SAN DIEGO (KGTV) — An hours-long standoff between San Diego Police and a burglary suspect ended late Thursday night in the Marina area.The standoff, which started at about 4:30 p.m., occurred in the area of West Harbor Dr., between Kettner Blvd. and Pacific Highway. Police called Emergency Negotiation Team and SWAT officers, and a Psychiatric Emergency Response Team to the scene. Shortly after 11 p.m., SDPD said the San Diego Police suspect had been taken into custody.No further information was immediately available. 530

SAN DIEGO (KGTV) - An inmate at R.J. Donovan State Prison has filed a lawsuit against the California Department of Corrections and Rehabilitation.Anand Jon Alexander filed the complaint on Monday, alleging prison officials failed to keep him safe and to provide adequate medical care after he was assaulted behind bars.In the complaint, Alexander claims he was attacked by another inmate while waiting to make a phone call on May 18, 2019. He was allegedly stabbed multiple times in the face and kicked on the ground.After the attack he sustained “five facial fractures, a lower orbital floor blowout, sinus and nasal fractures, a deviated septum, a 50% abrasion to the right cornea, long term impairment of his vision and respiration, serious nerve damage, PTSD” according to the complaint.Alexander is 12 years in to a 59 year sentence after he was convicted of rape in 2008.An up and coming fashion designer, Alexander had been featured on “America’s Next Top Model” and was listed in Newsweek’s “Who’s Next in 2007.”But his career was put on hold after being accused by multiple women of sexual assault.Many of the charges were dropped, but he was convicted on one count of rape and 15 other counts following a trial in Los Angeles. The jury found him not guilty or were hung on several other counts.Alexander has maintained his innocence. In the complaint, his lawyer writes he “has acknowledged the existence of blurred lines between his personal and professional relationships…Nevertheless, he holds steadfast to his innocence.”The American Justice Alliance, a group which seeks to free prisoners who have been wrongfully convicted, submitted an amicus brief to the Federal Central District Court.In it, they wrote Alexander “was targeted by a collusion of disgruntled business associates and some former girlfriends, who have admitted they were out to “bring him down,” and “get revenge,” seeking notoriety and monetary benefits. He was then subject to a prosecution and trial riddled with extraordinary police misconduct.”The lawsuit names CDCR as well as Marcus Pollard, the Warden of R.J. Donovan Correctional Facility and Daniel Paramo, the former Warden.It alleges prison officials failed to protect Alexander from harm and after he was injured gave “deliberate indifference to Mr. Alexander’s medical condition.”They are seeking unspecified monetary damages and a jury trial.So far, no criminal charges have been filed against the assailant. 10News reached out to CDCR for comment but had not heard back before the story was published. 2557

SAN DIEGO (KGTV) — A school district superintendent and a Native American reservation leader in North County are speaking out against the proposed placement of a sexually violent predator. On Thursday, there were strong reactions from those who are close to North County's Pauma Valley home where sexually violent predator Joshua Cooley could soon be placed. “When people like this are placed by our borders, it's very concerning,” Temet Aguilar, the Chairman of the Pauma Band of Mission Indians, said Thursday. Aguilar is encouraging the hundreds of families on and near the reservation to speak out against the placement of 40-year-old Cooley, whose victims were 12-years-old.“They think this is an area that's rural and there's nobody out here but actually it's more dangerous. Predators can hide out here. We have a tremendous amount of agriculture. We have rural lands,” he added.Valley Center-Pauma Unified School District Superintendent Ron McCowan told ABC10 News they'll write letters if they have to to make sure they're voices on the matter is heard. “We'll write the letters if we have to. We'll show up at the court hearing if we have to," McCowan said. “We'll make every effort we can. We'll work alongside our local officials and make sure that our voice for our community is heard and make sure they understand the risk that they're putting our young children in.”This Tuesday, DA Summer Stephan sent a letter to the Department of State Hospitals, urging the Department to find a different place for Cooley, who's from Northern California, not San Diego. He has no local connections.It's unclear why the Department is seeking his housing in San Diego.Next month, a Humboldt County judge will consider a request from the Department to place him in Pauma.If granted, it would mark the first time that such a predator from outside San Diego would be placed in our county.DA Stephan has called the move reckless and irresponsible. She said that in July, a San Diego judge struck down a request to place 75-year-old sexually violent predator Joseph Bocklett in the same Pauma home.According to an ABC station in Northern California, Cooley’s been denied placement in at least four different areas in and near Humboldt.The Department of State Hospitals will not confirm any information about Cooley, citing privacy concerns. A Humboldt County court official called ABC10 News on Thursday to say the Court would not comment.On Oct. 9, at 8:30 a.m., a hearing on Cooley's placement will be available for viewing at https://www.humboldt.courts.ca.gov/.Those interested in submitting a public comment for the hearing can do so between Sept. 15-23. SAN DIEGO (KGTV) - Almost a dozen gyms retained a lawyer, preparing for a fight to stay open against San Diego County's health orders.Monday Governor Gavin Newsom announced a long list of businesses needed to close down again, due to a spike in coronavirus cases.That list includes:places of worship restaurants wineries movie theatersfamily entertainment centerszoos museums cardroomsfitness centerssalonsmalls.Metroflex Gym in Oceanside has been open since May despite the health orders. Owner Lou Uridel said this renewed push to close puts them in a corner and if they close, they won't reopen."We have only one plan, that's to stay open, we don't have the option to keep closing opening, closing opening." Uridel said they've been denied a dozen times for loans."I feel like it would be a betrayal of my faith and a betrayal of my dreams to give up on that and just close down," he said.Uridel said they're a place many find comfort, "we're continuing to get a lot of new gym members, we have stopped signing up people as of today." Uridel said they had to stop to ensure their members have access to the gym with the limited capacity imposed by the county's health orders.San Diego County announced this week they were putting together strike teams to ensure businesses in the list above shut down."It definitely doesn't scare us," he said.He said the laywer they hired found a loophole where the state health order was filed by the health department, and if they are not violating any health regulations they cannot be closed down.San Diego County Public Health Officer Wilma Wooten said they were just following the state's recommendations and those businesses need to shut down to protect the community and bring down coronavirus case numbers.Uridel said they are doing everything possible to create a healthy gym environment.He said they brought in a biologist to measure their air flow with their bay doors open and about a half dozen industrial fans in place.Uridel said their air flow rated 9.1/10.He said every gym member washes their hands on the way in and out, and wipe down their equipment. He said social distancing is in place and there is more cleaning each hour.He said if the county comes after them, "all we can really do is take it in the chin, whatever they're going to throw at us. If they're going to fine us, we'll fight it in court."When asked if he was worried about his staff or members getting sick, he said "it's always a concern, but it's a concern at any business, even the ones that remain open. If you check around, a lot of cases have come out of Home Depot, and grocery stores and there hasn't been one blink to close any of those down."He says his gym is a place of healing, helping military members fight PTSD and others work through the trauma of the coronavirus.Uridel said one man who lost his wife to suicide and faced other challenges is a regular at his gym. "When he told me this is what saved his life again," Uridel said emotionally, "it just made me realize that's exactly what we have to do."He wants to keep the doors open to provide that haven during this hard time. 3129
