SAN DIEGO (AP) — A Marine who worked jointly in Iraq with a decorated Navy SEAL accused of murder testified Thursday that the SEAL did not stab a teenage Islamic State prisoner in his care.Marine Staff Sergeant Georgio Kirylo said that he did not see stab wounds on the neck of the dead captive when he moved the body to position it for a so-called "trophy" photo.Kirylo took the stand in the San Diego court-martial of SEAL Chief Edward Gallagher, who is accused of fatally stabbing the adolescent militant in 2017. Gallagher, 40, has pleaded not guilty to murder and attempted murder.His statements followed testimony of an Iraqi general who said he was with the prisoner until he died, and that he did not see Gallagher stab him.Two SEALs previously testified that they saw Gallagher plunge a knife into the prisoner's neck. He said some of the men in the platoon took turns taking photos with the body because they were excited that they had coordinated an air strike with Iraqi troops that had killed Islamic State fighters including the captive's commander."This was our unofficial war trophy," he said.Iraqi General Abbas al-Jubouri, whose forces were partnered with U.S. troops, testified that he handed over the wounded militant to SEALs to keep him alive for interrogation.The general was questioned June 3 and video of the testimony was shown to the jury on Thursday.The general said during defense questioning that he did not see Gallagher harm the captive in any way — and if he had, he would have spoken up."If he did any mistake with this kid, or if anyone had from the Navy SEALs, I would have stopped them," al-Jubouri said.Navy medics did their best to save the captive, he said.When he was shown photos of the dead militant with bandages around his neck and tubes in his chest, al-Jubouri said he'd never seen the images before.The general said the militant told him he was 17 years old.The trial resumed a day after officials said a SEAL who testified that it was he — not Gallagher — who killed the wounded prisoner may face perjury charges. The Navy said it is reviewing Corey Scott's statements following his stunning testimony last week.Witnesses had said they saw Gallagher stab a wounded Islamic State captive in the neck and shoot at two civilians during his 2017 tour in Iraq.Scott testified that he actually killed the captive by plugging his breathing tube. SAN DIEGO (CNS) - A 21-year-old man who fatally stabbed a transient in Ocean Beach was sentenced today to 15 years to life in state prison. Noah Mitchell Jackson, 21, was convicted earlier this year of second-degree murder for the June 22, 2017, killing of 65-year-old Walter ``Ras'' Riley, an Ohio native nicknamed ``the Incense Man'' due to his practice of selling aromatic burning sticks at local farmers' markets. Officers sent just before 12:30 a.m. to the 1900 block of Bacon Street found Riley lying on the sidewalk with stab wounds to his upper body. He was pronounced dead at UCSD Medical Center. Deputy District Attorney Michael Reilly said the victim was stabbed five times, with the killing blow entering his back, breaking several ribs and puncturing his heart. I stabbed that (expletive).'' ``Those are the words of a murderer,'' Reilly told jurors. However, Iredale denied this suspected motive, as he said his client had substance abuse problems that led him to make several ``completely random statements'' to friends following the date of the killing. The attorney said the spitting incident involving Jackson's sister never occurred and ``God only knows'' why Jackson said it had. Iredale said police originally had 20 to 30 suspects, but centered on Jackson due to a 911 call made about 90 minutes prior to Riley's stabbing. In that call, a recording of which was played for the jury, the mother of one of Jackson's friends said Jackson was at her home displaying erratic behavior and saying he wanted to commit suicide. He'd just gotten into an argument with his girlfriend, then left the house, she told a dispatcher. Iredale alleged the clothing description she provided police -- a white sweatshirt and jeans -- vaguely resembled the attire of a suspect captured on surveillance footage running through Ocean Beach following the killing. That footage was publicly released shortly after Riley's death. Iredale said the man in the footage was Riley's killer, but looked nothing like his client. SAN DIEGO — The city of San Diego never waived permit repair fees for sidewalks, despite a January announcement from the mayor's office saying it would do so throughout 2020.A homeowner pays the fees, which total to just over ,000, when he or she elects to repair the sidewalk in front of their home. A spokeswoman for the mayor says, however, that the city had to delay the fee waiver program once the coronavirus outbreak hit. The city instead was forced to cut upwards of million from the general fund budget. "The City continues to prioritize sidewalk repair amid the uncertainty and budgetary impacts that COVID 19 has brought," city spokesman Anthony Santacroce said in a statement. "While COVID-related holds slowed repair down for a few months, we estimate another 10,000 locations will be repaired with concrete slicing this (fiscal year 2021) and we are off to a great start."The news release announcing the fee waiver, however, is still on the city's website.Marie St. George, a Mission Hills resident, saw that announcement and contacted the city. She wanted to spend upwards of ,500 to repair the crumbling sidewalk in front of her home. That sidewalk, laid down in 1922, is likely one of upwards of 81,000 backlogged locations the city has marked for repair."I actually am afraid now," St. George said. "People could trip. It's become sort of a hazard."The city has a program to split the construction cost with residents, as both the city and homeowners can be liable for the condition of the sidewalk. St. George, however, was willing to pay all of the cost because she wanted it done faster. However, when she called to get the permits, the city representative said she couldn't waive the fees. "I thought based on the mayor's announcement that it would be waived, so it was pretty shocking," she said. Councilman Mark Kersey, who heads the Active Transportation and Infrastructure Committee, which was moving the fee waiver program forward, said in a statement that he hopes this will be prioritized as money comes available. “Repairs on sidewalks are even more important in the pandemic since so many people depend on them every day," he said. "Programs like the fee waiver can keep residents moving safely and save valuable City dollars by preventing trip-and-fall lawsuits."The city says it also repaired or replaced more than 7,500 sidewalk locations last fiscal year. San Diegans will soon have a new, and much more convenient way, to sell their homes.With a few taps on their computers or phones, they could get an all-cash offer from real-estate tracker Zillow for their property.The program, called Zillow Offers, adds speed, convenience and certainty to a process that often requires patience, home staging, visits from complete strangers, and frustration over transactions falling through."What we're trying to do is help homeowners solve one of the biggest problems they have," said Jeremy Wacksman, President of Zillow. "If you're selling and buying at the same time, trying to get all that done and project managing that even with the help of a great agent is hard."Zillow plans to launch the program in San Diego in early 2020. Homeowners would answer a few questions about their property online, getting an initial offer. If interested, they can arrange for an in-home inspection. A day or two after that, they'll get a formal cash offer they can consider. But that certainty comes at a price. Zillow makes its offer based on a variety of factors, including how long they believe they will have to hold the property and what they can sell it for. The company also deducts the costs of any repairs it deems necessary, with no room for negotiation. Typically, their offer comes with a 7 percent fee, which is 1 to 2 percent more than the average commission.Mark Goldman, a loan officer for C-2 Financial, said Zillow's offer likely comes with a cost. "For somebody who needs to do a fast transaction, it might be a suitable option, but you're not going to get top dollar for your house if you're going to do that," he said.
