SAN DIEGO (KGTV) — A San Diego hairstylist is suing Governor Gavin Newsom over closures of indoor salons. It comes even after a revised order that allows them to operate outside.Amy Mullins-Boychack doesn’t take just any client.“They might have to pace for 15 minutes before they can regulate their anxiety to get a hair cut,” she said.She’s been cutting hair for children with special needs at her salon “THAIRapy” for eight years. Under restrictions from the state, salons are only allowed to operate outdoors.She says that’s not an option with her clients.“I have clients that don’t have impulse control,” said Mullins-Boychack. “They don’t have the ability to just sit anywhere and get a hair cut.”So she joined a lawsuit filed against the governor in March. The plaintiff, JD Bols, is a landlord to several churches and beauty salons in San Diego.The lawsuit also names Mayor Kevin Faulconer, Sheriff Bill Gore, and the County Board of Supervisors as defendants. It claims the pandemic-related restrictions violate civil rights and have financially crippled businesses deemed non-essential.“This isn’t about vanity," says Mullins-Boychack. “This is a life skill for them, this is routine, this is repetition, this is part of their livelihood, part of their social skills.”In addition to the lawsuit, she’s working to get an exemption from the governor to continue her business indoors. 1398

SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544

SAN DIEGO (KGTV) - A man fired as many as five shots at a parked car in San Ysidro Wednesday morning, San Diego Police said.The shooting happened at 7 a.m. at an apartment complex near West San Ysidro Boulevard and Dairy Mart Road, according to officers.No one was hurt by the gunfire.Police said the man surrendered peacefully when they arrived at the scene. SAN DIEGO (KGTV) — A local sailor got an emotional holiday surprise thanks to the generosity of some frequent fliers.Navy diesel mechanic Joe Ramsay just learned his brother is flying in for the holidays."Don't really have the words to describe it," said Ramsay.Ramsay has been stationed in San Diego for more than two years. After hernia surgery this summer, his finances got stretched. There would be no trip home to North Carolina for the holidays."I was going to spend it with friends or alone. That was pretty much my plans," said Ramsay.That wasn't the plan for Ramsay's brother Trey, who entered a contest put on by New York entrepreneur Peter Shankman. The businessman decided to collect and donate hundreds of thousands of airline miles in hopes of reuniting families."Just wanted to get to my brother for the holidays. I haven't seen him in a year or so," said Trey Ramsay.In his entry, Trey called his brother "the closest person in my life," adding the family hasn't been able to visit Joe since he arrived in San Diego. San Diegan Rhys Ford, a mystery writer who travels for her job, donated 45,000 miles and two tickets."It's seeing people reuniting. It's the fact that somebody's so excited to get on a plane. SAN DIEGO (KGTV) - A San Carlos family is hoping surveillance video will help track down the man recorded making himself comfortable in their home.Along Wallsey Drive, the Meduna family got a heart-sinking scare the day before Halloween.Around 8:30 a.m, Megan Meduna and her husband both got a notification that their garage door was open.  Inside the home, a camera was recording an intruder. Meduna says the man had pried open a window screen in the front and forced open a window.  A sound heard in the video is the burglar opening the door to the garage, before he's seen shutting the window he just climbed through. As he puts on his gloves, he walks up to the camera and flips it over."It's just creepy, creepy to see someone in my house sneaking around," said Meduna.By the time police arrived, the man was gone. He got away with only a little bit of cash, but the impact was felt across a neighborhood.  Surveillance video showed him casing the area.  Minutes before the break-in, a neighbor reported seeing the man knocking at her door, then pretending to need directions when she answered the door.  At another home, a ripped screen was found near a side window and an out-of-place brick was discovered outside another window.Neighbors are now wondering if the same man could be linked to other burglaries. A few weeks ago and blocks away, 10News reported on a break-in with a similar MO that left a newlywed couple missing wedding gifts and family heirlooms.  A month ago, there was a another burglary at Meduna's home, in which electronics and jewelry were taken."Feel violated and angry.
