SAN DIEGO (KGTV) - Supporters of labor unions rallied across the country on Saturday ahead of a Supreme Court case that could effect how unions collect agency fees. One was held in downtown San Diego outside the California Democratic Convention, where hundreds of union supporters gathered for the “Working People’s Day of Action” event. Demonstrators were supporting the union AFSCME, which is engaged in a court battle that has made its way to the Supreme Court. In Janus v. AFSCME, the Supreme Court will decide whether it is legal for unions, which often donate to political causes, to compel members to agency fees. Those fees are collected by unions from employees who have opted not to join the union but still benefit from collective bargaining. The plaintiff, Mark Janus, has argued it violates his first amendment rights to pay fees to an organization that he disagrees with politically. A ruling in his favor could have wide-reaching effects on public sector labor unions around the country, argues famed labor organizer, Dolores Huerta. “That is going to be very devastating to our unions here in California,” said Huerta, if the court sides with Janus. 1213

Front line workers will be first to be vaccinated, followed by long-term care facility residents and employees.Doses from the county's allotment were sent to UC San Diego Medical Center and Rady Children's Hospital on Monday and Tuesday.A separate batch of vaccines was sent to Naval Medical Center San Diego and Naval Hospital Camp Pendleton on Monday.The Department of Defense chose both locations as hubs where some service members will be vaccinated.In a statement released last week, the DOD outlined their vaccine distribution plans. They will follow the CDC guidelines and will prioritize those who provide direct medical care, followed by critical national security units, and then deployed forces.The vaccine arrival comes as military hospitals in San Diego are also seeing a surge in COVID-19 cases. The San Diego Union-Tribune reports that Naval Medical Center San Diego has 16 ICU beds, but they are at 70% capacity. Naval Hospital Camp Pendleton’s four ICU beds are at 75%. 1574

He was found guilty of three firearm charges, including felon in possession of a gun.The jury deadlocked when charging him with three counts of assault with a deadly weapon. The District Attorney’s Office refiled for a retrial.RELATED: Gaslamp deputy shooting suspect escapes Spring Valley SWAT standoffA few months later that retrial is in session and Pitoau now faces potential life in prison for allegedly shooting sheriff’s deputy Jason Philpot three times, aiming the gun at his brother, Joshua Philpot and shooting and hitting a third person walking by.During his testimony Tuesday, Pitoau tells the jury he didn’t intent on actually firing the gun. "When I see the gun it was like okay you know what I mean, just show it to these guys. It be like okay split parts, I run this way they run that way. It be cool," Pitoau said.Pitoau was asked by the defense attorney and prosecutor to recollect the night of August 7, 2017. The night he got into an altercation with the Philpot brothers and it ended in shots fired.RELATED: Suspect in Gaslamp shooting that injured off-duty deputy arrested in MexicoWhen Pitoau grabbed the gun from his friend that night he tells the jurors he didn’t think Jason Philpot in law enforcement and would know how to remove a gun from a shooter.“I had it in my right hand his left hand cam over my hand and his right hand came under my hand,” Pitoau continued. “So he grabbed the whole thing like he close don it so he started twisting my wrist." Pitoau went over the entire night and even included details of fleeing the country after he saw the shooting on the news the next morning. “I took off to Mexico, well I cut my hair, shaved my beard and then I walked to the trolley station and went to Mexico."After a month in Tijuana he was brought back to the United States and immediately handed over to U.S. Marshals. SAN DIEGO (KGTV) -- Support for the Black Lives Matter movement is now visible on a downtown San Diego street.Over the weekend, various Black Lives Matter banners were put up on Broadway, between Third Avenue and Kettner Boulevard.The banners showcase the work of San Diego-based artist Anthony Tyson, and they display the message that Black lives of every age, gender, preference, past, and future matter.“You know, not that many people of my color, of my ethnicity is around this area. So, my people can come down and see it, and then also you have people that are used to this area seeing something different. And it gets them to ask the question of ‘what is this?’ and that's all you really need at the end of the day,” Tyson told ABC 10News.Tyson collaborated with the nonprofit Downtown San Diego Partnership for the project.“The Downtown Partnership believes strongly in its duty to ensure organizational efforts are promoting equality and addressing systemic injustice and racial discrimination wherever they exist. In addition to commitments made within the organization, the Downtown Partnership is working to foster a greater sense of cultural vibrancy through placemaking and special projects. Particularly when those efforts can highlight historically disadvantaged cultural institutions and artists,” the organization said in a news release. 1363

  

SAN DIEGO (KGTV) - The father accused of causing a condo fire in Rancho Bernardo that killed his two children appeared in court Tuesday afternoon for a preliminary hearing.Henry Lopez is accused of passing out drunk with a lit cigarette, setting his condo on fire last October.His children, 10-year-old Cristos and 7-year-old Isabella, were in the home at the time and suffered smoke inhalation. Both children died as a result of their injuries.Lopez was also burned in the fire and hospitalized for some time.One witness told the court Tuesday he heard a female screaming at the scene, but the screaming stopped.RELATED: Father charged after children killed in fireHenry Lopez' ex-wife Nikia Lopez testified the two were in the midst of a divorce. They shared joint custody of their children.  Lopez told the judge her former husband was an abusive alcoholic.She claims she had warned him previously not to smoke in the house around the children."He drank a lot. My goal was to keep it from the kids.  I would wake up in the middle of the night and throw away the bottles in the trash. I would pull him upstairs before the kids woke in the morning... sometimes I would have to clean up his throw up."  He’s not in custody because his defense attorney says he needs to be out to receive medical treatment for the burns he sustained during the fire.Prosecutors believe the fire started in his bed and ultimately spread to the rest of the home.  Investigators found discarded smoking materials and alcohol near the start of the fire.If there’s enough evidence against Lopez and the case goes to trial, he faces up to 14 years in prison for several felony counts including involuntary manslaughter and child endangerment.Lopez is not charged with intentionally starting the fire. 1809
