SAN DIEGO (KGTV) — One man is dead and another person was injured after two separate shootings just miles apart early Saturday.The first shooting occurred in the Lincoln Park area before 3:30 a.m. near Euclid and Imperial avenues. A suspect wearing dark clothing reportedly shot at a group of transients, according to San Diego Police.One person was hit by debris from the gunshot and taken to the hospital as a precaution.MAP: Track crime happening in your neighborhoodA second shooting occurred about two miles away, an officer patrolling Mountain View heard gunshots around the same time. He arrived to find a man lying on the ground on South 45th Street, near Willy Henderson Sports Complex.The Hispanic man in his 20s to 30s was shot multiple times and died at the scene, police said. His identity has not been released.Police are searching for a white Volkswagon seen in the area by witnesses following the shooting. SAN DIEGO (KGTV) - On this holiday, some extra thanks for a Clairemont family, months after an expectant mother was placed on a ventilator from COVID-19."This Thanksgiving, I’m thankful to be here with my family," said Ashley Duque.That family includes Ashley, her husband Diego, their daughter Anna, 3, and the newest addition, three-month-old Lucas."He came out our miracle baby," said Ashley.The miracle emerged from a pandemic. In March, 17 weeks into her pregnancy, Ashley was hospitalized with coronavirus, before being placed on a ventilator for five days."It was very, very scary," said Ashley.She spoke to ABC 10News from her hospital bed while recovering. Ashley was discharged after more than two weeks, but she would be back for nine different surgeries from complications from the COVID-19 treatment.Most of the surgeries involved removing scar tissue in her throat caused by her time on the ventilator.Then in August, Ashley was back in the hospital, as she went into labor three weeks early."I was nervous and scared," said Ashley.Despite her COVID battle and her other health issues, Lucas Duque was born August 25, weighing 6 pounds, 6 ounces. He was healthy."We’re just very blessed that nothing happened to him," said Ashley.On this Thanksgiving holiday, there is a mix of emotions. Ashley is still having issues with the scar tissue, but Ashley and Diego are feeling an overwhelming feeling of gratitude."In a flip of coin, anything can happen. SAN DIEGO (KGTV) - On Monday, concerns were raised and the release of police body camera video was requested after San Diego police officers reportedly shot a man on Sunday after they arrested him. Police say he managed to get out of his handcuffs and accessed a police gun after he was left in a patrol vehicle.On Monday, SDPD Lt. Andra Brown told 10News that officers were called to the Westgate Hotel on Sunday night for a report of a man who threatened security workers. After officers reportedly took in the 25-year-old Hispanic man, they say he slipped out of his cuffs while in the patrol unit.“It does happen but you know there's a tricky line to walk between having the handcuffs too tight where they can't come off but that also means that they can cause damage to a person that's under arrest and that's not our goal,” said Lt. Brown.She added that the suspect then reportedly broke a divider in the vehicle and grabbed a backup gun from an officer's gear bag that was in another area of the vehicle, all while he was alone in the vehicle and officers were away to process paperwork. “They were in the area of the vehicle. It's not like they were hundreds of yards away. They do maintain visual contact and there are other officers that are in the area,” she told ABC10 News.Once officers noticed, police say he fired a least one round after refusing their commands to drop the gun. They report that they fired back and struck him in the torso, but they say he still got out of the car with the gun and ignored their commands. Officers say a police canine then took him down.Community activist Tasha Williamson said Monday that the suspect should never have been left alone. “It’s not safe for the individual who has been arrested and not safe for the officers who are leaving them in the car with weapons,” she added.She's been demanding the release of body camera video within 24 hours of the shooting, like police did last week after rounds were fired with a robbery suspect.A police spokesperson said Monday that the release of the video will take longer in this case but the department is working hard to get it out and hopes to have it released within a couple of days.“[That’s] not sufficient and what that's telling the public is that when there’s no public outcry, they'll take their time at releasing the video,” added Williamson.The suspect was taken to the hospital with non-life-threatening injuries.SDPD is investigating the officer-involved shooting. SDPD says once its investigation is completed, it will be reviewed by the San Diego County District Attorney’s Office to determine if the officers bear any criminal liability for their actions. Police say the Internal Affairs Unit will conduct an investigation to determine if there were any policy violations, and the Shooting Review Board will evaluate the tactics used by the officers before the Community Review Board on Police Practices reviews the incident. With that, the questions and concerns about what that means for drivers out on the roads.“I think we will see an increase in DUI marijuana’s,” said Officer John Perdue, a San Diego Police officer in the traffic division.Perdue is an expert at DUI and drug recognition. Since November 8, 2016, when California voters approved Prop. 64, or the adult use of marijuana act, he’s been hearing the same thing when he comes across drivers he suspects are driving high.“Their first reaction is one of two, either A. ‘I have a medical marijuana card’, or B. ‘marijuana is legal.’ And I have to remind them, so is alcohol, but you still can’t drive under the influence of it,” Perdue said.How exactly will police be able to tell if someone is driving high?One tool that officers will use to help is the Drager Drugtest 5000, a presumptive drug screening test that can detect seven types of drugs in a person’s system.Like an alcohol breathalyzer, Perdue said, “the person has every right to refuse this.” But unlike alcohol, it doesn’t have a percent limit.If the Drager reads positive, Perdue said, “it doesn’t necessarily mean they’re impaired or under the influence, it just says that chemical or drug is in their body.”  So to be arrested for DUI, it’s still up to the officer to decide if the driver shows impairment.But that can be tough. Look at the Drager as an extra tool that’s used along with field sobriety tests, what an officer smells, sees or finds in the car, to formulate that officer’s opinion of whether a driver is high.“The hardest thing will be, because there is no per se limit right now, the officers are really going to have to be aware of the signs and symptoms,” Perdue said. 1808
