A man in Colorado who was sentenced to more than 300 years in prison for child sex crimes in 2015, is now walking free after his conviction was thrown out on a technicality.Michael Tracy McFadden, 46, was convicted for 19 counts of sexual offenses, including a habitual sex offender against children, according to KKCO. McFadden was released from the Arkansas Valley Correctional Facility on Tuesday.In June, the Colorado Court of Appeals found that McFadden's right to a speedy trial was violated when the judge in the case granted a continuance. When the court ruled that his statutes were violated, they threw out his conviction."Frankly I'm completely appalled with the decision," District Attorney Dan Rubenstein told KREX. "I find it offensive that our justice system would allow this to happen."Rubenstein explained to KREX that speedy trials are broken down into two categories: constitutional and statual.Constitutional speedy trials have no timeframe, depending on the case. However, in Colorado, statutory speedy right trials require a time frame of six months.Rubinstein told reporters, “Because the error here was that he shouldn’t have been tried longer than six months from the last time he waived speedy trial, there was no remedy for that, and therefore there is no ability to retry him." "The justice system completely failed in this situation. A black bear that traveled across several states and garnered a large social media following has been rescued and transported to safety by the Missouri Department of Conservation.According to department officials, the bear traveled through Wisconsin, Illinois, and Missouri before finding himself trapped between two highways in Wentzville, Missouri.“The bear found itself in a tough spot, stuck by several major roadways,” said MDC State Furbearer Biologist Laura Conlee. “Due to the proximity to the roadways, coupled with the busy travel day, MDC staff determined the bear had little chance of safely leaving the area on its own. In the interest of public safety and the bear’s safety, MDC staff made the decision to immobilize the bear and transport it to a nearby area of suitable bear habitat outside this urban corridor.”Bruno was sedated and then was released unharmed when he awoke, MDC staff said.Social media users had dubbed the black bear Bruno after he was first spotted back in June, officials said in the press release.In a press release, the Illinois Department of Natural Resources said Bruno likely traveled the long distance in search of a mate. 1173

A female shooter and a male employee were shot and killed early Monday at a distribution plant in Texas, a Missouri City spokeswoman said.Officers responded to reports of an active shooter at the Ben E. Keith food distribution plant, Missouri City Police Capt. Paul Poulton said.Another employee was also shot and was transported to a hospital, Poulton said.Officers are still in the process of conducting secondary searches of the facility. A federal judge has ruled in favor of a group of adult entertainers who claimed their rights were violated when police raided San Diego strip club where they worked. An attorney for the women said the ruling essentially finds that the city's municipal code, which allows for inspections of police regulated businesses, violated the dancer's First Amendment rights. But the judge stopped short of ruling on the claim that the city also violated the Fourth Amendment on unreasonable searches and seizures. The San Diego City Attorney's office told 10News it's reviewing the ruling at this time and had no further comment. The dancers are also seeking damages, which their attorney says will be decided when the matter goes to trial, but a date hasn't been set.  797

A father and mother in Las Vegas were arrested on Feb. 28 on charges including murder, child abuse/neglect, and animal cruelty. Police were called to the couple's apartment on Feb. 25 after getting reports about possible abuse or neglect. Medical workers told police dispatchers that they were transporting a 5-month-old child to the hospital and the baby appeared to be malnourished.The baby died after being taken to the hospital.Detectives from the Las Vegas Metropolitan Police Department investigated the case, and three days later arrested 29-year-old Anthony Oceja and 24-year-old Loreana Martinez. Oceja and Martinez also had two other children who were taken into protective custody and are being evaluated by medical personnel for potential health concerns. There were also three dogs in the residence that appeared to be severely malnourished. They were turned over to Clark County Animal Control.
