SAN DIEGO (KGTV and ABC) - Fishermen had a close encounter with killer whales off the San Diego coast that was caught on camera. The group was on a 21-foot boat looking for yellowtail when they came across the orcas. "Out of nowhere, one of them popped up right next to the boat 3 or 4 feet away from me…landed, splashed me, and splashed the whole side of the boat. I screamed,” witness Nathan Benge told Good Morning America. One of the killer whales had a playful interaction, performing a belly roll beneath the surface of the boat’s wake, GMA reported. SAN DIEGO (KGTV) -- A frustrating mystery is plaguing commuters in Carmel Valley.A seemingly perfectly good brand new lane meant to ease traffic to the 56 has been coned off for months. The project adds a third lane on southbound Camino del Sur from around Highland Village place to Highway 56. Greg Agius, who commutes that way, says it's been coned off for months. A city staffer told him it would be complete by the end of August, but on Monday it was still inaccessible to drivers. RELATED: San Diego road repairs are ahead of scheduleAgius, who also bikes in the area, said it is making for a tight merge that has led to near fender benders. "It's backing up my commute," he said. "I've actually over the last three to four months had maybe half a dozen close calls."The lane is meant to lighten the congestion in Carmel Valley, which is getting increasingly congested as more housing is built. Developer Lennar hired contractor MGI to add the lane as part of its approval for area housing projects. RELATED: San Diego projects receive funding due to controversial gas tax"This is the one that baffles me the most because it's more dangerous what they've done with the cones than if the cones weren't here," Agius said. The problem rests with the traffic light at the intersection. It doesn't stretch far enough over to be visible to all cars in the new lane. Caltrans Spokesman Ed Cartagena gave an example of cars next to a semi-truck.They wouldn't be able to see the traffic light if not in front of them. Cartagena said it needs to be extended before anyone can benefit from the new asphalt. He also noted recent other work on the lane, above and below ground, including removal of an electric box ten inches above ground.  Either way, Cartagena said the new light should be installed by the end of the week, clearing the way for the lane to open. A city spokesman said the contractor had delays in obtaining the signal pole and mast-arm for the traffic light. SAN DIEGO (CNS) - Virulent Newcastle disease was detected this weekend at a property in central San Diego County, a state veterinarian said Sunday. Friday's detection was identified when a private veterinarian submitted dead birds to the California Animal Health and Food Safety Laboratory System, according to state veterinarian Dr. Annette Jones. Response team members from the California Department of Food and Agriculture and the U.S. Department of Agriculture are working through the Labor Day weekend on control measures, including restriction of bird movement, mandatory euthanasia of infected and exposed birds, and surveillance testing near the property where infection was detected. "We are moving quickly to investigate the origin of disease as well as any movement of birds or equipment that could carry infection," Jones said in a statement. Detections of virulent Newcastle disease have decreased greatly over the last few months, she said. "Our priority remains to stop the spread of the virus and eradicate the disease," Jones said."We have made significant progress toward this goal by identifying and clearing remaining pockets of disease, but this case reminds all bird owners in Southern California to remain aware of VND signs, practice good biosecurity, stop illegal movement of birds from property to property, and report any sick birds immediately to the Sick Bird Hotline, 866-922-2473."Members of the 'home flock' community encourage keeping your birds where they are, wash your hands, change your clothes and shoes after contact with the birds to prevent the spread of the disease.The disease put California on a quarantine, keeping businesses from buying new chickens, leaving cages empty. SAN DIEGO (CNS) - Three San Diego County sheriff's deputies were justified in fatally shooting an Alpine man who charged at them with a knife in his hand last fall, according to a report released Wednesday by the District Attorney's Office.Daniel Ayala, 31, was shot 10 times outside his apartment in the 2600 block of Alpine Boulevard last Nov. 12.Sgt. Chris Katra, Cpl. Sean McGillicuddy and Deputy Kevin Nulton responded to that address around 2:50 p.m. following reports that a man was screaming, talking about killing himself and others, and throwing items, according to a letter prepared by District Attorney Summer Stephan and addressed to San Diego County Sheriff Bill Gore.Body camera footage from two of the lawmen was also released by the D.A.'s office.RELATED: Man who was fatally shot by deputies in Alpine identifiedAs the deputies approached the front door of Ayala's unit and knocked, announcing ``Sheriff's Department'' three times, Ayala opened the door, said ``What's up!'' and jabbed a knife twice through his metal screen door, the body-worn camera footage shows.The deputies backed up from the door as Nulton alerted the others by saying ``Knife, knife, knife.''Ayala then opened the screen door and advanced towards the lawmen, who opened fire, striking him mostly in the upper body, according to Stephan's letter.Ayala died at the scene. His 5-year-old son was inside the apartment during the entire encounter, but was physically unharmed, according to the district attorney.Toxicology results showed Ayala had methamphetamine, heroin, cannabis and alcohol in his system.Stephan's letter concludes that the deputies ``were in a confined space when Ayala advanced on them quickly with a knife in his hand.'' The letter also notes Ayala's previously reported statements about killing people.``The deputies had no other option available to them as they Ayala could stab them immediately and seriously injure or kill them,'' the letter reads.Katra has been employed by the San Diego Sheriff's Department for 18 years, McGillicuddy for 12 years and Nulton for 10 years. 2096

SAN DIEGO (KGTV) -- A 65-year-old woman was rushed to the hospital after being struck by a vehicle in Serra Mesa on Christmas eve. According to police, the incident happened just before 8 p.m. at the intersection of Ruffin Road and Village Glen Drive near the Village Glen Apartments. Police say the woman was crossing the street when she was struck by a 16-year-old driver. The woman was rushed to the hospital with major injuries. The teen remained at the scene after the crash.
