SAN DIEGO (KGTV) - Alarming audio files and documents from the San Diego Sheriff’s Department’s Internal Affairs Division have been released about the sexual misconduct investigation into ex-deputy Richard Fischer who was accused of assaulting 16 women. Team 10 has started pouring through the records.In one audio clip, an Internal Affairs interviewer is heard questioning, "As you're buckling her, did you say, 'I hope your husband doesn't mind?'" He responded, "I don't recall saying that." He was apparently being questioned about his interaction with a handcuffed woman who was in his patrol car. "Okay. Well, do you recall if your arm or your palm of your hand touched her breast?" she asked. He said, "No. I would say I can't recall for sure if I accidentally touched- rubbed against- not rubbed. Um, unintentionally touched her breast with my arm as I buckled her in."In another clip, a woman is heard describing how she says Fischer placed her hand on his private area. She said, "Oh my God. I was, like, in a panic. I didn't know what to do."The hours of audio recordings and hundreds of pages of reports from the Department have now been made public. For months, San Diego police agencies have been working to release past records related to officer misconduct, following last year's groundbreaking order by the courts. It came after ABC10 News and other media sued to keep some police unions from blocking departments from giving up files.Fischer pleaded guilty last year to multiple assault charges, following accusations that he groped, hugged or tried to kiss more than a dozen women while he was on-duty.Records released show copies of texts from a woman who he pulled over. They read, in part, “He asks me if I wanted to make out. I swear to God [redacted] every single word of this is true."Several times throughout the audio recordings, he's asked about women who he had met while he was on calls or doing traffic stops. "Did you, um, ask her, if [she] were older if she would ever go on a date with you?" asked the interviewer. "I don't believe I did. No,” he responded. "Is it possible you asked her that?" she asked. He replied, "[I’m] probably [going to] say ‘no’. I don't remember asking her that."This May, Fischer was released from jail on custody credits, just months after being sentenced to four years behind bars. 2351

SAN DIEGO (KGTV) — An elderly Army veteran is warning others after he was brutally attacked while riding his mobility scooter in North Park.Around 3:30 p.m. Tuesday, 81-year-old Phil Severns was headed to a grocery store on the scooter when it happened."I just felt a sharp blow on the right side of my head. It almost knocked me out ... My glasses came off and were broken,  and my head hurt terribly," said Severns.Severns says he turned around and saw two concerned women who described his attacker. He looked and saw a man on the run a block away, described as a black man in his mid-20s with long hair, a lean build, and blue shirt and shorts.MAP: Track crime happening in your neighborhoodAt that moment, Severns says he kept thinking that he had to find out who did it. Severns decided to go after him, following him into a nearby CVS Pharmacy parking lot, where he found the man swinging a sock that appeared to be filled with rocks."Confronted him and asked him why he hit me," said Severns.The answer? A claim that Severns had hit him first, which Severns calls untrue. Before the man took off, there was more odd behavior.    "Just walking in circles and waving that sock," said Severns.It appears he wasn't done. Across the street at Walgreens, managers tell 10News they believe the same homeless man punched a clerk an hour later, the second such altercation with the man in the past year. It's a revelation that makes Severns more fearful."He's dangerous and acting crazy. SAN DIEGO (KGTV) - After eight weeks of rehabilitation, SeaWorld San Diego rescue teams release seven rescued sea lions back into the ocean. Six of the sea lions were malnourished pups when they were first rescued. It took rescue crews about two months to help them regain their strength and nutrients needed. The seventh sea lion was discovered on La Jolla Shores with a shark bite wound to his shoulder. Rescue crews tell 10News they watched him for three days and then took him to their veterinarians because they noticed he wasn't using his left fin at all. After x-rays, SeaWorld San Diego vets discovered several broken bones in his front left fin and his left shoulder was snapped in half. Intense rehabilitation over the past eight weeks has him in good condition to return to the wild Tuesday. During the rescue return trip, General Hospital actress and dedicated animal advocate Carolyn Hennesy joined. Hennesy works closely with the SeaWorld San Diego rescue center and often joins them on return trips. As part of tradition, before animals are released, Hennesy said a few words to the sea lions, "Considering myself part of the SeaWorld family, I will say it was wonderful having you." All seven were released into the ocean about an hour from shore. SeaWorld San Diego tells 10News they've rescued over 600 animals in 2019 already including, 137 sea lions. 1379

SAN DIEGO (KGTV) — An autopsy report released on Trevor Heitmann, the teenager known as "McSkillet" on YouTube, is revealing details about what happened before he crashed his vehicle on Interstate 805.The report says Heitmann’s parents called the police to request a psychiatric evaluation stating, “On August 23, the decedent's parents contacted the local police department to request a psychiatric evaluation but were informed that the evaluation could not be performed as the decedent had not broken any laws."The statement means hours before Trevor Heitmann drove his car down the freeway killing two people, police were at his house.RELATED: Autopsy details mental state of McSkillet before deadly I-805 crash"Even though police are trained to identify mental health issues and mental illness issues they just can't take someone off the streets unless there is such conduct to warrant it,” said attorney Kenneth Rosenfeld.Rosenfeld, who has no connection to this case, explained law enforcement does have the ability to detain someone using the 51-50 law. It would allow someone to be involuntarily detained for a psychiatric hold for up to 72 hours.Conduct in many cases needs to be observed. Just saying someone is acting out of nature isn't always good enough.RELATED: YouTuber's family releases statement, offers condolences to crash victims“Police officers are not psychologists or psychiatrists,” he said. “They do their best, but usually when someone’s conduct or behavior is so erratic, that’s when they can factor into the idea that this is probably someone worth taking it.”Police dispatch logs show units arriving at the Heitmann home just after 8:00 a.m., Aug. 23, the morning of the crash.At 9:14 a.m., notes say, “based on statements from parents, there was no credible threat and Subject did not meet 5150 criteria. Parents advised if we went in house to ask subject if he would voluntarily go to hospital, subject may become violent. We did not encounter subject. SAN DIEGO (KGTV) - Adam Shacknai testified Monday in the wrongful death civil lawsuit filed by the family of Rebecca Zahau, whose body was found hanging at the Spreckels Mansion in Coronado.The San Diego County Medical Examiner’s office ruled Zahau’s death was a suicide. Zahau’s family believes she was murdered at the home on 1043 Ocean Blvd.Adam Shacknai, the brother of Zahau’s boyfriend Jonah, told investigators he removed Zahau’s body from the balcony about 6:45 a.m. the morning of July 13, 2011.In testimony, Shacknai said he called 911.Investigators found her body on the ground, her hands and feet bound with red rope.
