SAN DIEGO, Calif. (KGTV) - As protesters gather across the country to spread the message that black lives matter and there is a problem of police brutality against black people, not everyone is ready to join in the marches, but there are other ways to help the combat racism. “To make change, to build a movement, it takes all sorts of action. Everyone doesn’t need to go in the streets,” said Dayo Gore, UCSD Associate Professor in Ethnic Studies and Critical Gender Studies. While many have said they want change both verbally and through social media, she said people of color want that support to be taken to the next level. “This is not enough, your apology is not enough, feeling sorry is not enough, feeling my pain is not enough, I need some actual real change,” she said. To get that real change, people can use their voting powers to elect officials who will be an advocate, which is a point President Obama made in a publication addressing how people can make a difference in combating racism. He also noted that when making demands for officials, be specific with what you’re asking so it’s harder to ignore. Gore emphasized that point, citing specific examples of room for change in the San Diego community. She suggested a community review board that’s independent of the police department to review activity and oversee actions taken by police. She also said funding within the police department could be reevaluated. “Funding other things that will make communities more viable and able to survive, instead of simply policing communities,” said Gore. She also said in order to help get rid of racism, it’s important to first acknowledge there is an issue and educate yourself. “It starts with understanding what the problem is, and then figuring out where you best can raise your voice,” she said. She said another active step to take is speaking up among peers if someone says something racist, even if it’s uncomfortable. “When you’re hanging out with friends, do you say something when people say things racist or make assumptions based off the color of their skin?” she questioned. Gore also suggested people find groups in the community to both follow and support financially. San Diego (KGTV)- We’re learning more information about the seemingly healthy political commentator who dies suddenly in San Diego over the weekend. 26-year-old Bre Payton contracted the H1N1 flu virus, also known as swine flu, and meningitis. On Friday, a friend posted on twitter she found Payton unconscious. She was rushed to the hospital where she later died. The San Diego County Health Department says the So-Cal resident contracted both illnesses before arriving in San Diego. Meningitis causes inflammation in the brain and spine. A recent outbreak was reported at San Diego State University, but it is unclear if the strain Payton had was bacterial, like the SDSU cases, or if it was viral. In a report released last week, there were over 1,300 influenza cases in San Diego County between July and December. Almost 200 of those cases were the H1N1 flu. Health officials say, young adults, like Payton, are more likely to get the flu virus than kids and older adults. Middle age adults are not regularly exposed to the virus, and they have the lowest vaccination rates. News of her death is hitting hard to her family. Her parents released a statement to ABC News saying: “Bre was a brilliant, determined and beautiful girl from day one. She could silence a room with her beauty, and at the same moment impress everyone with her articulate reasoning. We miss her dearly, and our hearts are broken." 1415

SAN DIEGO (KGTV)- Thieves hit a well-known business causing thousands of dollars worth of damage. Bill Howe Plumbing, located on Aero Drive, had their work trucks vandalized as thieves steal gas from the gas tanks. Fleet manager Rhett Wheeler says the business has been targeted at least three times in the last month. “Its a shock that someone will crawl underneath a car with a drill, drill a hole in a gas tank, to steal a couple of gallons of gasoline,” says Wheeler. Thieves have damaged at least 10 vehicles, costing the family-owned company around ,000 in damages. “We end up losing a truck for two or three days per occurrence,” says Wheeler. Wheeler is urging everyone, including businesses, to check their vehicles of leaking gas before driving off. The company has reported the incidents to police. Managers are also working on more security measures for the future. 889

SAN DIEGO (KTGV)— A homeless man and convicted rapist accused of sexually assaulting a woman at an East Village bar in November faced his accuser in San Diego Superior Court. Gary Cushinberry, who's accused of multiple counts of sexual assault and attempted rape, pleaded not guilty. The judge ordered all media to conceal the victim’s identity, and to refer to her as Jane Doe. Jane Doe took the stand and recalled what happened on the evening of November 5th. She said she was at Amplified Kitchen and Beer Garden in East Village, celebrating with some colleagues.After having a few drinks, she headed to her car. She admitted she was drunk at the time, and her memory was hazy. But she did remember the moment her bottom touch the ground.“He was touching underneath the blanket, and I just remember being shocked. Uh, next he further proceeded to put his hand in my pants,” Doe said. While he attacked her on the ground underneath a dirty blanket, he tried to drug her with what she thought was a meth pipe, Doe continued. Detective Carlos Munoz of the San Diego Police Department also spoke in open court. After the case was assigned to him, he monitored surveillance cameras in the area. The detective found footage of a homeless man fitting Gary Cushinberry’s description, pulling Jane Doe into a bush next to her car. The two were not in frame for the next 25 minutes, until video captured Jane Doe speeding away from the parking lot, back into Amplified, where she later reported the assault.“It’s like you imagine a fight or flight. And I didn’t really fight and I didn’t flight. I just froze,” Doe said. Cushinberry, who is already a convicted rapist in Indiana, returned to the frame, just two minutes later. “When he walks up toward the intersection, or the corner, he is adjusting his belt, he is adjusting his waist,” Detective Munoz said. The next day, Jane Doe provided information for a suspect sketch.Officers also took her to Palomar Hospital to run a rape kit. DNA Criminalist Adam Dutra of the San Diego Police Department Crime Lab tested the DNA swab taken from the front button and zipper of Jane Doe’s shorts.“There was strong support for the inclusion of Mr. Cushinberry as the 98% contributor,” Dutra said. Cushinberry’s past convictions include rape in 1995, sexual battery in 1997, and recently, felony robbery in San Diego.His next court appearance is on December 19th. 2407

SAN DIEGO (KGTV)- It was a battle over workers rights at a rally downtown Thursday. Assemblywoman Lorena Gonzalez directly addressing the group against her proposed Assembly Bill. Assembly Bill 5 would affect any independent contractor including Uber and Lyft drivers, yoga teachers even hairdressers. The group at Thursday’s rally was made up mostly of adult entertainers. “I’ve been doing fine I like the freedom to educate myself and if someone’s going to stop me from that I want to do something about that and voice my opinion," one woman told 10News. The bill would make many independent contractors full time employees, forcing employers to provide overtime, health care and sick leave. Assemblywoman Gonzalez rebutted the group today. "There’s nothing in the law that says an employee has to work from 9 to 6. Any employer can tell you to work two hours, one hour, any hours you choose. There’s nothing in the law that says an employer can’t be flexible.”Some say they don’t want it because they prefer the flexibility and freedom to decide hours that comes with independent contracting. 1104
