EL CAJON (CNS) - The husband of a pregnant woman killed when her car struck a tree after being rear-ended by an alleged drunk driver in Ramona testified Tuesday that he saw the accident in his rear-view mirror.Christian Foderingham's testimony came as a preliminary hearing got underway for Andrew Milonis, charged with murder, DUI and gross vehicular manslaughter while intoxicated in the May 14 death of 29-year-old Jessica Foderingham, who was eight months pregnant. The victim's husband testified that his wife was following him in her own car on San Vincente Road on the way to her grandmother's house on Mother's Day when he heard a loud bang, saw an SUV swerve onto a sidewalk and saw his wife's 2016 Dodge Dart slam into a tree in the center median.RELATED: Judge raises bail to M in Ramona fatal hit and run"It felt like my heart stopped," he said. "I ran back to her car."Christian Foderingham, a U.S. Marine, said he cut off the seat belt holding his wife's lifeless body in place and pulled her out of the car. Jessica Foderingham and her unborn daughter were pronounced dead later at a hospital. The husband said the force of the accident made it look like someone had taken a sledgehammer to his wife's lower body.According to the California Highway Patrol, Milonis was heading east on San Vicente Road when his 2011 GMC Yukon pickup rear-ended the victim's car near Arena Drive about 6:45 p.m.Milonis fled following the collision, then abandoned his vehicle about a mile away and called for a Lyft driver to give him a ride to a bar on Main Street, CHP public-affairs Officer Kevin Pearlstein said. Deputies found him at the tavern about an hour later and arrested him.According to court testimony, Milonis was arrested for DUI six months before the fatal accident when he allegedly drove drunk and hit a fence. The preliminary hearing will continue Wednesday. When it's over, Judge John Thompson will decide whether enough evidence was presented to order Milonis to stand trial. The defendant faces 40 years to life in prison if convicted. 2067

During Tuesday’s Supreme Court confirmation hearing, Sen. Lindsey Graham said “good old days of segregation” in a question to nominee Amy Comey Barrett when discussing a landmark 1954 high court ruling. On Wednesday, Graham claimed the comment was made in sarcasm."If anybody was listening to who I am and what I said, you know that it was the deep sarcasm that I suggested that some legislative body would want to yearn for the good old days of segregation,” Graham said on Wednesday. “The point that I'm trying to make is there is nobody in America in the legislative arena, wanting to take us back to that dark period in American history.”During Tuesday’s questioning, Graham asked, "And one of the reasons you can say with confidence that you think Brown versus Board of Education is super precedent is that you’re not aware of any effort to go back to the good old days of segregation by a legislative body, is that correct?"Graham is an unexpectedly tight race against Democrat Jamie Harrison for his seat in South Carolina. Harrison fired back at the senator.“Lindsay Graham just called segregation ‘the good old days,’” Harrison tweeted. “The good old days for who, Senator? It’s 2020, not 1920. Act like it.”Graham responded directly to Harrison’s quip.“And for my opponent to suggest that says far more about him than me,” Graham said. “I've been a United States Senator for three terms. I represent a state with 31% of an African American population. I want to make sure that everybody in my state moves forward. And in terms of that statement it is a it blows my mind that any rational person can believe that about me.”Recent polls compiled by 538 show an essentially deadlocked race between Graham and Harrison. The landmark 9-0 Brown versus Board of Education decision ruled that segregation of schools violated the Equal Protection Clause of the 14th amendment. 1883

Editor's note: An earlier version of this story repeatedly referred to the governor as "Mike Parsons." Scripps regrets the error. Missouri Gov. Mike Parson said in a radio interview on Friday that he still supports reopening schools in the fall despite the fact that he knows children will contract the novel coronavirus when they return to the classroom.Parson made the comments in a radio interview with Marc Cox, a talk show host on 97.1 FM in St. Louis. Cox asked Parson to respond to local politicians that he felt were "overreacting" to the pandemic, particularly when it came to youth sports."These kids have got to get back to school, they're at the lower risk possible," Parson said. "And if they do get COVID-19, which they will, and they will when they go to school, they're not going to the hospitals. They're not going to sit in doctor's offices. They're going to go home, and they're going to get over it."Parson went on to say that "science" proved his point, though he did not cite and specific statistics.Watch the interview in the player below. Parson's comments about children in schools begin at about the two-minute mark. The CDC does say that children do not appear to be high risk for COVID-19, and that the vast majority of confirmed cases have appeared in adults. However, children are still able to spread the virus to friends and family members. And while children are often spared from the most serious cases of COVID-19, the CDC reports that the virus has sent dozens of children to the hospital. Currently, the agency's COVID-19 Associated Hospitalization Surveillance Network currently reports that for every 200,000 children aged 5-17, about 1 is sent to the hospital every week. The network doesn't monitor hospitals in Missouri, but if those statistics hold true, between four and five public school students in pre-K through high school would be hospitalized in the state each week. According to Education Week, there are more than 900,000 students in the state.Parson also did not mention teachers, administrators and other school staff members, all of whom could catch the virus from children or other adults in the school.Parson also argued that keeping students out of school could cause more issues than if students were to come back to class."The risk of not putting them back in school — I guarantee it will cause more problems than the virus than we'll ever think creates long-term for our state," Parson said.Dr. Anthony Fauci, the nation's top infectious disease expert, has said that he feels schools outside of virus hot sports should try and reopen for that very reason. In addition to furthering children's' social and cognitive development, with schools open, more kids will have access to nutritious meals as well as mental and physical health evaluations. However, Fauci has said schools in areas where the virus is rampant need to be careful."We should try as best as possible to keep kids in school," Fauci said. "...however, that's going to vary depending on where you are in the country." 3050
