister could face charges ranging from kidnapping to child endangerment. "You just can't gag someone and bind them and take them in the back of a car to a foreign country. That's just not acceptable. We're trying to sort out the details," said Sgt. Morrin. The teen admitted to officers she's been using methamphetamines for the last year. Her relatives told 10News she escaped twice from local rehabs. The family lives in San Juan Capistrano. Nancy Knott is a licensed psychotherapist. She spent years working as a treatment counselor for Scripps before going into private practice. Knott is not familiar with this case, but says parents often reach a breaking point. "When it reaches a certain point, desperation sets in, and anytime desperation sets in, people don't always make the correct choices. They're trying a lot of times to save the life of their child," said Knott.Knott said families in California can hire outside help when trying to force a minor into treatment. "A parent could arrange for a transport company to take their child into treatment and they do not use physical restraints unless absolutely necessary. Again, first choice is to have the parents to seek out some expert advice, try to work with their child themselves, if not, usually the one off approach works better especially with the child parent relationship to bring in a professional, to work with the child and the family. The family would be signing off permission, or the guardian, to the transport company to take that child to treatment," said Knott adding that the company should be licensed and bonded. Knott doesn't recommend seeking treatment in Mexico. "I've never taken a patient to Mexico. And frankly, never will. The laws are different there. The family is always at great risk of crossing that border because they are not going to be the same laws as in the US, so it's riskier; that's my opinion," said Knott.Knott said early intervention is critical, but recovery can still take years. "Treatment doesn't always work the first or second time with adolescents. We look at keep them alive until 25, meaning the brain is more developed at 25 to have a little more rational way of looking at their problem," said Knott. Charges have been filed against a California Highway Patrol officer in the Bakersfield area.According to a District Attorney, Brian Pardue is being charged for allegedly attempting to commit a sexual offense against a minor.Pardue's offical charges are a felony, for attempting to contact a minor with intent to commit a sexual offense. And a misdemeanor for arranging a meeting with a person believed to be a minor intending to commit a sexual offense.The incident is believed to have happened on July 3, 2020, and involved digital communications with an undercover law enforcement officer pretending to be an underage minor. CARLSBAD (KGTV) - In response to a four year construction project that recently kicked off, California Highway Patrol has lowered the speed limit on a stretch of interstate 5 by 10 miles per hour. The stretch is about eight miles long, through Encinitas and Carlsbad. The entire project will eventually go all the way to the 78. The project with add HOV lanes over the next four years. The new speed limit will help to protect workers in the area working closely to the passing vehicles. California Highway Patrol officer Mark Latulippe tells 10News, "the days of well we just put the signs up and we’re giving you a grace limit, are over". They've put up dozens of signs to warn people of the change, dropping the speed limit to 55 miles per hour. Despite the many signs drivers are ignoring the change and sticking to their normal speeds upwards of 70 miles per hour. The signs have been up for about a month but Latulippe says, "we are sending enforcement units out now to start that ticketing process of trying to slow this down". Drivers can now expect to get pulled over and ticketed from here on out. Because the area is a work zone, the tickets will be double the normal speeding fine. 1202
