SAN DIEGO (KGTV) — The Ninth Circuit Court of Appeals rejected an emergency injunction for a Chula Vista church to hold Christmas Day services indoors.South Bay United Pentecostal Church, which has had legal challenges denied over California's COVID-19 restrictions against places of worship holding indoor services, requested the injunction while its appeals case works its way through the courts.Thursday, the Ninth Circuit denied the request but the case will see a full hearing on the merits on January 15, 2021.RELATED: Los Angeles County change on indoor religious services could impact South Bay lawsuit"We are extremely disappointed that the Ninth Circuit has yanked the joy of Christmas away from South Bay United Pentecostal Church and its congregants," Charles LiMandri, one of the attorneys representing the church, said in a statement.LiMandri said they will request that the U.S. Supreme Court intervene in the case. The country's highest court has already ruled in favor of religious institutions in a New York case, prompting Los Angeles County to amend their public health order to allow for indoor religious services under certain modifications.“By refusing to allow South Bay to participate in the worldwide celebration of the birth of Jesus Christ, the court is continuing to perpetuate the violations of religious liberty that Governor Newsom has been executing for nine months under the guise of COVID-19 prevention,” said LiMandri.California's regional stay-at-home order prohibits indoor operations across several industries, including churches and places of religion.South Bay United Pentecostal Church has argued against the state's restrictions since May. Senior Pastor Arthur Hodges told ABC 10News that they're prepared to go above and beyond current coronavirus-related precautions once they reopen. 1837

SAN DIEGO (KGTV) — Teenage cancer survivors from Rady Chidlren's Hospital celebrated an "unforgettable" event.The annual Unforgettable Prom brought teens battling cancer out for a night of dancing and celebration — a night many of the teens miss at school while they continue to fight illness. Now in its 13th year, the dance has helped teens take a moment to celebrate that special night in every teenager's life. And everything is covered: From dresses and tuxedos to entertainment, food, and decor, thanks to volunteers and the Friends of Scott Foundation, a local non-profit that works to provide emotional and financial support for children with cancer and their families.This year's theme, Avengers "Age of Heroes," honors Ryan Wilcox, a former patient and Unforgettable Prom King, who lost hist battle with cancer. "Unforgettable Prom" was started by Carmen Delgadillo, founder of the Friends of Scott Foundation. Degadillo lost her teenage son, Scott, to Acute Lymphostic Leukemia. From that loss, Delgadillo started the foundation to help other families in need of support during their own battles with cancer. SAN DIEGO (KGTV) -- The non-profit organization Border Angels hosted its 32nd-anniversary dinner on Saturday. The dinner raises money to help continue providing the services they offer to immigrants in the community, including water drops for border crossers, legal services, and shelter. The migrant caravan and the upcoming election were hot topics of conversation during the dinner. This year the organization honorees were Margarita Zavala, Kirsten Zittlau and Jacqueline Arellano. Zavala and Zittlau are attorneys. Arellano is the water drop coordinator for Border Angels. Border Angels' founder Enrique Morones tells 10News that he decided to honor women this year. He also encouraged everyone to go out and vote on November 6th saying the president is sending the wrong message about immigrants. Guests at the event also reacted to President Donald Trump deploying the military to the border. At a campaign event, the president was not backing down, saying migrants need to come to the U.S. legally.   1051

  

SAN DIEGO (KGTV) -- The man accused in the death of three migrants found in the trunk of a car in August was arraigned on related charges in San Diego court Tuesday. According to court documents, Neil Edwin Valera, a U.S. citizen who lives in Mexico, was arraigned in federal court in connection with the deaths of three Chinese migrants, including a mother and her 15-year-old son. The third person in the trunk was a female. None of the victims have been identified. Authorities say Valera is a truck driver from El Paso, Texas. He was arrested at a downtown bus station Saturday. RELATED: 3 bodies found in trunk of car parked in Bay TerracesValera was charged with encouraging aliens to enter resulting in death and bringing aliens without presentation for financial gain. Police discovered the bodies of the three migrants in the trunk of a 1999 silver BMW on August 11 after being called to the 2100 block of Jamie Avenue by a person reporting a foul odor. “The wind would start to blow a little bit, you can smell like, a really, like, it’s hard to explain. I’ve never smelled that before but I thought, well, maybe it was like trash or, you know, like that kind of smell but a very more pungent odor than that," a neighbor told 10News.Video recordings reportedly showed the same car crossing into the U.S. from Mexico on August 9. “These tragic cases are grim reminders that attempting to cross into the United States illegally in the trunk of a car – and putting your faith, hope and future in the hands of smugglers – is extremely dangerous,” said U.S. Attorney Robert Brewer. 1595

  

SAN DIEGO (KGTV) - The family of a man reported missing from a Spring Valley care facility two weeks ago told 10News Friday he was found safe in North Park.Aldofo Otanez, who has schizophrenia, lived at Mi Casa es Su Casa. His family said he was planning to visit his brother on February 16 but never arrived.Otanez’ brother said the family passed out flyers and posted pictures on social media.RELATED: Schizophrenic man still missing after two weeksOn Friday, a 10News viewer called the family to say Otanez had been sleeping on the sidewalk on El Cajon Blvd. in North Park.People at Dave’s Flower Box had given him a bottle of water, money to buy coffee, and a burrito.The family says he was hungry but is doing well. 738
