(KGTV) — Prosecutors Wednesday say two transients accused of a deadly home invasion robbery this week stabbed the victim 50 times in the face, neck, and back.Ian Bushee, 37, and Malissa James, 26, are both accused of breaking into a home in the 1800 block of Outrigger Lane just after midnight Monday. During the break-in the victim, identified as 63-year-old Marjorie Gawitt, was stabbed multiple times.Gawitt was still able to call 911 to report the incident and was conscious and breathing when police arrived. She was taken to Scripps La Jolla Hospital, where she died of her injuries.RELATED: Police identify suspects in deadly Carlsbad stabbing, burglaryBushee and James fled the scene in Gawitt's vehicle, according to police. The vehicle was found in San Marcos and the two were arrested in the 4800 block of Park Drive later Monday.Each has been charged with homicide, burglary, conspiracy, and auto theft. Bushee was also charged with accessory after the fact. James also also charged with torture. The pair was already on probation in San Bernardino for residential burglary.Both defendants pleaded not guilty of all charges.Bail was not set for Bushee or James, as they were determined to be a threat to the community.Both face the death penalty. A readiness hearing is scheduled for March 21, and a preliminary hearing is set for March 27. 1377

California regulators want to tax text messages to increase funds for programs that bring connectivity to underserved residents.A new surcharge proposed by the California Public Utilities Commission (CPUC) wouldn't be a per-text tax, but a monthly fee based a cellular bill that includes any fees for text-message services. Most carriers offer a flat fee option for texting, and already charge a similar fee for other services included in the bill — such as phone calls. The exact structure of the charge would vary from carrier to carrier.The commission will vote on the measure January 10, 2019, and is facing strong opposition from industry trade groups like the CTIA, which represents AT&T Mobility, Sprint, and T-Mobile. (AT&T is the parent company of CNN.)The 52-page proposal by CPUC Commissioner Carla J. Peterman lays out the details of the plan, and says the state's Public Purpose Program budget is going up while incoming fees to fill it are decreasing. Currently the surcharge rate is less than 7%.The proposed plan could be complicated by a new Federal Communication Commission ruling. On Wednesday, the FCC approved a new rule that classifies text messages as an "information service" like email. Proponent of the rule say it will give carriers the ability to crack down on spam messages, and critics say it could lead to carriers censoring messages.The CTIA argued in a legal filing submitted Wednesday that if texts are an information service, then the CPUC doesn't have authority over them and can't add on surcharges. It claims the proposal would go against federal law.The industry group also says the proposal would create inequity "between wireless carriers and other providers of messaging services," such as WhatsApp, iMessage and Skype."Subjecting wireless carriers' text messaging traffic to surcharges that cannot be applied to the lion's share of messaging traffic and messaging providers is illogical, anticompetitive, and harmful to consumers," the CTIA said in its filing.In light of the FCC ruling and other legal filings submitted to the CPUC, the group could change its draft proposal before the vote next month.According to the CPUC, the charges go to a number of different programs, including 911 services, subsidized phone service for low-income residents, and equipment for deaf and hard-of-hearing users. 2379

  

CALEXICO, Calif. (KGTV) - Twenty-nine migrants were processed at the Calexico Port of Entry after non-profits say they were separated from their children and deported.Sandra Cordero, Director at Families Belong Together, said 27 children ages 5 to 15 have been separated from their parents. Some for more than a year. Cordero said the parents came from Central America, including Guatemala, Honduras and El Salvador.Together Rising and Al Otro Lado raised money to fly the parents to Tijuana. Cordero said they stayed in Tijuana for two weeks preparing to go to the Calexico Port of Entry. Cordero said they presented themselves Saturday morning and U.S. Customs and Border Protection told them the detention center was at capacity.While waiting, Cordero shared some of the parents' stories, "he was trying to prepare his son because he knew they would be separated but he couldn't find the words or the feeling of how he was going to tell him that," Speaking about a man named Jose from Guatemala. He stood beside her while she spoke and wiped away tears. After 10 hours, the parents were brought in to process their asylum requests."We just found out that they're going to accept five families at a time and they're letting them all in, so thank you thank you thank you," Amanda Doyle, Vice President of Together Rising, said tearfully."I think it was really us, our presence here, and the presence of all of our supporters online, calling tweeting, pressuring, we're so lucky to have all these supporters that made today happen," Cordero said.Cordero said they would be back Sunday to ensure the parents were being processed quickly so they may be connected with their U.S. sponsors and ultimately reunited with their children. Cordero said they have lawyers who know where the children are and going through procedures to ensure they can be released to their parents. 1879
