SAN DIEGO (KGTV) -- Allegations of battery made against a California Assembly candidate have proven to be false, according to the San Diego County Sheriff’s Department.Detectives say after interviewing several witnesses and reviewing surveillance video, allegations against Phil Graham have proven to be unfounded and the case is being closed.RELATED: State assemblyman candidate accused of batteryNiki Burgan filed the report on Sunday, May 20. Burgan alleged that the incident happened on May 14 at the First Street Bar in Encinitas. Burgan said she met Graham and that they engaged in conversation.Burgan alleged that Graham kissed her against her will and followed her outside before attempting to have her touch him in a sexual manner against her wishes.The department says it conducted a thorough investigation and disproved the allegations after being assigned to the case on May 21.10News reached out the Phil Graham and received the following statement:  1006

SAN DIEGO (KGTV) - After 20 months of Immigration and Customs Enforcement (ICE) detainment, a Congolese father fighting for political asylum has reunited with his family. The newly paroled father went to a church service in San Diego with his family for the first time since 2017."Constantin has been reunited with his family," Pastor Colin Mathewson of St. Luke's Episcopal Church said. Sunday was Constantin Bakala's first time at church with his family since his parole. In 2017, the former computer engineer took his family and escaped from the Republic of Congo after he said they received multiple death threats by the new government. They somehow made it to San Ysidro to seek political asylum. But there, the family was separated and Bakala was held alone at four different ICE detention facilities on the East Coast. Meanwhile, while his wife Annie and seven children were released in San Diego. Through a French translator, Bakala spoke to 10News."Because of the distance between my detention and family, communication was very difficult," Bakala said. The family's only form of communication was the phone. For months, the Bakalas and their friends fought for reunification. 10News was there as they rallied at an ICE office in downtown San Diego and at church events. Earlier this year, Bakala's first parole request was denied. Five lawyers, 30 volunteers, and 20 months later, Bakala was granted parole. On Aug. 19, 2019, Bakala arrived at San Diego International Airport with a single duffel bag."[It was] pure joy when I hugged and kissed them," Bakala said. His eldest daughter, Marie Louise, could not contain her joy."I am really grateful to God and to all those people who are helping me and my family to be together," Marie Louise Bakala said. She previously told 10News that all she wanted was for her father to be there when she celebrated her 18th birthday. Her wish came true."I'm just really happy because my birthday will be next month, and my dad is here!"The Bakalas' journey, however, is not over. As Bakala adjusts to his new life as a parolee, the family awaits their trial. But now, they have each other.Constantin, Annie, Marie Louise, Emmanuel, Daniel, David, Augustine, Moises, and Joseph are together at last.In his broken English, Bakala told 10News: "I thank everybody who are before me to understand the condition from where I am coming."Constantin Bakala's case has been moved to California. SAN DIEGO (KGTV) - After nearly two decades of delays and setbacks, San Ysidro community members celebrated the completion of a million major road reconstruction project Monday.For years the half-mile stretch of Old Otay Mesa Road in between San Ysidro High and San Ysidro Middle Schools lacked many safety features to protect the students who walk to and from school.An unfinished dirt path was used as a sidewalk with no fence to keep students away from oncoming vehicle traffic, no street lights or proper signage and no barriers to keep pedestrians from slipping down a steep canyon.After three years, the stretch of road now includes the safety features the community had been asking for for years. The roadway was widened and realigned, sidewalks and bike lanes were added, there's now a retaining wall, signage and lighting.The City of San Diego says the project took so long to complete after the initial groundbreaking because of the rough terrain crews had to work through.San Diego Mayor Kevin Faulconer announced reforms to overhaul the City’s infrastructure program back in 2015. He says that increased funding each year and helped speed up high priority projects, like the one on Old Otay Mesa Road. This project was one of more than 60 neighborhood projects that were fully funded after Faulconer’s reforms went into effect."Parents have a peace of mind knowing that their kids have a safe path to and from school," said Faulconer at a news conference Monday.The half-mile stretch of Old Otay Mesa Road, which was closed off to traffic for several years, officially reopened on Monday. 1612

  

SAN DIEGO (KGTV) -- A woman was taken to the hospital after the car she was riding in -- which was believed to have been stolen -- struck a building and two parked vehicles in the El Cerrito area on Friday morning.San Diego police said the collision happened at around 5:15 a.m. in the 5800 block of El Cajon Boulevard.Witnesses told ABC 10News they saw a silver Honda Accord traveling at a high rate of speed, possibly reaching 100 MPH, when it lost control and collided with a building and parked cars, littering the area with debris and car parts.Responding emergency crews pulled a female from the wreckage and took her to the hospital. Police said the woman suffered a broken hip and deep laceration on the back of her leg.One witness said a man, believed to be the driver, was able to get out of the wrecked car and ran away from the scene. He was described as Black, in his 20s, wearing a black sweater and black pants.According to police, as officers and emergency crews responded to the crash, a man called 911 to report his car that was left running outside of a business on El Cajon Boulevard was stolen.Police told ABC 10News they believe the car in the crash was the same vehicle stolen a few blocks away. 1226

  

SAN DIEGO (KGTV) - A tour this weekend will give San Diegans a chance to see all of the options they have to make their homes more energy-efficient and climate-friendly.The San Diego Green Homes Tour features 14 houses, all with unique ways to go green."We have a variety of homes from luxury and do it yourself tactics that everyday people can employ," says tour Co-Chair Katie Teare. "We're hoping people that attend the tour can learn and be inspired to put some of these techniques into their own home."Among the options, a home that is entirely off-the-grid and run by solar power, a home built from straw bales, a home that turned the backyard pool into a pond, and several homes that are LEED-certified as among the most energy-efficient.RELATED: Photos of energy efficient homes in San Diego (Slide Show)"If you're going to be building a new house it just seems like the right thing to do," says Kristin Brinner, whose newly built Solana Beach home is part of the tour. "We have a daughter, and we're really concerned about climate change and the world she's coming into, so we want to do everything we can to minimize our impacts."Brinner's home features solar power, a grey-water system, and a driveway that percolates water and pushes it to their yard instead of into storm drains.She and her husband took the tour three years ago to get inspiration as they started to design their new home."It might cost a little more to buy a nicer system, but if you look at the cost over time, since they're so efficient, you get back a return on the money," says Brinners husband, Chris Novak.Bill Powers agrees. He set up his home with a fully self-contained solar power system in 2014. He says it's time that these kinds of renovations become the standard, not the exception."This isn't fringe stuff. This is something you can do if you'd like to do and give you the flexibility to protect your own home when the grid's not available," says Powers.The tour is on Saturday and Sunday. Tickets to tour the homes are for both days or for one day.
