SAN DIEGO (KGTV) — Eight San Diego County gyms have filed a lawsuit against state and county leaders over the public health orders due to the coronavirus pandemic.The gym owners say that restrictions on their business by California and the county have caused, "difficulty in satisfying their financial obligations, having been forced to lay off a significant number of employees" and they have "expended large sums of money in an effort to comply with Defendants’ vague orders."Gym owners say they have lost tens to hundreds of thousands of dollars, in some cases, retrofitting their businesses to be compliant with reopening measures.The Plaintiffs include Metroflex Gym in Oceanside, Ramona Fitness Center in Ramona, Boulevard Fitness in University Heights, Deadweight Strength in Grantville, Convoy Strength in Kearny Mesa, IB Fitness in Imperial Beach, and Being Fit in both Clairemont and Mira Mesa.The owners added that they have sought clarification of the orders and how they're enforced by law enforcement and the county, but have not received any clarification from officials.The lawsuit claims that public health orders labeling their businesses as nonessential without allowing them to challenge it, and mandatory closures, are not constitutional.Defendants include Gov. Gavin Newsom, all five San Diego County supervisors, and the mayors of each city where the gyms are located. Various local law enforcement and public health officials, including Wilma Wooten, Sheriff Bill Gore, and SDPD Chief David Nisleit, were also named. 1548

SAN DIEGO (KGTV) - Following a heated battle over new regulations for short-term vacation rentals Wednesday, the San Diego City Council approved new regulations in a 6-2 vote.The new rules will go into effect July 2019.The rules, which were based on a plan by Mayor Kevin Faulconer, adopt the city’s first license-based system to manage the rentals, charge cost-recoverable fees to administer licenses and enforce code violations, establish a “Good Neighbor” policy to preserve neighborhood quality of life, hire additional staff to respond to complaints about nuisance properties, and implement a per-night fee that would generate funding for affordable housing projects.RELATED: San Diego City Council approves new rules on short-term rentalsAlthough the plan initially called for homeowners to be allowed two licenses for a primary and secondary home, the council later amended the provision before the plan passed its first vote in July.Faulconer’s proposal was changed to allow a host to be issued a license for a primary residence and a dwelling on the same land as the primary residence.Faulconer also had a provision in his plan allowing no limitations on the number of licenses available to hosts within Mission Beach when it was introduced in June. SAN DIEGO (KGTV) - Honda has agreed to pay million to settle allegations surrounding airbag failures.The lawsuit was brought by a collation of Attorneys General in 48 states.According to the Attorney General of New York the settlement, "Concludes a multistate investigation into Honda's alleged failure to inform regulators and consumers of issues related to the significant risk of rupture in the frontal airbag systems installed in certain model cars, which could cause metal fragments to fly into the passenger compartments of many Honda and Acura vehicles."The California Attorney General’s Office says Honda also agreed to a number of injunctive terms to protect consumers, including requirements that it include design features that protect vehicle occupants in the event of an airbag rupture and a prohibition from engaging in false or misleading advertising related to the safety of its frontal airbags."For years, Honda failed to warn consumers and regulators of the potential dangers of its airbags. That type of business practice not only violates Californians' trust but endangers lives," said Attorney General Xavier Becerra. "Every time we get into our vehicle, safety is a priority. In case any company forgets that California is ready to remind you and hold you accountable."ABC 10News reached out to Honda for a comment on the settlement but did not hear back.According to the California Attorney General’s office, the ruptures have resulted in at least 14 deaths and over 200 injuries in the United States alone."It's a win for the consumer," said Alexander Brangman.On Sept. 7, 2014, Brangman's daughter Jewel rear-ended a van in her rental car on a freeway in Los Angeles. Four vehicles were involved. Everyone walked away from the crash, except her.Brangman said the shrapnel pierced her neck. She later died.While he applauds the actions of state leaders to reach a settlement with Honda, Brangman says he's still concerned that vehicles have dangerous airbags in them."I'm an example of something tragic happening that was preventable, and it's still happening," Brangman said.According to the National Highway Traffic Safety Administration, approximately 63 million Takata airbags have been recalled because these airbags can explode when deployed, causing serious injury or even death.To check your car https://www.safercar.gov/ 2365

SAN DIEGO (KGTV) -- For the first time since mid-July, several San Diego County businesses were allowed to resume indoor operations.Under Gov. Gavin Newsom's new tiered system for businesses reopening during the pandemic, several more industries can welcome customers inside, but with modifications and or capacity limits.Danny Daniels owns Barbers Den in Chula Vista. He was thrilled to have customers back inside Monday afternoon."This is my passion, I love barbering, I love everything about barbering," said Daniels, who has been cutting hair for nearly 20 years."I truly believe something as simple as a haircut can go a long way in making someone feel good," he added.Austin Campbell is the managing partner of Sola Salons Studios in San Diego. He owns and helps run 15 locations.Campbell is among the owners who traveled to the state capitol to protest the governor's second shut down back in July."On the first shut down everybody said, this is going to be tough, but it's the right thing to do, everyone just hunkered down and said we gotta get through it, but the second shut down, people took it; personally, they thought this was uncalled for, unfair, completely arbitrary and not researched," said Campbell.Many stylists said the governor's decision to allow salons to move services outside made no sense."The whole offer of outside hair, to be honest with you, was kind of a slap in the face of our industry," said Campbell, adding that inside was safer and more sanitary.Everything that the state recommended we could do, really pretty much was in complete contradiction to what everyone has been taught and been practicing for their entire careers," said Campbell. Salons don't have capacity limits, but social distancing and mask mandates must still be followed. Campbell said the impact of the shutdowns has been far more than just financial."A lot of people are not just financially struggling, but mentally, emotionally, professionally, the beauty industry is more than just a job; it's a true career and identity," said Campbell.Campbell said his salons employ roughly 600 people. Many have already moved out of state.He has a message for the governor."Our industry has been prepared for this long before covid existed, and we take it very seriously.
