SAN DIEGO (KGTV) — San Diego court records show a history of legal disputes with Clark Construction Group, the company that employed the worker who died in yesterday’s accident on a construction site at UC San Diego.10News found a court complaint over the 2017 death of a driller. Frederick Von Kahl's family sued Clark Construction and other defendants for negligence, alleging they created a dangerous workplace at a San Ysidro job site which reportedly caused a valve to strike Kahl in his chest.Friday afternoon, Kahl family attorney Benjamin Bunn said that the case just recently moved into a settlement agreement. He said that Kahl had been married for 40 years.The Occupational Safety and Health Administration (OSHA) website revealed that it issued violations and a ,260 fine. In another negligence case, a worker sued Clark Construction Group and other defendants over a 2010 accident at the San Diego Marriot & Marina Hotel, claiming that a large piece of concrete dropped through a roof and struck a worker's body and right arm. The case was later dismissed.There's also a negligence suit that settled after a 91-year-old woman reportedly suffered broken bones from a fall while walking by a downtown construction site that she claimed was unsafe.The Division of Occupational Safety and Health of California (Cal/OSHA) has done at least 10 investigations into the company in the last 10 years. A Cal/OSHA spokesperson said Thursday that most of the investigations involve complaints from workers reporting unsafe conditions, with no violations issued. SAN DIEGO (KGTV) - San Diego Police confirmed Monday the arrest of a Yuma, Arizona police officer on suspicion of rape.Yuma Police officer Jared Elkins, 33, was taken into custody Friday morning on Marlborough Dr. near Adams Ave. in Kensington.San Diego Police said Elkins was off duty at this time of his arrest. He is a 7-year veteran of the force, the Associated Press reported.  Yuma Police are working to place Elkins on administrative leave.Elkins will be charged with rape, oral copulation, threat to do bodily harm, sex asault with a foreign object, and misdemeanor sexual assault, police said.Elkins was released on 0,000 bail Saturday and ordered to appear in court on Sept. 25. 709

SAN DIEGO (KGTV) – San Diego City Councilmember Jennifer Campbell on Tuesday is expected to formally announce enforcement plans to help with concerns over crowd control in Ocean Beach.Campbell, who represents District 2, said in a news release, “Our office continues to field calls regarding increased crowds gathering at Veteran’s Plaza in Ocean Beach on Wednesday evenings. While I appreciate the San Diego Police Department’s increased presence last week, it’s clear more comprehensive action needs to be taken to keep San Diegans safe.”Residents in the area say large gatherings have been consistently happening despite San Diego County public health orders restricting mass gatherings.According to OB residents, big crowds assemble Wednesday nights at Veteran’s Plaza, and many attendees are seen not wearing masks or practicing social distancing.Ocean Beach Town Council President Mark Winkie told ABC 10News in a previous interview that residents “want people to understand this is our community. You’re welcome to be here, but you need to adhere to social distancing rules and respect our community.”Winkie has met with City of San Diego officials about the gatherings in OB. He said the city was looking to shut down Veteran’s Plaza to help with enforcement.On Tuesday morning, ABC 10News spotted city crews placing plastic netting at the park.While he said the town council is not happy the park is closing, Winkie said a closure would allow needed renovations at the park to be done.The OB Town Council has also been pushing for more education to remind people about following the rules.Winkie said he’s been told health officials will be at Veterans Plaza on Wednesday nights to spread the word about county health guidelines. 1746
