TAMPA BAY, Fla. — About four million Kia and Hyundai vehicle owners are one step closer to receiving a piece of the nearly 0 million settlement over an engine defect linked to cars and SUVs spontaneously bursting into flames. The settlement deal, first announced last year, would cover reimbursement for past repairs and expenses, free repair or replacement of damaged engines, denied warranty coverage, and loss of vehicle value.ABC Action News I-team Investigator Jackie Callaway first exposed the cause behind these fires in the report “Up in Flames” in 2018.That’s also the year Tisha VanAllen’s 2011 Kia Optima caught fire as she was driving down a Mississippi highway.“The car started stuttering and I pulled over and when I did it was just engulfed in flames,” she said.VanAllen became trapped in the burning car.“I tried my passenger door, my driver's door, it would not budge,” she said.Panicking, she kicked at the door and window before a truck driver pulled over and wrestled the door open.“He kept yanking on the door handle until he finally got it to open up and he just grabbed me and yanked me out,” she said. The loss of her car devastated the finances of the single mother of four. And at one point she faced eviction.“It just put me in a downward spiral,” VanAllen said.Kia and Hyundai, under the settlement terms, will pay VanAllen and millions of other drivers’ repairs, damage, and loss of vehicle value.Kia did not respond to a request for comment but a Hyundai spokesperson wrote in an email that, "this settlement acknowledges our sincere willingness to take care of customers impacted by issues with this engine’s performance....."The class-action lawsuit includes drivers who owned or leased the following vehicles with 2.0-liter or 2.4-liter gasoline direct injection engines:2011-2019 Hyundai Sonata2013-2019 Hyundai Santa Fe Sport2014-2015 and 2018-2019 Hyundai Tucson2011-2019 Kia Optima2012-2019 Kia Sorento2011-2019 Kia SportageA federal court hearing for final approval is set for November 12 and a judge is expected to grant formal approval of the settlement before the end of the year. The automakers are already sending out claim forms to affected drivers who can expect to start receiving checks in 2021.VanAllen said it can’t happen soon enough.“I am glad they are taking the responsibility for it,” she said. “Because it really put me in a really bad hardship.”This story was first reported by Jackie Callaway at WFTS in Tampa Bay, Florida. 2489

TALLAHASSEE, Fla. — On Friday, a judge ruled that patients approved to use medical marijuana will be allowed to smoke it.Florida voters legalized medical marijuana in 2016. The only mention of smoking in the amendment’s language and in an intent document during the 2016 campaign was that the Legislature and local governments could restrict it in public places. The Legislature last year passed enacting laws that banned the sale of smoking products, saying that it poses a health risk.Orlando lawyer and medical-marijuana advocate John Morgan filed a lawsuit that brought the case in front of a Tallahassee judge who ruled that Florida's current smokable weed prohibition is unconstitutional. On Friday, Circuit Judge Karen Gievers ruled Florida's medical cannabis patients have the right to smoke weed in private places. 835

Ten female Mcdonald's current and former employees have filed sexual harassment complaints against the company over the past week. One worker in Chicago said that a McDonald's supervisor at the franchise store retaliated against her by reducing her hours when she reported instances of sexual harassment by management. Another Chicago worker at a franchise said she was fired soon after reporting that a manager had made sexually explicit comments to her.A third individual in St. Louis, who is 15 years old, said she was repeatedly harassed by an older employee every Sunday for two months. The employee commented on her appearance and sexually propositioned her, she said. The employee added that reports of the incidents were not taken seriously by a superior at the company-owned store, and the harassment did not end until she stopped working on Sundays.A 20-year-old woman in Durham, North Carolina, said that she was sexually harassed by co-workers and supervisors. She also said she was subjected to a hostile work environment at the company-owned store because she is black. The woman said she was made fun of by colleagues after reporting the behaviors and she eventually stopped turning to management. The complaints were filed with the Equal Employment Opportunity Commission in seven states, including Michigan, Florida and Louisiana. Most of the incidents were alleged to have occurred over the past two years.McDonald's said in a statement on Tuesday the company takes sexual harassment allegations "very seriously.""At McDonald's Corporation, we are and have been committed to a culture that fosters the respectful treatment of everyone. There is no place for harassment and discrimination of any kind in our workplace. McDonald's Corporation takes allegations of sexual harassment very seriously and are confident our independent franchisees who own and operate approximately 90 percent of our 14,000 U.S. restaurants will do the same," the statement said.Lawyers from Altshuler Berzon and Outten & Golden LLP are representing the employees, with funding from TIME'S UP Legal Defense Fund, which is administered by the National Women's Law Center Fund.Sharyn Tejani, director of the Legal Defense Fund, said in a statement, "we hope to help ensure that these charges will be a catalyst for significant change."The advocacy group Fight for announced the complaints on Tuesday."With support from the TIME'S UP Legal Defense Fund, workers in the Fight for now have a powerful ally in our ongoing effort to make McDonald's restaurants safe places for all workers," said McDonald's employee Adriana Alvarez, who is also a member of the Fight for 's national organizing committee.Fight for has set up a hotline for McDonald's employees who want to have their allegations reviewed by lawyers. 2827

The Arizona Poison and Drug Information Center have seen a spike in alcohol poisonings and hospitalizations across much of Arizona. The center services all counties except Maricopa, stating it has never seen so many in one month.“We see dozens of these per year, but never 22 in a month with hand sanitizers being the source of these hospitalizations," said Dr. Steve Dudley, director of the Arizona Poison and Drug Information Center.Since June 1, it has received 22 cases related to people drinking hand sanitizer. The center said many don't know the poisonous chemical methanol is inside.Dudley explained if hand sanitizer isn't mixed just right, it can create the toxic compound.“With COVID-19 and everyone is rushing to be prepared and stay stocked on hand sanitizer that's a left shortage. So, that's opened the door for either whole making of hand sanitizer or other companies or manufacturers being able to step in and fill that need,” explained Dr. Dudley.Dudley explained the effects of methanol might not be apparent right away, but could be deadly over time.“Methanol itself is not very toxic, it's what the body breaks methanol down into that causes all the toxicity,” he said.Signs and symptoms of methanol poisoning include:NauseaVomitingBlurry or hazy vision that could lead to permanent blindnessSeizuresDudley explained the reason some drink hand sanitizer.“Unfortunately, you know, it's an alcohol substitute, just like we see people who drink rubbing alcohol and attempts to get drunk. And so again, the problem is you know people who are used to drinking this product. Not that we would ever recommend it but they're used to drinking a certain product and they know what to expect in terms of what it does for them and what side effects that would have, but now you throw in as extremely toxic methanol in there,” said Dr. Dudley.Dudley added it could be hard to know if methanol is in hand sanitizer by reading the label, but if you think someone has ingested methanol you call the poison center immediately at 1-800-222-1222.KGUN's Ciara Encinas originally reported this story. 2107
