SAN DIEGO (KGTV) - A man involved in a DUI hit-and-run crash that seriously injured a young boy in the South Bay started his sentencing hearing Wednesday for violating federal immigration laws.Constantino Banda Acosta, a Mexican national who had previously been deported from the U.S. at least 15 times in the past, has been in federal custody since March over federal criminal re-entry charges.He was transferred to federal custody after charges against him stemming from a 2017 crash were dismissed.Banda faced charges in the May 6, 2017, crash in San Ysidro that sent young Lennox Lake to the hospital with serious injuries, including head trauma.Banda was initially charged with drunk driving and hit-and-run after authorities said he ran a stop sign at Dairy Mart Road and slammed his pickup truck into the Lake family’s car as they were heading home from a Disneyland trip.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152.Following a mistrial, a judge dismissed the case against Banda in March, saying there was no clear evidence that showed he was behind the wheel at the time of the crash.Banda’s lawyers had argued that another man in the truck, Jorge Adame Ariza, may have been driving the truck after a night of drinking with Banda.Adame said Banda got into a fight with another man outside a Chula Vista restaurant before the crash. SAN DIEGO (KGTV) -- A man was stabbed to death in a Pacific Beach bathroom Sunday, and a man possibly linked to the incident was arrested, according to San Diego Police.SDPD officials said the stabbing was reported just after 7:30 p.m. in the 700 block of Grand Avenue as an assault with a deadly weapon with an injured man.Firefighters and lifeguards were the first arrive, and they found a 39-year-old white male bleeding from the upper torso in a men's bathroom, according to police. First aid was given within minutes and the man was taken to a hospital, but he died from his injuries.Police said witnesses reported seeing a man riding away from the scene on a bicycle immediately following the incident. A man matching witness descriptions was detained about a quarter-mile away from the scene and was questioned, according to SDPD officials.On Monday, officials announced 33-year-old Martin Alvarez was arrested and booked into County Jail on suspicion of murder.Police are not aware of any relationship between the victim and the suspect.Police are looking into whether cameras at nearby businesses have any video of the events surrounding the stabbing. SAN DIEGO (KGTV) - A man carjacked two vehicles within hours in Otay Mesa, San Diego Police said Friday.The first carjacking happened in the parking lot of the Iris Trolley Station on Iris Ave. about 10:30 p.m. Thursday.A man was outside of his Volkswagen Jetta and a woman was sitting in the car when the suspect got into the driver’s seat, police said.The woman got out of the car and the suspect drove away, according to San Diego Police.Officers searched the area and found the suspect had parked the Jetta at Palm Ave. and Beyer Way and carjacked another car.Two men who were sitting in a Hyundai Genesis when the suspect grabbed the driver and pulled him out of the car. The passenger got out and the suspect drove away in the Genesis, officers said.The suspect crashed into a white SUV at I-805 and Sweetwater, police said.Paramedics took the driver, 33-year-old Daniel Perez, to the hospital with a knee injury. 927

  

SAN DIEGO (KGTV) - A man accused of sexually assaulting women at knife-point across San Diego will face trial.On Tuesday, Judge Maureen F. Hallahan bound over eight felony counts against 19-year-old Seth Roberts.Three of his alleged victims gave testimony on Tuesday, describing their encounters with him.The first was an 18-year-old woman who said she had dated Roberts for about two months last year. They had been living in Oklahoma but both decided to hitchhike to California in October. RELATED: Former pro skateboarder convicted of rape and murder granted paroleThe woman, whose name was not released, said they stayed in Los Angeles for a week before coming down to San Diego where they were staying in a tent at a campground.She told the judge Roberts forcibly raped her one morning, holding her hands above her head.“I was telling him it was wrong, saying it was rape,” she said.After, she said Roberts left to go to work and she called a Lyft car which drove her all the way to Arizona where she called police and reported the alleged rape.The second victim said she met Roberts while walking near the beach in Pacific Beach in November of 2018.“He seemed like a very nice person,” she said through an interpreter.RELATED: Police searching for additional victims in sex assault caseThe woman said she is from Brazil but had been living in Washington, DC working as an au pair for a family.She traveled with them to San Diego for vacation and bumped into Roberts on her day off.She said he began making small talk and told her his roommate had a Brazilian girlfriend. He convinced her to walk with him towards his apartment to meet her.But she said before they made it there, he directed her to an area on the side of a home and pulled out a knife.She told the court that Roberts put his hand down her pants and inserted his finger into her anus while holding a knife to her throat.“I thought of my family. I thought of my dreams, how much I wanted to come here,” she said. “I could have never imagined this would happen to me.”A third woman also testified, saying Roberts raped her in her home at knife-point after she refused his advances.Roberts is being held on ,000,000 bail. SAN DIEGO (KGTV) — A piece of Hollywood has made its way to the USS Midway Museum. Thursday crews worked to move a large movie prop onto the deck of the famed vessel: A replica of the TBD Devastator that was used in the movie “Midway." “It’s the only Devastator on display in the world,” says Walt Loftus, Air Wing Director at the USS Midway Museum. “All the rest of them are at the bottom of the ocean.”RELATED: Top Gun 2 plane driven through Coronado streetsThe plane is a replica of the carriers that sailors used at war. The giant plane was a prop used in the upcoming film, starring Woody Harrelson, Luke Evans, and Nick Jonas. It's designed with “big square tubing with foam made into the shape of the devastator,” says Loftus. “But it's the actual size that the Devastator was.”"Midway" follows the story of U.S. Navy sailors and aviators who persevered through the Battle of Midway in 1942. It was only six months after Japan’s attack on Pearl Harbor.
