SAN DIEGO (KGTV) - A grieving mother says the flu was the main cause in the death of her healthy teenage son.Cellphone video captured a smiling Brian Finete, 19, surprising his mother with flowers for her birthday last Tuesday night at their home in Clairemont."The moment was special. He was always a happy boy with a big heart. He loved life and always wanted to make people happy," said Maria Finete.Later that night, Finete played Xbox all night with his friend at his home. Just past 4 a.m., he went to the bathroom. About two hours later, the friend woke up and went looking for him. Finete was found collapsed in the bathroom."I started screaming, said to call 911. I start CPR," said Maria.Finete was rushed to a hospital, but was declared brain dead a few days later. He was taken off life support on Saturday."We have no words to describe this. We don't understand why," said Maria.Finete, who had no known underlying conditions, tested positive for influenza B. Doctors told her the flu had spiked his blood sugar levels, and the combination of the flu and the high blood sugar levels caused him to collapse and stop breathing. "I never thought in my mind my kid would die from that," said a tearful Maria.She says her son had few symptoms. He had a lingering cough from a cold from last month. The night before he collapsed, he woke up in a sweat next to his girlfriend."When he sleeps he always sweats a little bit. He did tell her, 'I'm not feeling that good,'" said Maria.She says he didn't have a fever, took ibuprofen for a headache and seemed fine that Tuesday night. He was discovered hours later."Just so hard to see my baby gone. Don't know what to do without him," said Maria.Amid the grief: the pain of 'what ifs.' Her son decided not to get a flu shot this season, despite almost always getting it in the past."Take it. Take the flu shot if you can," said Maria. SAN DIEGO (KGTV and CNS) - Trial started Monday for the Yuma, Arizona police officer accused of raping a woman during a visit to San Diego.Jared Elkins, 34, is charged with eight felony counts of rape for the alleged incident in September 2017.The 23-year-old woman’s mother called 911 to report a crime at a home on Marlborough Street in Kensington. Elkins, who is related to the alleged victim by marriage, was staying at her home.Elkins, the alleged victim, and two other family members went to dinner then watched a movie while drinking beer and wine at the home before the alleged assault occurred, according to prior court testimony.RELATED: Arizona police officer charged with raping San Diego womanThe alleged victim testified during a preliminary hearing in April that Elkins physically forced her to participate in sex acts despite her pleas for him to stop. The two other family members were asleep in the house so small "you can hear someone breathing in the next room," the woman testified.During the alleged assault, the woman said she asked Elkins what would happen if she cried out for help. "He said, ‘I would kill you,"' the woman testified. After the incident, the woman said she found another family member in the house and they called police.At a hospital, the alleged victim's blood-alcohol level was determined to be .09 percent, according to witness testimony.Besides forcible rape, Elkins is charged with rape of an intoxicated person, forcible digital penetration, two counts each of forcible oral copulation and oral copulation of an intoxicated person, forcible sexual penetration and sexual penetration of an intoxicated person.Elkins -- a seven-year veteran of the Yuma Police Department who later resigned -- faces 14 years in prison if convicted, according to Deputy District Attorney Lisa Fox. 1834

SAN DIEGO (KGTV) - A 13-year-old Tierrasanta boy is battling for his life after family members say he was diagnosed with bacterial meningitis.A week ago Sunday, Grant Eyles started throwing up while his mother drove him and his siblings back from Los Angeles.  He quickly developed a fever, but didn't get worse until Thursday, when he lost mobility on his right side and became confused.His mother says a battery of tests pointed to bacterial meningitis, where membranes around the brain and spinal cord become inflamed, and it started with a common ailment."It was a complication essentially from a sinus infection.  The infection breached the sinus cavity and went into the brain," said family friend Vanessa Bredehoft.Over the weekend, seizures forced doctors to place Grant in a medically induced coma.  Grant remains in critical condition.County health officials say many strains of bacterial meningitis do not require an alert for person-to-person prevention, and this appears to be one of those cases.A fundraiser dubbed "Dance for Grant" is scheduled for March 3rd from 8 a.m. to 11 a.m. at Studio K Dance and Fitness.A Gofundme campaign has been set up to help with the family's expenses. 1221

SAN DIEGO (KGTV) - As police ramp up their probe, an Otay Mesa dog owner believes his dog may also have been targeted by a pepper spray-wielding mail carrier.The owner of 9-year-old Roscoe didn't want identified, but he tells 10news about two months ago - moments after their mail carrier left - Roscoe started to twitch in pain, which lasted minutes. He say Roscoe was behind a gate and not a threat to the postal carrier. Hours later, the dog's eyes were still red. The dog's owner didn't report it, but says another neighbor complained about a similar occurrence. Both of their homes are just blocks from the Galindo home on Agosto Street."Makes me feel angry and so sad that he's causing so much pain," said Alfonso Galindo.Earlier this week, he spoke to 10news about the strange stains on his patio that prompted him to check his surveillance video. He watched the unbelievable unfold: a postal carrier appearing to hold pepper spray under the mail, as he walked by a metal gate. Behind the gate is his 7-year-old rescue Pupa. At the same time, Pupa begins convulsing for minutes."Sickening. It's scary how nonchalant he is. He's done this before," said Galindo.Galindo says he found nine similar incidents in the recordings on his hard drive, about a month's worth. The Postal Service issued an apology, saying the 'appropriate action' will be taken."That left me with a question. Is this person going to be retrained and put back on my route? That's not going to cut it," said Galindo.There are also more questions about the impact on his two young children, who are constantly touching and hugging Pupa. For months, they've suffered mysterious respiratory issues, requiring frequent trips to the hospital. On Wednesday, both were diagnosed with asthma. Galindo says more tests need to be done, but doctors believe the pepper spray could be the cause, and at the minimum, is an aggravating factor."I'm scared to find out where this could take my children. SAN DIEGO (KGTV) - A 10News investigation has revealed that the California department responsible for the state’s child welfare program does not maintain data regarding all deaths of children in foster care.  The revelation is prompting calls for immediate action to child welfare services from at least one San Diego-based politician.State law requires counties to report any child death that is determined to be suspected to be the result of abuse or neglect to the California Department of Social Services.  According to the CDSS, each county in California is required to keep track of every foster child that dies while in its custody.Counties are also responsible for reporting all high profile incidents that occur in foster homes to the State Department of Social Services. High profile incidents would include incidents involving death or serious injury. But the CDSS has no master data list available regarding foster deaths and says that information is maintained at the county level.Using open records laws Team 10 collected the total number fatalities of children residing in a foster placement from all 58 counties in the state since 2010.The numbers show more than 250 kids died during that time across the state. 1290
