VISTA, Calif., (KGTV) — The man and woman accused of fatally stabbing a Carlsbad woman in March appeared at their preliminary hearing on Wednesday. Ian Bushee and Malissa James pleaded not guilty to all charges, including murder and burglary. The District Attorney called several witnesses, playing 911 calls and never-before-seen police body camera footage in the courtroom. The 911 call was from the victim, Marjorie Gawitt.Dispatcher: 911. What's your emergency?Marjorie: (inaudible) I've been attacked. That was the beginning of Gawitt's dying message on the morning of March 11, 2019. The 63-year-old woman was sleeping in her Carlsbad home alone when police said Bushee and James tortured and stabbed her fifty times in the face, neck, and back. Dispatcher: We've got help sent out to you, Marjorie. Who did this?Marjorie: I don't know. It took everything Gawitt had left in her to make that 911 call. The call was so tragic, officers testifying on the stand became choked up while listening to Gawitt's voice. Because of her final act of courage, Officer Randy Noa found her minutes later, still alive. On his body camera video, you can hear him trying to speak to Gawitt."You okay ma'am? Oh. Ma'am. Is he still in here or did he leave? (PAUSE) I can't hear you, ma'am," Officer Noa said, breathing heavily."It looked like she was trying to say to me that he was gone. But it was hard," Officer Not testified inside the courtroom. The District Attorney also played a second body camera video, worn by Officer Derek Harvey. On it, you can hear him trying to console the victim. "Ma'am, you're going to be okay. The paramedics are going to be here, any second, okay?" Officer Harvey said. Minutes later, Harvey's camera recorded him finding what looked to be the weapon on the counter."Her eyes were clouded, dilated and fixed," Officer Harvey said. "I knew she was... probably not going to make it." He was right. Despite the paramedics arriving quickly, Gawitt died at Scripps La Jolla Hospital. With the only eyewitness now gone, investigators were back at square one. What they did know was that the victim's gold car was missing, so they worked to track that down. Hours later, surveillance video captured the victim's stolen car in San Marcos. The suspects were taped walking around near a masonry warehouse and at a 7-11 store. Investigators said the two later ditched the stolen car in San Marcos, and for some reason, rode a bus back into Carlsbad. The two were later arrested near the original crime scene. Police said it turns out Gawitt's home was not the first the pair had ransacked that day. "I looked up, and I said something is missing here," neighbor Patricia Gapik said. That same morning, Gapik noticed her sewing basket and her daughter's flute were gone. Random items were also scattered near her sliding glass door. "I then realized that someone was in my house," Gapik testified. "I was scared."Luckily, Gapik was asleep the entire time, and never confronted the burglars. But investigators later found that the two cases were connected. They found some of Gapik's belongings inside the car left in San Marcos. The suspects, Ian Bushee and Malissa James were the same. Thursday morning, the Medical Examiner will be giving his testimony on Gawitt's fatal injuries. 3303

VISTA, Calif. (KGTV) -- Jury selection is expected to take all week in the trial of former NFL tight end Kellen Winslow II. The San Diego football star and son of Chargers Hall of Famer Kellen Winslow Senior pleaded not guilty to charges that he raped two homeless women in Encinitas last year. He's also charged with raping an unconscious seventeen-year-old girl back when Winslow was nineteen. Prosecutors say he was out of custody on million bail in connection with the felony case when he got in trouble again. Prosecutors say he fondled himself in front of a 77- year-old woman at a Carlsbad gym, asked her if she liked it, and groped her while she was in a hot tub at the same gym.Jan Ronis is a San Diego defense attorney not affiliated with the case, but watching it closely. "From what I've seen at the preliminary examination, everyone that testified seemed to have a lot of credibility. These were older women, you would extend the greatest credibility to that kind of witness," said Ronis. Winslow played ten seasons with the NFL. His defense team is reportedly planning to call two psychiatrists to testify. It's unclear if CTE, or Chronic traumatic encephalopathy will play a role in that defense. Ronis says it might not make a difference. "You can still be responsible for your conduct , criminally responsible, after having sustained a traumatic brain injury or something of that nature. It's different than say, your mental health issue was such that rendered you incapable of understanding the nature of your conduct that you couldn't understand the difference between right and wrong, " said Ronis. WASHINGTON — An Associated Press investigation has identified at least six sexual misconduct allegations involving senior FBI officials over the past five years, including two new claims brought this week by women who say they were sexually assaulted by ranking agents.The AP found several of the accused FBI officials were quietly transferred or retired, keeping their full pensions even when probes substantiated the sexual misconduct claims.Beyond that, federal law enforcement officials are afforded anonymity even after the disciplinary process runs its course, allowing them to land on their feet in the private sector or even remain in law enforcement.According to the AP's report, one FBI assistant director retired after he was accused of groping a female subordinate in a stairwell. Another official was found to have credibly harrassed eight employees, and another agent retired after he was accused of blackmailing an employee into sexual encounters."They're sweeping it under the rug," said a former FBI analyst who alleges in a new federal lawsuit that a supervisory special agent licked her face and groped her at a colleague's farewell party in 2017. "As the premier law enforcement organization that the FBI holds itself out to be, it's very disheartening when they allow people they know are criminals to retire and pursue careers in law enforcement-related fields.""They need a #MeToo moment," said Rep. Jackie Speier, D-California. "It's repugnant, and it underscores the fact that the FBI and many of our institutions are still good ol’-boy networks. It doesn't surprise me that, in terms of sexual assault and sexual harassment, they are still in the Dark Ages."In a statement, the FBI said it "maintains a zero-tolerance policy toward sexual harassment" and added that severe cases can result in criminal charges. WASHINGTON (AP) — Dozens of email accounts at the Treasury Department were compromised in the massive breach of U.S. government agencies being blamed on Russia. That's according to an Oregon Democrat, Sen. Ron Wyden, who says hackers broke into systems used by the department’s highest-ranking officials. Wyden issued a statement Monday after he and other members of the Senate Finance Committee were briefed by the IRS and the Treasury Department. Wyden says that though there is no indication that taxpayer data was compromised, the hack “appears to be significant." In addition, the breach appears to involve the theft of encryption keys from U.S. government servers, Wyden said.“Treasury still does not know all of the actions taken by hackers, or precisely what information was stolen,” Wyden said in a statement.It is also not clear what Russian hackers intend to do with any emails they may have accessed.A Treasury Department spokeswoman declined to comment on Wyden’s statement.Treasury was among the earliest known agencies reported to have been affected in a breach that now encompasses a broad spectrum of departments. The effects and consequences of the hack are still being assessed, though the Department of Homeland Security’s cybersecurity arm said in a statement last week that the intrusion posed a “grave” risk to government and private networks.In the Treasury Department’s case, Wyden said, the breach began in July. But experts believe the overall hacking operation began months earlier when malicious code was slipped into updates to popular software that monitors computer networks of businesses and governments. 1645
