LOS ANGELES (CNS) - Denny's Inc. is being sued by a man who says he was eating at one of the dining chain's restaurants near downtown Los Angeles in 2018 when he was stabbed by a homeless man.Ralph Martinez maintains in his Los Angeles Superior Court lawsuit that Denny's management was aware of previous assaults at the location. He alleges negligence, premises liability, assault, battery and intentional infliction of emotional distress.A Denny's representative did not immediately reply to a request for comment on the complaint brought Friday. The plaintiff is seeking unspecified compensatory and punitive damages.According to his court papers, Martinez was having dinner alone at the Denny's in the 800 block of South Figueroa Street on June 24, 2018, when a homeless man entered the location and "immediately began making racial slurs at other customers and began harassing the other customers."The homeless man then approached Martinez and began hitting him before stabbing him several times with a knife, according to the lawsuit."At no point in time did defendant's staff intervene or even ask or escort the homeless man to leave," the suit says.Denny's did not have any security guards at the restaurant even though management knew of previous violent incidents there, the suit alleges. 1306

LOS ANGELES (CNS) - A pair of active-duty U.S. Marines stationed at Camp Pendleton were arrested Tuesday morning on a federal grand jury indictment charging one of the Marines and three civilians with conspiring to distribute narcotics -- including oxycodone pills laced with fentanyl -- to civilians and members of the Marine Corps, one of whom suffered a fatal drug overdose in May.Lance Cpls. Anthony Ruben Whisenant, 20, and Ryan Douglas White, 22, were expected to make their initial appearances Tuesday afternoon in U.S. District Court in Los Angeles. Whisenant allegedly distributed narcotics to fellow Marines, including the one who overdosed, and White is charged with being an accessory after the fact for allegedly attempting to hinder the apprehension of Whisenant and an alleged drug supplier named in the indictment. The 14-count superseding indictment also charges:-- Jordan Nicholas McCormick, 26, of Palmdale, the lead defendant and the conspiracy's alleged supplier of LSD, ecstasy, cocaine and oxycodone pills laced with fentanyl to co-conspirators-- Gustavo Jaciel Solis, 24, of Sylmar, who allegedly distributed McCormick's drugs to civilians and military personnel-- Jessica Sarah Perez, 23, of Pacoima, who allegedly distributed narcotics, including fentanyl and cocaine, to civilian customersOn Aug. 11, Solis and Perez were indicted on fentanyl and cocaine distribution charges, and Solis was indicted on firearms-related charges. They have pleaded not guilty and their trial date is scheduled for Oct. 27. Solis is in federal custody and Perez is free on ,000 bond.Tuesday's updated indictment adds McCormick -- who is also in federal custody -- Whisenant and White as defendants, in addition to adding charges to the original indictment. According to the indictment, the conspiracy lasted from last November through this month and involved multiple sales of fentanyl- laced oxycodone to an undercover buyer, often for amounts exceeding ,000 per buy.On May 22, Solis sold 10 pills of oxycodone laced with fentanyl to an active-duty Marine who died of a drug overdose in the early morning hours of May 23, the indictment alleges. In addition to the conspiracy charge, McCormick, Solis, Whisenant and Perez face substantive charges of distribution of narcotics, including fentanyl. McCormick and Solis are also charged with possessing firearms in furtherance of drug crimes. If convicted, McCormick and Solis would face a sentence of 10 years to life in federal prison, and Whisenant and Perez would each face up to 20 years behind bars. White, if convicted, would face up to 10 years in federal prison. 2637

LOS ANGELES (KGTV) - A vigil held Wednesday for a bicyclist killed at an intersection in South Los Angeles on Tuesday became the scene of another hit-and-run crash that injured a pedestrian."The driver of a tan-colored Honda Accord drove through the vigil at the intersection of Manchester and Normandie avenues shortly after 1 p.m.," Los Angeles police Officer Tony Im said. The video from the scene captured the sedan striking the pedestrian, who is then flung into the air, appearing to hit his head on the car windshield and finally landing on the asphalt.RELATED: GOOD SAMARITAN HIT WHILE HELPING MOTORISTAfter rolling to his feet, he hopped over to the sidewalk on one foot, seemingly injuring his right leg. LOS ANGELES (AP) — It's not exactly the last straw but Los Angeles has ordered restaurants to stop providing the disposable plastic kind unless customers ask for them. The City Council on Friday unanimously passed an ordinance barring restaurants and food trucks from offering plastic straws to customers, even those taking food to go.Drive-through and delivery places can offer the straws but can't automatically provide them.RELATED: San Diego ban on Styrofoam, single-use plastics takes effectFor businesses with 26 employees or more, the law takes effect on April 22, which is Earth Day. All restaurants must comply by October.L.A. becomes the largest U.S. city to pass a law aimed at reducing plastic waste, which is winding up in landfills and the ocean in enormous quantities.California passed a law last year prohibiting full-service restaurants from automatically providing the straws. 901

LONDON — The British government says it won’t be using 50 million face masks it bought during a scramble to secure protective equipment for medics at the height of the coronavirus outbreak because of safety concerns. The masks were part of a 252 million pound (2 million) contract the government signed with investment firm Ayanda Capital in April. Papers filed in a court case reveal that the masks will not be distributed because they have ear loops rather than head loops and may not fit tightly enough. The government says another 150 million masks supplied by Ayanda are unaffected but are still being tested. The papers are part of a lawsuit against the Conservative government by campaigning groups the Good Law Project and EveryDoctor. As the coronavirus outbreak accelerated across the U.K. in March, it became clear that the country lacked sufficient stockpiles of masks, gloves, gowns and other protective gear for health care workers and nursing home staff. That sparked a race to buy billions of pieces of equipment from suppliers in the U.K. and abroad.Opposition parties are calling for an urgent investigation into the way personal protective equipment was acquired. 1189
