MARTIN COUNTY, Florida — The Martin County Sheriff's Office said a 28-year-old man faces poaching charges after deputies said he was caught with two gopher tortoises at a state park.Deputies responded Sunday evening to Seabranch Preserve State Park and found the suspect, identified as Robert Lane, on the ground.The sheriff's office said Lane pulled two endangered tortoises from their hole and was on the ground searching for others.Lane was in possession of a male and a female gopher tortoise when deputies caught him.They said he admitted to deputies that he pulled both of the tortoises from their hole and was going to take them home where he had planned to eat them.Gopher tortoises are a threatened species and federally protected.The case was turned over to the Florida Fish and Wildlife Conservation Commission. Lane faces charges related to poaching on state property.Deputies said they found the hole where Lane pulled the tortoises from and returned both reptiles to the location.  1043

MIAMI — All of South Florida is now in the cone of concern for Hurricane Eta, which hammered Nicaragua on Tuesday.According to the 4 a.m. ET update from the National Hurricane Center, Eta is packing maximum sustained winds of 60 mph.The NHC said Eta will rapidly weaken as the storm moves farther inland over Nicaragua and Honduras.The forecasts project the storm will curve and emerge over the northwestern Caribbean Sea on Thursday night or Friday. Once it does, forecasters said it could re-strengthen into a tropical storm.By Sunday at 7 p.m., the center of Eta will be just south of Florida with maximum sustained winds of 60 mph.According to meteorologists for Scripps station WPTV in Palm Beach, Florida project that there will be a higher confidence on Friday for the potential impacts in South Florida."Computer models are in fairly good agreement, but the timing is different," said WPTV chief meteorologist Steve Weagle said. "Some are much faster, bringing the rainfall in on Friday. Others a lot slower, bringing it in on Saturday."At that point, Weagle said the forecast is calling for tropical storm conditions over the weekend with heavy rain and gusty winds.Weagle said rain bands will likely arrive later on Friday, loosely tied to Eta and a weak front over Cuba. Heavy rain squalls and possible tropical storm conditions are in the forecast for Saturday and Sunday."It'll likely be a very sloppy, disorganized weather system as it moves through," Weagle said. Massachusetts is the first state since the deadly shooting in Las Vegas last month to ban bump stocks, the gun accessory the shooter used to increase his rate of fire.Bump stocks became a major source of discussion among lawmakers across the country after the attachments were found on the guns of Las Vegas shooter Stephen Paddock, who killed 58 and injured some 500 last month. But talk of banning the devices nationwide appears to have stalled.Beginning in 2018, penalties for the possession or use of a bump stock or trigger crank in Massachusetts will range from probation to life in prison, Representative David Linsky, a Democrat who proposed the amendment, told CNN.The new law defines a bump stock as "any device for a weapon that increases the rate of fire achievable with such weapon by using energy from the recoil of the weapon to generate a reciprocating action that facilitates repeated activation of the trigger."In other words, the devices allow semi-automatic rifles to fire more rapidly, similar to automatic weapons. Twelve of them were found on firearms recovered from Paddock's Las Vegas hotel room.Critics of the legislation say lawmakers rushed to push the passage without holding public hearings.Jim Wallace, Executive Director of the Gun Owners Action League, a Massachusetts gun-rights group, called the legislation "a knee-jerk reaction."Though lawmakers in the Massachusetts House and Senate both introduced traditional bills just days after the October 1 Las Vegas shooting, the legislators ultimately felt they needed to act in response to a public outcry from constituents, Linsky told CNN.Constituents flooded the inboxes of Massachusetts lawmakers, and Linsky said the "vast majority were begging legislators to do something about the situation."State House members enacted the ban by introducing language in an amendment to the fiscal year 2017 budget.RELATED: Senate Democrats want to ban assault weapons 1948
