VISTA (CNS) - A Catholic priest who grabbed a seminary student's groin from behind in a restroom stall during a night of drinking at a Carlsbad restaurant was convicted of misdemeanor sexual battery Monday.A jury deliberated about two hours before finding the Rev. Juan Garcia Castillo guilty.Castillo, who had worked at St. Patrick's Church in Carlsbad since 2011, faces six months in jail and registration as a sex offender when he is sentenced Jan. 18, said Deputy District Attorney Joshua Brisbane.The 33-year-old victim -- a former Navy attorney who left the military to join the priesthood -- testified that he had met Castillo the night before the incident, which happened about 1 a.m. on Feb. 4.According to court testimony, the victim went to the restroom to be sick, and was in a stall when Castillo grabbed his genitals from behind.The victim testified that he told Castillo to go away, but the defendant came back in the stall and massaged the victim's groin in a sexual way.Castillo, 35, testified that he followed the victim into the restroom because it looked like he was going to be sick. The priest said he tried to put pressure on the victim's stomach to stop his vomiting because his mother had taught him that trick as a child.The Roman Catholic Diocese of San Diego suspended Castillo once it learned of the "credible allegation" against him. 1371

WASHINGTON — A member of the White House coronavirus task force says the increase in U.S. cases isn’t just because of more testing.Admiral Brett Giroir of the U.S. Public Health Service Commissioned Corps. says the proof of the increase is the uptick in hospitalizations and deaths nationwide from COVID-19, the disease caused by the coronavirus.Cases of the virus are spiking across the country, particularly across the upper Midwest. Last week, the U.S. recorded two days of record increases of new COVID-19 cases.President Donald Trump has been saying the U.S. is “rounding the turn” on the pandemic. The president also contends the news media are spending too much time focusing on the health crisis.However, a model by the Institute for Health Metrics and Evaluation at the University of Washington — a model routinely cited by the White House — notes that hospital resource use has risen steadily in recent weeks and is projected to spike in the coming days.Giroir, who was put in charge of coronavirus testing by Trump, says the nation is at “another critical point” in the response to the pandemic.He is urging people to keep wearing masks, wash their hands and practice social distancing. Giroir says a safe and effective vaccine is “around the corner.” 1270

(KGTV) -- A Fallbrook woman was convicted of negligence for killing a father of four off of Highway 395 near the Pala Mesa Resort on May 23, 2017.Sulem Garcia was on prescription medications when she veered off the road crashing into Paul Burke who was on his bicycle, blocks from his home. Garcia's lawyer argued she was exhausted from finishing her finals at Palomar College that day and had been on the prescription medications to treat depression for three years.Garcia received the maximum sentence which was 1-year behind bars. More than 60 of Burke's family members and friends were in the courtroom. Burke's wife Laura gave a victim impact statement saying she does not believe that Garcia is remorseful and that the sentencing was a slap on the wrist.Burke owned and operated a custom surf shop for more than 40 years. He also worked at Costco. Burke's daughter and son both spoke at the sentencing hearing. 938

  

VISTA, Calif. (KGTV) -- Jury selection is expected to take all week in the trial of former NFL tight end Kellen Winslow II. The San Diego football star and son of Chargers Hall of Famer Kellen Winslow Senior pleaded not guilty to charges that he raped two homeless women in Encinitas last year. He's also charged with raping an unconscious seventeen-year-old girl back when Winslow was nineteen. Prosecutors say he was out of custody on million bail in connection with the felony case when he got in trouble again. Prosecutors say he fondled himself in front of a 77- year-old woman at a Carlsbad gym, asked her if she liked it, and groped her while she was in a hot tub at the same gym.Jan Ronis is a San Diego defense attorney not affiliated with the case, but watching it closely. "From what I've seen at the preliminary examination, everyone that testified seemed to have a lot of credibility. These were older women, you would extend the greatest credibility to that kind of witness," said Ronis. Winslow played ten seasons with the NFL. His defense team is reportedly planning to call two psychiatrists to testify. It's unclear if CTE, or Chronic traumatic encephalopathy will play a role in that defense. Ronis says it might not make a difference. "You can still be responsible for your conduct , criminally responsible, after having sustained a traumatic brain injury or something of that nature. It's different than say, your mental health issue was such that rendered you incapable of understanding the nature of your conduct that you couldn't understand the difference between right and wrong, " said Ronis. Viral news website Upworthy has laid off a significant chunk of its staff.More than 30 people were let go from the whole company, a spokesperson for Good Media Group confirmed to CNN. The company cited "an increasingly challenging media environment.""Today, we had to make the hard decision to say goodbye to esteemed colleagues," the company said in a statement. "An incredible team remains, and our mission is as relevant now as ever."Editor-in-chief Liz Heron wrote on Twitter that her "entire team" was laid off and she resigned. Senior staff writer Parker Molloy also confirmed her exit on Twitter. Eli Pariser, Upworthy's cofounder and co-CEO, stepped down last week. "I remain very grateful to all the smart, good-hearted people that helped to build something we all believed in," he wrote on Twitter.Upworthy skyrockted to viral fame in 2013 because of its catchy headlines and innovative mastery of Facebook's algorithm. The website is famous for headlines using the "curiosity gap," sentences that end in "You Won't Believe Why."At one point Upworthy attracted 85 million visitors.The website pivoted in 2015, writing original content and hired big names from the Wall Street Journal and New York Times. Good Media bought the website in 2017 and laid off staffers.It's the latest media company to lay off editorial staff. Over the past year, CNN, Vox, BuzzFeed, Vice, and most recently the New York Daily News all have laid off a number of people.Facebook and Google dominate digital advertising.
