SAN DIEGO (KGTV) — New details are emerging about the death of a man in San Diego Sheriff’s deputies’ custody. A recently released Medical Examiner’s report says an arrestee’s death last year was a "homicide." The District Attorney's office said last year that none of the deputies involved in the in custody death will face any criminal charges. Oscar Leal died last February 28 after deputies responded to his apartment in Vista and detained him. The Medical Examiner’s homicide classification is not a legal term, but a medical assessment. The DA's office wrote in part of a nine-page summary and statement in December last year: "... His level of methamphetamine intoxication combined with his active resistance combativeness in the duration of the struggle, all contributed to his death ... The deputies involved in his detention acted reasonably under the circumstances in bear no state criminal liability for their actions."The Sheriff Bill Gore wrote in a statement:"I am aware of the Medical Examiner's conclusion regarding the manner of death of Mr. Leal. I respectfully disagree with the classification of the manner of death in this case as a homicide.The pathologist wrote that his death was due to acute methamphetamine toxicity in the setting of agitation, physical altercation, and prone restraint. It was purely due to Mr. Leal's agitation that he was restrained. Peace officers have a duty to restrain those who are agitated and under arrest, as Mr. Leal was. Were it not for Mr. Leal's abuse of methamphetamine he would be alive today. The deputies and nurses on scene rendered immediate aid to Mr. Leal.Mr. Leal brought upon his own death with his choice to use methamphetamine. His manner of death is more accurately classified as an accident."It has not been made clear yet why the medical examiners report took 13 months to be released. 2135

SAN DIEGO (KGTV) - More than 830 pounds of narcotics, over .5 million and 20 fugitives were captured over the weekend in San Diego and Imperial Valley counties.Border officials said the seizures occurred from Friday, March 9 to Sunday, March 11. U.S. Customs and Border Protection officers intercepted 465 pounds of methamphetamine, 85 pounds of cocaine, 45 pounds of heroin, and 240 pounds of marijuana.The drugs were hidden within various places inside vehicles, including door panels, floors, and gas tanks.RELATED: US border officer falsely claimed to be US citizen, authorities claimDuring that same period of time, officials arrested 20 people for various charges including sex assault, embezzlement, burglary, shoplifting, and probation violation."Narcotics smugglers try to conceal their illegal items in many voids naturally found in vehicles," Pete Flores, director of field operations for CBP in San Diego, said. SAN DIEGO (KGTV) - On Normal Street in Hillcrest Friday, things were anything but normal.   Tim Henderson and his colleagues were checking email in the street."Just a minute ago, we had a meeting out here," he says while pointing to an assortment of chairs.    He and his co-workers at KTUA, a landscape architecture and planning firm, set up a little home office in a spot usually occupied by 3 to 4 parked cars.   The space was decorated with plants and patio furniture.Welcome to “Park(ing) Day 2017,” billed as a worldwide event where artists and designers transform metered parking spots into temporary public parks.    The event ran Friday from 9AM – 3PM, with several downtown businesses also taking park."We're in a ‘car-centric’ world, we always have to supply places for cars,” Tim explained.  “We're making a statement: during some part of the year, you can come out into a space not  being used for cars -- and have a park!"Henderson and his work buddies barbecued in the parking spots and even roasted s’mores.Parking is at a premium in Hillcrest, but Henderson said nobody seemed to mind them taking up the spots.    In fact, he said drivers had been slowing down to catch a glimpse at the “front yard” they created on the street.“They love it,” he said. 1351

SAN DIEGO (KGTV) -- Police have released photos of the man accused of badly beating a Pacific Beach bouncer Sunday night. According to police, four men tried to enter through the side door of a restaurant on the 700 block of Grand Avenue around 9:20 p.m. Sunday when a bouncer told the group they had to use the main entrance. As a confrontation escalated, police say one of the men picked up a metal crowd barrier pole, hitting the bouncer in his head. Others in the group then reportedly started fighting with other bouncers at the restaurant before all four men left, according to police. The bouncer who was hit in the head suffered a skull fracture and brain bleed. He was taken to the hospital in critical condition. Another bouncer suffered a broken nose and two other staff members suffered some bumps and bruises. The man suspected of swinging the pole was described as black, in his 30s, 6 feet tall, and 250 pounds with a muscular build. SAN DIEGO (KGTV) - Neighbors in College Area are a little more vigilant after a coyote attacking a chicken was caught on camera. Matt Dixon was grilling in his backyard when he heard squawking on the neighboring hillside. “One of the chicken flies into the fence,” said Dixon describing the video he took. “That’s when the coyote popped out of the clearing it there and made its way up and he eventually found what he was after.” Dixon posted the 28-second video online and found that people were quicker to forgive the coyote. “I got a lot of flak for not trying to help save the neighbor’s chicken and I can understand that,” said Dixon, “but it all happened so fast.” Other neighbors say they are more cautious with their children and pets outside knowing there can be coyotes in an urban area. 805
