SAN DIEGO (KGTV) - A San Diego mother of four said she was fired from her job of nine years because she needed to keep working from home during the pandemic.According to a lawsuit filed by Taneasha Newsome, “Knowing Ms. Newsome required a work accommodation or a medical leave to care for a disabled child during the global pandemic that gripped the country in early 2020, Axos failed to attempt accommodating Ms. Newsome’s obvious need. Instead, Axos terminated her in order to rid itself of an employee who required accommodation.”The federal complaint filed last week against San Diego-based Axos Bank alleges associational disability discrimination and wrongful termination, failure to provide reasonable accommodations, and racial discrimination, among other things.Newsome said it was challenging before the pandemic to balance work and home obligations. She explained one of her children has attention deficit hyperactivity disorder and another is autistic.Newsome said when the stay at home order went into effect, schools closed, and she started working from home.“I was told basically, I’m supposed to use my breaks legally and my lunch to do what I need to do for the kids, which anyone who has kids knows that’s impossible,” she said. “You can’t put them on a schedule when they’re hungry or need to use the bathroom.”According to her lawsuit, in late March 2020, Axos began using a computer program to monitor its remote workforce.The lawsuit claims Axos knew the program “was unable to track certain aspects of employees’ workdays, which caused the system to erroneously underreport working hours for Ms. Newsome and others.” It stated Axos used the inaccurate reports, “to place Ms. Newsome and other employees on a performance improvement plan (PIP) on April 24, 2020 for lack of productivity, even though the reports did not accurately measure their full productivity.”“During that time, they say, ‘Hey the software isn’t properly tracking us, it’s not tracking our work,’” said Newsome’s attorney Alreen Haeggquist. “They ask questions to their managers of how does it track productive time and unproductive time. No answers are given.”According to the lawsuit, Axos demanded all teleworking employees return to full-time, in-office work on May 1, 2020. The lawsuit said employees that required a further teleworking arrangement were instructed to submit a formal request form that detailed their need for continued teleworking.“When Taneasha says, ‘Hey I need an accommodation. I need to keep working from home because of my children with special needs and what’s going on with them at home.’ They fire her based on those reports from over a month earlier,” Haeggquist said.According to the lawsuit, “Axos fired Ms. Newsome during a two-minute Zoom meeting with HR, claiming it was based on her lack of ‘productivity.’ Axos Bank fired Ms. Newsome, but not because of her performance. After interfering with Ms. Newsome’s right to take leave to care for her disabled family members, and otherwise failing to accommodate that need, Axos Bank fired Ms. Newsome because, as the mother of two disabled children, she needed to remain working from home, and the company thought she was too likely to be ‘distracted’ by the childcare obligations of her disabled children.”In a statement, a spokesperson for Axos Bank responded to the allegations writing, “Like most public companies, it is our policy not to comment on the specifics of pending litigation. With respect to this complaint, we can say the allegations are false and omit material facts, and we are confident we will prevail once these material facts are presented to the appropriate forum.”Newsome said things have been difficult since she lost her job.“We had to give up our apartment,” she said. “We now live with family, which I’ve never had to do. When I left home at 18, I stayed gone. So, this is my first time coming back home. It’s an adjustment for the kids, they’ve never not had their own.”Newsome’s lawsuit also alleges racial discrimination. It claims, “Axos discriminated against Ms. Newsome in compensation and in terms, conditions, and privileges of employment because of Ms. Newsome’s race. Based on information and belief, Axos paid Ms. Newsome less than her white counterparts, and the differential was not based on a bona fide factor, but rather, it was based on race.”As of this writing, the company has not yet responded to the allegations in court filings. 4461

SAN DIEGO (KGTV) — A San Diego student has been named among those killed when an international flight bound for Ukraine crashed in Iran.Sara Saadat was a student at Alliant International University in Scripps Ranch. She was a passenger on Ukraine International Airlines Flight PS752, according to the school.In a statement to 10News, Saadat was visiting family in Iran and was heading back to San Diego to begin the spring 2020 semester. She was enrolled in the university's clinical psychology program."We extend our deepest sympathies to family and friends of Alliant Student Sara Saadat. Sara was a passenger on Ukraine International Airlines Flight PS752 that crashed in Iran. It appears that Sara was visiting family in Iran and was on her way back to San Diego to begin our spring 2020 term in our PsyD in Clinical Psychology program," the school's statement read. SAN DIEGO (KGTV) - A two-year-old girl found strapped to the chest of an immigrant teenager is in the custody of Immigrations and Customs Enforcement officials, the U.S. Border Patrol said Monday.The girl was part of a group of six undocumented immigrants found traveling near Campo Nov. 27, officials said.The 17-year-old boy who was carrying the girl said she had been with her mother the previous night, but the mother became tired and asked the teen to hold her daughter. When the group separated, he could not locate the mother, he told Border Patrol officials.Authorities are trying to reunite the girl with her mother.The U.S. Border Patrol said it maintains a high level of vigilance in border zones to prevent the smuggling of humans, drugs, and other contraband. 780

SAN DIEGO (KGTV) - A University City mother is looking for answers after her daughter was greeted with pornographic images on two consecutive days of remote learning.Chelsea Butler says it happened during her 14-year-old daugther's remote Physical Education class last Thursday morning. Her daughter is a freshman at University City High School."When she logged in, the screen was filled with pornography. It was being streamed during her Zoom call," said Butler.Butler says her stunned daughter quickly logged off and told her about it."Made her extremely uncomfortable. She was really upset by it," said Butler.Butler emailed the school and got a call back from the assistant principal, along with an email sent by the school. Both confirmed the Zoom bomb and an investigation by school police and the administration."The fact my daughter was exposed to it against her will is very upsetting," said Butler.The next day, her daughter tried to log in -- same time, same class -- only to be greeted by more pornographic images. This time, there were dozens of extra people in the room."They apparently got in by stealing students' screen names and changing them by one letter in order to access the classroom. Her screen name was one of the ones used. That's why she was even more upset," said Butler.The incidents is putting remote learning security under the microscope. Butler says right now, her daughter logs onto a password protected web portal to get her Zoom meeting ID.Her daughter enters a virtual waiting room, before the teacher invites her into the class. Butler isn't sure how, but says the precautions clearly must be enhanced.Across the country, numerous news reports have detailed similar Zoom bombs during remote learning involving pornography. Butler says her daughter won't be going back to that class until changes are made. SAN DIEGO (KGTV) - After 14 months on the job, Gordon Walker, the CEO of the Regional Task Force on the Homeless is taking a six month leave to help open a temple for the Church of Jesus Christ of Latter-day Saints in Rome, Italy.Walker was hired in June of 2017 after successfully reducing the homeless population in Utah by 91%.“We can do the exact same thing here,” he told 10News. “The chronic homeless problem here in San Diego is not much larger that it was in Utah.”He took over the RTFH just after it had been consolidated with several other agencies.One of his first big projects was overhauling an outdated software system that is used by many different agencies that interact with the homeless.Expected to be launched in December, he says the new program will allow for easier and more streamlined data collection.It’s an important change because they can’t fight a problem when they don’t know exactly what it consists of.“We had a hard time answering some very basic questions, like ‘what do we actually need?’ “For this purpose, one of the task force’s yearly projects is executing a ‘point-in-time’ count of homeless people across the county.When the numbers were released this year, however, they were met with criticism.“You cant just not count 1000 to 2000 people just because you haven’t done your due diligence when we’ve counted them every year,” said Michael McConnell, a homeless advocate and former member of the RTFH.He’s referring to the homeless population that live in vehicles.Because they were not included in the 2018 count of unsheltered homeless, the number appeared to decline from the previous year.Walker still defends their decision, saying “here in San Diego there was a great deal of effort of counting people in vehicles without proving or showing that there was anyone living in the vehicle.”But he said they plan on changing that next year by performing outreach beforehand, so when they encounter vehicles while doing the count they know who lives inside them.“We are going to do more interviewing so we know the people better,” he said.Whether or not he will be back to see that through remains to be seen.
