SAN DIEGO (CNS) - California restaurant owners from across the state, including San Diego County, filed government claims today seeking refunds of state and local fees assessed during the COVID-19 pandemic, saying public health orders have forced them to shutter their doors or operate under capacity restrictions even as they're charged fees for liquor licenses, health permits and tourism assessments.The claims were filed in San Diego, Los Angeles, Orange, Sacramento and Monterey counties. Claims will also be filed in San Francisco, Fresno and Placer counties, according to the restaurant owners' attorneys.Plaintiffs' attorney Brian Kabateck said, ``Restaurant owners are obligated to pay these government fees just to operate, yet the same government entities who have collected those fees have forced these businesses to close their doors or drastically restrict operations due to the pandemic. We simply want the government to return those fees to those restaurants who followed the law and closed.''The state has 45 days to respond to the claims, which are necessary precursors to a potential class-action lawsuit.The move was supported by the California Restaurant Association, whose president and CEO, Jot Condie, said, ``Even when the restrictions are lifted, the devastating impact on the restaurant industry will extend for years. Restaurants have not received any form of relief. Easing fees would help enable establishments to stay open and keep vulnerable workers employed.'' Restaurants, like many other industries, have been hit hard by the pandemic, leading to the permanent closures of many establishments.A survey by the California Restaurant Association found 63% of responding owners said they have not received rent relief. SAN DIEGO (CNS) - A suspect in the strangulation death of a City Heights woman a half-century ago was behind bars Tuesday following his out-of- state arrest last weekend, San Diego police reported.John Sipos, 75, was taken into custody Saturday in Schnecksville, Pennsylvania, on suspicion of murdering 24-year-old Mary Scott, who was found slain at her home in the 4000 block of 39th Street on Nov. 20, 1969, according to Lt. Matt Dobbs."The investigators exhausted all leads at the time, and the case eventually went cold," he said.Recently, cold-case investigators identified Sipos as Scott's alleged killer via forensic genealogy, said Dobbs, who declined to disclose further information about the circumstances of the homicide.Sipos was being held at Lehigh County Detention Center in Allentown, Pennsylvania, pending extradition to San Diego. 856

SAN DIEGO (CNS) - Authorities Wednesday publicly identified a Chula Vista city employee found slain in his home near Mount Helix.Chula Vista police personnel conducting a welfare check at the request of a co-worker found the body of 38-year-old Kevin Powell in his residence in the 4400 block of Carmen Drive in Casa De Oro shortly after 1 p.m. Tuesday.Because the neighborhood is in an unincorporated area, the San Diego County Sheriff's Department was called in to take charge of the case, said sheriff's Lt. Thomas Seiver.Powell's death has been ruled a homicide, said Seiver, who declined to specify how the victim is believed to have died."The preliminary cause-of-death (finding) is being withheld for investigative reasons," Seiver said.Powell's work supervisor asked police to check on him after he missed several meetings, according to the sheriff's department. 878

SAN DIEGO (CNS) - County health officials today reported the death of a San Diego County man due to flu complications, bringing this flu season's death toll in the region to seven.The 73-year-old man died due to influenza A complications on Dec. 16, according to the county's Health and Human Services Agency.The man's vaccination status and medical history are still being investigated. The other six county residents who have died this season had additional medical conditions and either weren't vaccinated or their vaccination status was unknown."Influenza can be deadly, especially for the elderly and people with chronic medical conditions," said Dr. Wilma Wooten, the county's public health officer. "Getting a flu shot is the best way to prevent getting sick."At this time last year, 11 county residents had died due to flu complications. Last flu season was the county's worst in nearly 20 years of collecting data, with 342 residents succumbing to flu complications. Residents over the age of 65 with underlying medical conditions accounted for much of that death toll, according to the county.According to the county's weekly flu report for Dec. 16-22, lab- confirmed flu cases rose for the fourth consecutive week, from 290 to 410. That jump is a far cry, however, from the same week last flu season when reported cases spiked to 2,332. To date, 1,339 flu cases have been reported and lab- confirmed this flu season."While we're seeing fewer flu cases this season, everyone 6 months and older should get vaccinated since the flu season could last through April and even May," Wooten said.In addition to residents 6 months and older, county health officials and the Centers for Disease Control and Prevention strongly advise the annual flu vaccination for people with a heightened risk of serious flu complications, like pregnant women, people older than 65 and people with chronic conditions like asthma and diabetes.County residents can get vaccinated at doctors' offices, retail pharmacies, community clinics and the county's public health centers. 2070
