Californians have voted to carve out specific gig workers from a state employment law about who is considered an employee and eligible for benefits.That means people who drive for Uber and Lyft will remain classified as independent contractors and will not be eligible for employee benefits.A California Supreme Court decision in 2018 created a strict test to decide whether a self-employed worker, like gig workers, should be considered employees.In response to the ruling, lawmakers amended Assembly Bill 5 in 2019 to add additional professions where services could be provided by independent contractors, and would not necessarily be employees. However, no changes were made for app-based companies like Lyft, Uber and DoorDash.The state law made app-based drivers employees, and would pay them for their time both while they are driving and they are waiting for a new ride, and offer employee benefits like paid sick leave and workers compensation for one-the-job injuries, the Los Angeles Times explains.Since the proposition has passed, drivers will remain categorized as independent contractors, although the proposition includes wording to require companies to provide an hourly wage for time spent driving equal to 120% of minimum wage. The language also gives drivers a stipend for purchasing health insurance coverage when their driving time averages at least 15 hours a week. However, only hours spent driving counts toward that total, not the time spent waiting between trips.Proposition 22 was launched and partially funded by Lyft and Uber. CAMP PENDLETON (KGTV) - A training accident on Camp Pendleton that left several Marines with severe burns may have been caused by an exposed gas line, a report from the Washington Post indicated Friday.Camp Pendleton officials said Marines from 1st Marine Division were conducting "scheduled battalion training" on land when a vehicle caught fire September 12.The 15 Marines were taken to various area hospitals.The vehicle involved was identified as an Assault Amphibious Vehicle (AAV) used to transport Marines from sea to land. The AAV performed a maneuver which caused it to run over a gas line, sever it with its tire treads, and ignite the line, the Washington Post reported.The official report on the fire has not yet been released by the Marine Corps. 777
CALIPATRIA, Calif. (KGTV) — Six prison guards were injured during an attack by an inmate this week, leading to the use of deadly force.Calipatria State Prison inmate Douglas Compton refused to leave an "out-of-bounds" area in the prison's yard on Thursday after three officers ordered him to do so, according to the state's Department of Correction and Rehabilitation (CDCR).Compton then stabbed one of the officers in the head and face, CDCR says. Responding officers used batons, pepper spray, and other use-of-force options to try and subdue Compton.During the struggle, Compton punched another two officers.An officer in an observation tower discharged one lethal round from a rifle to stop the attack. No one was injured by the use of lethal force, CDCR says.Six officers were injured and taken to an outside hospital for treatment and released.Compton was injured and treated, before being transferred to another prison.CDCR added that two inmate-made weapons were recovered at the scene. CDCR investigators are investigating the weapons as well as the use of deadly force.Compton was sentenced to 112 years to life in prison following a 2013 conviction of second-degree murder, voluntary manslaughter with the use of a firearm and possession of a firearm by an ex-felon with the use of an altered ID. 1315
