SAN DIEGO (KGTV) — A former San Diego Sheriff's Department Captain accused of operating an illegal firearms trafficking business was arrested Friday.Former SDSO Capt. Marco Garmo is accused of operating the illegal firearms trafficking business, at times from his office at Rancho San Diego Station, authorities say. The indictment also accuses a fellow Sheriff's deputy, Lt. Fred Magana, prominent San Diego jeweler Leo Hamel, firearms dealer Giovanni Tilotta, and El Cajon resident Waiel Anton with aiding the Captain's business.Officials say Garmo was operating the illegal business during his entire tenure as Captain at the Rancho San Diego Station. The 27-year veteran of the department, who retired in September, is accused of beginning the business for profit and to gain future donors for an anticipated campaign for San Diego County Sheriff.RELATED: San Diego Sheriff's captain on leave during criminal investigationFriday morning, Magana and Hamel both plead guilty to charges including engaging in the business of dealing in firearms without a license, false statement in acquisition of a firearm, and conducting firearms transaction in violation of state law.Both admitted to aiding Garmo's business by making "straw purchases" of firearms, or purchases of firearms on behalf of someone else. The pair also admitted to creating false records to conceal those purchases, and offering to promote Garmo's weapons. As part of his plea, Hamel admitted to buying a variety of handguns from Garmo and making purchases in which Garmo would falsely report that he had acquired the guns for himself, not Hamel. The local jeweler also admitted to acquiring several firearms from Garmo without proper documentation and planning a false paper trail.Hamel must forfeit more than 200 firearms and 100,000 rounds of ammunition seized during a February 2019 raid.RELATED: FBI, ATF raid home, businesses of prominent San Diego jeweler Leo HamelMagana admitted to straw purchasing a pair of "off-roster" firearms, which are guns made available for law enforcement but not the public, for Hamel at Garmo's direction and advertising Garmo's firearms to potential customers.Officials say Anton helped buyers apply for concealed carry permits as part of his "consulting" business and received money to give buyers early appointments and avoid the backlog of other applicants. Anton is charged with also giving "kickbacks" to Garmo for referrals.Investigators accuse Tilotta, the owner of Honey Badger Firearms, with organizing Garmo's straw purchases and submitting false firearms records. While law enforcement officers are allowed to resell off roster guns in certain instances, Garmo was reportedly warned by the ATF that excessive resales for profit could violate federal law. Officials say Garmo acquired about 146 firearms between March 2013 and February 2019 and sold or transferred 104 of them.Investigators also accused Garmo of lying about tipping off a cousin, who was a partner in an illegal marijuana dispensary called Campo Greens, of an impending warrant search he had received for the business. The tip off allowed the business to clear any products or cash before authorities arrived.Sheriff Bill Gore said in a statement Friday that Garmo's actions do not represent the department:"In the spring of 2017, the San Diego County Sheriff's Department learned an employee was possibly involved in misconduct. Upon confirming the information and determining the misconduct potentially involved criminal activity, the Sheriff's Department requested an investigation by the Federal Bureau of Investigation (FBI) and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). The FBI and ATF conducted a thorough investigation and the United States Attorney's Office, Southern District of California, issued indictments on one current Sheriff's employee and one former employee. I want to thank our federal law enforcement partners for their diligence on this case, and I have the utmost confidence in the criminal justice system.Acts such as these are a violation of public trust and tarnish the reputation of law enforcement. I am disappointed by the actions of these two individuals, as they do not reflect the values of this department and its thousands of trustworthy, hard-working employees. SAN DIEGO (KGTV) — A 14-year-old teen has been arrested and charged with a hate crime after punching a Rabbi near a University City synagogue, police say.San Diego Police said Rabbi Yonatan Halevy, of the Shiviti Congregation, was walking near the synagogue located near 3200 Governor Drive on Oct. 10, when he was punched by the teenager. The teen reportedly yelled racial slurs during the attack and fled the location, police added. SAN DIEGO (CNS) - The San Diego Unified School District announced plans Thursday to offer voluntary in-person learning sessions for elementary school students identified as experiencing learning loss.While the district is preparing to open its 2020-21 school year Monday for remote, online learning for all students, some children who have faced learning challenges due to the COVID-19 pandemic may be offered appointments to take part in the in-person sessions, which could begin as soon as late September, according to the district.Sessions will be held in spaces "with adequate air exchange, including MERV-13 air filters and/or portable ventilation units," according to the district.Students will be identified by their teachers for participation based on several factors:-- Below standard, represented by an average academic mark of a 1 or 2 in Math or English Language Arts strands on their Spring 2020 report card-- Students who do not have a Spring 2020 report card (incoming TK, K or new students to the district) and do not make progress toward grade-level standards once schools open-- Special education students not meeting their IEP goals-- Special education students with intense support needs-- Students who have been recommended for an initial assessment for an IEP or require a triennial assessment, and require standardized assessment that cannot be completed online for eligibility"We remain committed to following the science in designing our response to the COVID-19 crisis, including all of the recommendations we received from our expert panel of UCSD science and health professionals that included a phased return to in-person instruction," said District Superintendent Cindy Marten."This is Phase One, which provides a measured approach to address the very real problem with learning loss, faced by our most disadvantaged students, while maintaining the strict standards put in place to protect the health and safety of all students, staff and community," Marten said."Online learning has created new challenges for every student. SAN DIEGO (KGTV) — A 58-year-old man severely injured after an assault at a home in Clairemont in early April died Monday. According to police, 58-year-old Randy Taing died of his injuries in the evening of April 8. San Diego Police said the incident occurred in the 4100 block of Ashford St. before 12 p.m. The man reportedly called his wife sometime around 11:45 a.m., though his wife said the phone was silent.She asked her son to call, who got through to his dad. That's when the man told his son something along the lines of a possible break-in, police say.The man's son called 9-1-1 and rushed home to find his father with upper body injuries. The man was taken to a nearby hospital with life-threatening injuries, police said. Police said there were no signs of forced entry, but a safe had been taken. Neighbors of the family-owned business a mile away from their home, Rose Donuts, said the safe probably contained cash from the business. A family friend said the father, who he called Randy, was asleep at home during the robbery because he was filling in for his nephew at work. He said he was baking donuts at 2 a.m. while his nephew was on vacation.Customers who work in the area say the family is beloved. "They have two boys and sometimes they even babysit the grand kids while they’re working... SAN DIEGO (CNS) - Three San Diego County sheriff's deputies were justified in fatally shooting an Alpine man who charged at them with a knife in his hand last fall, according to a report released Wednesday by the District Attorney's Office.Daniel Ayala, 31, was shot 10 times outside his apartment in the 2600 block of Alpine Boulevard last Nov. 12.Sgt. Chris Katra, Cpl. Sean McGillicuddy and Deputy Kevin Nulton responded to that address around 2:50 p.m. following reports that a man was screaming, talking about killing himself and others, and throwing items, according to a letter prepared by District Attorney Summer Stephan and addressed to San Diego County Sheriff Bill Gore.Body camera footage from two of the lawmen was also released by the D.A.'s office.RELATED: Man who was fatally shot by deputies in Alpine identifiedAs the deputies approached the front door of Ayala's unit and knocked, announcing ``Sheriff's Department'' three times, Ayala opened the door, said ``What's up!'' and jabbed a knife twice through his metal screen door, the body-worn camera footage shows.The deputies backed up from the door as Nulton alerted the others by saying ``Knife, knife, knife.''Ayala then opened the screen door and advanced towards the lawmen, who opened fire, striking him mostly in the upper body, according to Stephan's letter.Ayala died at the scene. His 5-year-old son was inside the apartment during the entire encounter, but was physically unharmed, according to the district attorney.Toxicology results showed Ayala had methamphetamine, heroin, cannabis and alcohol in his system.Stephan's letter concludes that the deputies ``were in a confined space when Ayala advanced on them quickly with a knife in his hand.''
