SAN DIEGO (KGTV) - A San Diego veteran and father is defending his son's right to sit during the national anthem.Ray Everett is responding to a letter sent to Lincoln High School's principal, complaining that students on the basketball team were sitting and talking during the national anthem.The man who wrote the letter is a U.S. Air Force veteran and grandfather to a player on the opposing team. Another parent who was offended used her phone to film the students sitting."At the end of the day our students do not have to stand," said Everett. "But you will not make them feel like they did something wrong. They did not harm anyone and they did not break the law."Everett was in the U.S. Army for 15 years. He says he served his country in order to protect the rights of Americans, including the right to sit during the national anthem.Everett's brother-in-law, Antoine Jarvis, says while he was offended by the letter he respects everyone's right to their own opinion. "I think that the biggest challenge in voicing your opinion is when you're close-minded to other's opinions," said Jarvis. "When you're close-minded to their beliefs."Jarvis says he no longer stands during the national anthem after learning more about its history. He only asks that others respect his right to do so.The principal of Lincoln High School, a veteran himself, has been responsive to complaints and plans to sit down with the veteran who wrote the letter about the student's actions.On Thursday the San Diego Unified School District sent a statement to 10News:Public school districts do not have the authority to require students to observe patriotic or religious rituals in the classroom or at school functions. We believe in our students right to free-speech, but also encourage students to be respectful in the way they choose to exercise their rights.School Administration is reaching out to the students involved and taking the opportunity to use this as a teachable moment. 1986

SAN DIEGO (KGTV) -- A winter storm warning was issued for San Diego County’s mountains as a cold storm hit the region Monday..The warning is in place from 8 a.m. Monday through 4 a.m. Tuesday, according to the National Weather Service.“The agency says heavy snow and strong winds are expected. Plan on difficult travel conditions, including during the evening commute on Monday. Tree branches could fall as well,” forecasters said.Total snow accumulations of two to six inches are expected with localized amounts of 12 to 18 inches. The heaviest snow is expected to impact areas above 5,500 feet, however, some snow is expected down to 4,500 feet.Accompanying the snow are heavy winds of 20 to 40 miles per hour.RELATED: Check today's forecast in your area“If you must travel, keep an extra flashlight, food and water in your vehicle in case of an emergency,” the National Weather Service advised.A high surf advisory also takes the place of a beach hazards statement as the storm approaches. The advisory is in effect from 6 a.m. Sunday through 10 a.m. Wednesday for San Diego County coastal areas.Surf begins to build Sunday, peaking Monday afternoon through Tuesday, the agency says. Waves and surf of three to six feet are expected Sunday, increasing to four to seven feet with sets to eight feet by Monday.Accompanying the high surf is a slight chance of isolated thunderstorms and lighting at the beaches Monday, the National Weather Service said.Coastal areas could also see nearly an inch of rain as the storm passes. 1533

SAN DIEGO (KGTV) - A woman was sexually assaulted by the driver of a vehicle she confused for the ride she had requested in Hillcrest, San Diego Police said Friday.The woman left a business on University Ave. Wednesday night about 11 p.m. and entered the vehicle waiting in the roadway, according to investigators.A short time later, the male driver sexually assaulted the woman.Detectives say the woman was released and police were called.The victim described the attacker as a Hispanic man, about 40 years old, with a receding hair line and a mustache. San Diego Police released a composite sketch of the man. The vehicle was a dark colored 4-door sedan.Police did not release details about the location of the assault or whether the driver worked for a rideshare company.Anyone with information is asked to call the SDPD Sex Crimes Unit Detective J. SAN DIEGO (KGTV) - A San Diego woman who was shot at the Route 91 music festival in Las Vegas is making great strides in her recovery.Tina Frost and her boyfriend were with eight friends when Stephen Paddock opened fire. Frost was the only one of her group who was shot. The bullet went into her eye.Her family says the recovery has been difficult but that she continues to power forward with her therapies.Frost’s mother posted an update on the GoFundMe page indicating Frost has walked without assistance, thrown a ball, baked cookies, and painted an eye patch for herself.Amy Klinger, a close family friend, says Frost's strength and resilience is no surprise."She is not going to let anything get in her way of getting back to her normal, happy, and healthy life," said Klinger.  "It was so amazing, I walked into the room and she was talking with her physical therapist and because her sentences were so clear, I did forget for a minute she had not been speaking."A lifelong soccer player, Frost has even been able to kick a soccer ball to her dad in the hallway."The fact that they did say at the very beginning, let's see what happens in a year, and it's only less than five weeks out and she's walking and she's talking, she's just, the progress has been amazing and is a testament to who she is," said Klinger.Klinger believes the worldwide support and power of positivity has been a factor in the healing, for both Frost and her family."Just knowing there's this enormous community, Team Tina, that's out there behind the family, it keeps their spirits up and keeps them positive because this is a lot to do deal with," said Klinger.Frost has a big surgery in the upcoming weeks where doctors will begin facial reconstruction. 1749

  

SAN DIEGO (KGTV) -- An investigation into the death of 19-year-old SDSU student Dylan Hernandez, who died after falling from his bunk bed after a night of partying, has been completed, University Police said Thursday.According to a case submitted to the District Attorney’s Office, detectives concluded that there was no basis to prove manslaughter charges because “Hernandez’s death was an accident, and there was no witness or autopsy evidence supporting the existence of any criminal activity that was causally linked to Hernandez’s death."“There was no basis to prove hazing charges because there were no injuries upon Hernandez’s body that appeared consistent with hazing, and no evidence of student group activities likely to cause serious bodily injury or death, which is statutorily required to prove hazing," the department continued.Now that the criminal investigation has been completed, the university will conduct an administrative review of the circumstances.RELATED:Autopsy report of SDSU student who died after fall from bed releasedCause determined after San Diego State University student diesSan Diego State suspends 14 fraternities after student is hospitalizedUniversity Police also provided its final report to the Center for Student Rights and Responsibilities as well as Student Life & Leadership for a review of the alleged misconduct.“We continue to send our deepest sympathies to the Hernandez family and to others who cared for Dylan Hernandez,” SDSU Police Chief Josh Mays said. “We have taken great care in our investigation, spending months interviewing witnesses and analyzing information to fully understand what took place during the evening.”In January, an autopsy report revealed that Hernandez died of blunt force injuries to his head, ruling his death an accident.University Police say Hernandez received the injuries after reportedly falling out off his bunk bed. He was found unresponsive later that morning and taken to the hospital, where he later died.At the time of the autopsy, a toxicology report also said elevated alcohol levels of 0.06 percent and cannabinoids were found in his system.Following the news of the completed investigation, the university released the following letter to students: 2256
