DEL MAR (KGTV) - One person died after being struck by an Amtrak train Sunday morning, according to the San Diego Sheriff's Department.Deputies said that a woman walked through the signal guards at 15th Street and Coast Boulevard in Del Mar around 10 a.m. She was struck by the train, which was traveling at 48 miles per hour, and she was pronounced dead at the scene, deputies said. The woman has not been identified. The Sheriff's Department is asking anyone with information about this to call 858-565-5200. 538

DETROIT, Mich. -- A 70-year-old woman is suing the Detroit Police Department for millions of dollars, accusing its officers of "violent abuse.""I never in my life had handcuffs on," said the woman, Lisa Wright. But all that changed on Nov. 20, 2019, when Wright said she and her grandson heard a commotion outside her home on Wyoming near Chippewa on Detroit's west side.Wright's grandson opened the door and they were allegedly assaulted by police officers.Thursday, at a press conference with her attorneys, Wright told reporters how she was forced to the ground and handcuffed."We didn't do anything," Wright said they tried to tell police."After they roughed her up and abused her for 30 minutes or so, they just released her," said Wright's attorney, Michael Fortner. "Not even an apology."Wright, whose husband ended up rushing her to a nearby hospital where she remained for seven days, is now suing the City of Detroit and Detroit police for million for alleged physical injuries, post-traumatic stress, humiliation, and mental anguish.It all began on Nov. 20, 2019, when Detroit police officers responded to a 911 call for help at a house three doors away from Wright's home.During that run, two police officers were shot, including officer Rasheen McClain who died from his injuries.Immediately after the shooting, as police were searching the area for the suspect, Wright and her attorneys claim officers dragged her and her grandson out of their home and caused them injuries.In the lawsuit, officers "subjected plaintiff to unlawful searches of her person and property, wrongful arrest/detention, unnecessary and violent abuse, false arrest, and other unconstitutional conduct."Click on the video to hear from Wright and her attorneys.In December, WXYZ began looking into Wright's allegations of police misconduct, and police officials said they were investigating the claims. DENVER —An Aurora, Colorado high school athlete was turned away from a Texas university recently after the school’s head baseball coach told him the school no longer recruits Colorado athletes because of past issues with drug testing. The Cherokee Trail High School student expressed interest in attending Texas Wesleyan University in the Dallas-Fort Worth area on a baseball scholarship but was rejected in an email sent to the student by Head Baseball Coach Mike Jeffcoat.Jeffcoat writes, “Thanks for the interest in our program. Unfortunately, we are not recruiting players from the state of Colorado. In the past, players have had trouble passing our drug test. We have made a decision to not take a chance on Student-athletes from your state. You can thank your liberal politicians. Best of Luck wherever you decide to play.”Although not explicitly mentioned in the email, Jeffcoat is likely referring to Colorado's recreational marijuana laws. The university said it is aware of the email and is investigating the matter. John Veilleux, a spokesperson for Texas Wesleyan University, said the letter in no way reflects TWU, its values or recruiting practices. Veilleux declined to say if previous Colorado athletes had trouble passing drug tests. The school released the following statement:We are aware of the email sent by our baseball coach, and the comments he made are in no way a reflection of Texas Wesleyan University, its values or its recruiting practices.This is a personnel matter and it is currently under investigation. DELANO, Calif. -- Police in Central California have asked prosecutors to look into filing criminal charges against two Immigration and Customs Enforcement agents involved in a deadly chase, according to the Associated Press.Authorities say Santo Garcia and Marcelina Garcia died in rural Delano in March when their SUV hit a pole and overturned as they ran from ICE agents.Police in Delano determined that ICE agents pulled over the SUV before the crash. Agents got out of their vehicle but the driver of the SUV took off.RELATED: Immigration and Customs Enforcement stop followed by deadly crash in Central Valley?Police said the SUV was speeding when the driver lost control after driving onto a dirt shoulder.Santo and Marcelina were in the country illegally but Santos was not the man agents were searching for, police said.  Police recommended that the agents be charged with a misdemeanor of providing false information to a peace officer. 973

  

Death Wish Coffee Company is issuing a recall of their nitro brew cans because of the potential growth of a deadly toxin.According to the Food and Drug Administration, the company recalled 11oz. Death Wish Nitro Cold Brew cans because the current process could lead to the growth and production of botulin.Botulism is a potentially fatal form of food poisoning and can cause symptoms like weakness, dizziness, double vision, difficult breathing and more.They have halted the production of the Nitro Cold Brew until an additional step in the manufacturing process is implemented.They have also removed cans from the comapny's online stores.The company said they will make sure everyone who bought the product on their website receives a full refund within 60 days.So far, no illnesses have been reported. 811
