SAN DIEGO (KGTV) - There’s now a bombshell update about the standoff from earlier this summer at a condo complex near SDSU.Two officers were shot and dozens of neighbors were terrorized. 10News Investigative Reporter Jennifer Kastner has confirmed that officers wanted to search the suspect’s home for weapons days before the shooting.However, the Office of the San Diego County District Attorney did not attempt to get a search warrant. It was a horrifying night that ended with one person dead and two San Diego Police officers wounded by gunfire. Suspect Joseph Darwish died in the massive standoff.He had numerous hand guns and rifles, according to police. In the days after the shooting, 10News was tipped off by a law enforcement source that the FBI’s Joint Terrorism Task Force had wanted to search Darwish's home because they thought he had a weapon and was buying parts to make more weapons.Darwish wasn't supposed to own any weapons because of his criminal history. Our source says the FBI asked the District Attorney's Office to sign off on having a judge issue a search warrant, but the DA’s Office did not do so.For the past 7 weeks, 10News has been trying to confirm this with the DA’s Office.After our 10News attorneys got involved, the DA’s Office sent us a letter reading in part, “On June 13, 2018, the San Diego County District Attorney's Office received a request by law enforcement to review a draft of an affidavit in support of a search warrant to conduct a search of Mr. Darwish's person, property and residence. The District Attorney's Office determined that the warrant was legally deficient and so advised law enforcement.”June 13th was 10 days before the big shooting. 10News asked law enforcement expert and former police officer Kevin LaChapelle what "legally deficient" means. “It means that the District Attorney's Office felt that there was insufficient evidence or insufficient information that a judge would not grant a search warrant,” he explained.10News asked the DA’s Office why it turned down the FBI’s request to do a search warrant, but the DA’s Office will not answer that question, stating it's "exempt from disclosure".LaChapelle said this may have been a lesson learned the hard way, for the DA’s Office. He explained that the DA’s Office may reevaluate when it’s appropriate to seek a warrant. “It may help them start saying [a warrant] didn't meet [certain] criteria but it met this.It didn't meet a [level] 10 but it was at like a 7 and gosh, maybe [the DA’s Office needs] to start looking at this more so we can prevent these kinds of things,” he added. The FBI declined to comment about Monday’s story. San Diego Police have taken the lead on investigating the shootout. As of Monday morning, a lieutenant with the Homicide division said the investigation is still open and active and will probably take another couple of months to finish. 2913

SAN DIEGO (KGTV) — The Port of San Diego will begin its first over water testing of lighting on the San Diego-Coronado Bay Bridge, as the Port continues efforts to install lighting across a portion of the bridge.The testing will start on Sunday, Nov. 8, and continue to Saturday, Nov. 14, from 6:15 p.m. to midnight.The testing will include 170 computer-programmed LED lights and controllers temporarily installed on three of the bridge's tallest columns near the center of the structure. Each night, a live technical test will be conducted in different colors, combinations, sequencing, and arrangements."This bridge lighting test provides San Diego a unique opportunity to see what’s possible and how the infusion of technology and art can make people feel connected to, and inspired by, our beautiful waterfront," said Commissioner Marshall Merrifield, Port of San Diego Board of Port Commissioners. "Our goal is to ignite the imaginations of every person in the San Diego region, and after years of dedicated time to the project, bring forward a viable, beautiful addition to the nighttime skyline."The testing will see periods of darkness as other aspects are being tested, so the lighting won't be constant illuminated.The upcoming testing is the second test of the project. SAN DIEGO (KGTV) - The U.S. Coast Guard and Royal Canadian Navy offloaded 5,100 pounds of seized cocaine Friday, worth an estimated wholesale value of million.The drugs were brought off Her Majesty’s Canadian Ship (HMCS) Edmonton at Naval Base San Diego.The crews aboard the HMCS Edmonton were able to capture vessels smuggling the drugs in the Eastern Pacific in 49 days, detaining eight suspected smugglers.“Criminals don’t recognize international borders,” said Vice Adm. Linda Fagan, USCG Pacific area Commander. “I am particularly just excited to see this level of effort. It is a really hard mission to execute.”A U.S. Coast Guard law enforcement attachment was on board the Edmonton and the crews worked hand in hand as one team to make the drug busts.Once the drugs are offloaded, they will be turned over to the DEA. 837

SAN DIEGO (KGTV) — Three East San Diego County school districts are moving back to distance learning because of this weekend's harsh weather.The San Diego County Office of Education says schools in Julian Union Elementary School District and Warner Unified School District will move to distance learning on Monday. The county made move due to forecasted snow Sunday night and freezing temperatures on Monday.SDCOE added that Julian Union High School will have a snow day without distance learning with a scheduled makeup day at the end of the school year."The safety of students and school staff is of the utmost importance to San Diego County school districts," the county said in its announcement.The National Weather Service forecasts the Julian and Pine Valley areas will see one to two inches of snow overnight at 4,500 to 5,000 feet, and lows of 23 to 33 degrees.
