SAN DIEGO (KGTV) — A decision regarding the release of a sexually violent predator into Jacumba Hot Springs has been delayed.A judge said he still needed to look at alternatives after researching the proposed home at 45612 Old Highway 80 in Jacumba Hot Springs where 60-year-old Michael Poulsom would live if released. After listening to testimony, the judge says he’s not ready to make a decision about whether to grant his petition to be released from a mental hospital.Poulsom was convicted on three separate occasions, including twice in San Diego, for sex crimes involving children. He was sentenced to 15 years in prison in 1995, but committed to a state hospital as a SVP, a designation for sthose convicted of a sexually violent offense and diagnosed with a mental disorder. In Poulsom's case, he was diagnosed with pedophilia disorder.He has since petitioned for his release into a conditional release program for sex offenders. Doctors have medically cleared the release.RELATED: Bill introduced to keep sexually violent predator hearings open to publicAmong those that testified today was County Supervisor Dianne Jacob, who represents the area where Poulsom would be released. She says there has to be other areas he can go."Where are the other 700 places they checked out. I question that and I question if they checked out over 700," Jacob said.This hearing comes just after the court of appeals threw out a judge’s decision that would have freed the man known as the “Bolder than Most Rapist,” Alvin Quarles. Quarles was charged in more than 50 rapes, robberies, and burglaries in the 80s. His victims have fought to keep him away from the community.In Poulsom's case, the judge did not give a timeline as to when he will makes his decision.City News Service contributed to this report. 1809

SAN DIEGO (KGTV) - A City Heights elementary school was placed on lockdown Wednesday morning following reports of gunfire in the area.San Diego Police responded to the call of shots fired near Colina del Sol Park at 5319 Orange Avenue just after 9:30 a.m. Wednesday.Fay Elementary - located across the street from the park - was placed on a precautionary lockdown, according to police. The lockdown was lifted within an hour.Two individuals were detained following the reports, but police did not confirm whether they were associated with the shooting. Police did say they are searching for one more individual.Police recovered shell casings at the scene, but would not say how many were recovered. No injuries have been reported.SDPD officers were on the scene Wednesday afternoon investigating.  840

SAN DIEGO (CNS) - The state Supreme Court Thursday ruled that a San Diego citizens' initiative that cut back city employee pensions was illegally placed on the ballot, and ordered an appeal court to consider a remedy.Proposition B, initially approved by voters in 2012, eliminated guaranteed pensions for new city employees, except police officers, and replaced those benefits with 401(k)-style retirement plans.In 2015, one of the city's largest public sector unions challenged the benefit system, alleging former Mayor Jerry Sanders and other officials illegally placed the measure on the ballot without conferring with labor groups. The Public Employees Relations Board ruled with the union, but the Fourth District Court of Appeal reversed the decision in April 2017.Now, the appeal court's decision is overturned."We reverse the Court of Appeal's judgment and remand for further proceedings to resolve issues beyond the scope of this opinion," wrote Associate Justice Carol A. Corrigan in Thursday's decision, in agreement with the other five justices.A city spokesperson couldn't be reached for comment.The court ruled that although it was a citizens' initiative, Sanders' support of Prob B as policy warranted engagement with the unions under the Meyers-Milias-Brown Act, which gave city and county employees the right to collective bargaining in 1968.Governing bodies "or other representatives as may be properly designated" need to engage with unions "prior to arriving at a determination of policy or course of action," according to the act.Sanders had said he supported the measure as a private citizen, not a public employee. The Supreme Court ruled that Sanders did use the power of his office to push the initiative, however."He consistently invoked his position as mayor and used city resources and employees to draft, promote and support the Initiative. The city's assertion that his support was merely that of a private citizen does not withstand objective scrutiny," Corrigan wrote.In overturning the Public Employees Relations Board ruling in 2017, the appeal court took an "unduly constricted view of the duty to meet and confer," according to the Supreme Court ruling.The Supreme Court ruled that the appeal court address an "appropriate judicial remedy" for the illegal placement of the initiative on the ballot.The Public Employees Relations Board had previously ruled the city must pay employees "for all lost compensation" related to lost pension benefits, which would cost millions of dollars.The 401(k)-style system was originally intended to save taxpayers money by reducing future pension liabilities. Approved by 65 percent of voters, the system was the first of its kind among California municipalities. 2742

  

SAN DIEGO (CNS) - The two most popular baby names in San Diego County in 2018 were Liam and Emma, the county Health and Human Services Agency announced today.Emma led all other names with 264. Among girl names, Olivia was second with 235, according to the county, with Mia, Isabella, Camila, Sophia, Sofia, Victoria, Mila and Charlotte rounding out the top 10.Liam led all boys' names with 242, followed by Noah at 202. Other top 10 boy names were Sebastian, Mateo, Benjamin, Daniel, Ethan, Oliver, Alexander and Logan.It was the third consecutive year in which Emma led all girls' names and the second consecutive year that Liam led among boys. Noah has placed either second or first among boys' names in each of the last four years, according to county data.Nationally, Liam and Emma were second and third, respectively, among names for boys and girls born in 2018, with Jackson and Sophia topping the list, according to the parenting website babycenter.com.In total, 41,555 babies were born in San Diego County in 2018. SAN DIEGO (CNS) - The Utah football team arrived in San Diego Wednesday and practiced at Mesa College in Clairemont, five days before facing Northwestern in Monday's Holiday Bowl. The Utes bowl week itinerary includes a joint visit with the Wildcats to U.S. Navy aircraft carrier USS Theodore Roosevelt on Friday and a trip to the San Diego Zoo on Saturday. The Northwestern team is staying at the Marriott Marquis San Diego Marina in downtown San Diego and practicing at Southwestern College in Chula Vista. The Wildcats will visit SeaWorld on Saturday.
