SAN DIEGO (KGTV) - A judge declared a mistrial Monday in the retrial of an undocumented immigrant accused of being the driver in a San Ysidro, California hit-and-run crash which seriously injured a young boy.Constantino Banda Acosta was charged with the crash  on May 6, 2017.Investigators said Banda ran a stop sign and crashed his pickup truck into the Lake family’s Honda Accord.6-year-old Lennox Lake was in a child safety seat at the back of the car. He suffered serious head injuries.Banda left the scene but was arrested about two miles away after Border Patrol agents spotted his damaged truck parked on a street, police said.During Banda's first trial, his passenger, Jorge Adame Ariza, also an undocumented immigrant from Mexico, testified under a grant of immunity during the defendant's two-day preliminary hearing in June that he and Banda had a number of beers that night before the accident.Adame said Banda got into a fight with another man outside a Chula Vista restaurant. Adame told them he picked up Banda but later moved into the passenger seat with Banda behind the wheel during the crash.San Diego police Officer Michael Muniz testified in the first trial that Banda's blood-alcohol content measured .151 and .152 percent -- the legal limit is .08 -- during two breathalyzer tests.Federal immigration officials said Banda has been deported from the United States at least 15 times over the past 15 years, most recently on January 18.A judge will decide Friday whether a third trial will take place. 1544

SAN DIEGO (KGTV) - A new study looks at the number of drunk driving arrests in cities since ridesharing apps were created.San Diego was included in Moll Law Group study, which found DUI arrests fell 32 percent since Uber launched in June 2012. Lyft launched in San Diego the following year.  In an email to 10News last summer, SDPD Officer Mark McCullough credited the decrease in DUI arrests to the department's education and enforcement, as well as alternative transportation options. 509

SAN DIEGO (KGTV) — A non-profit organization held a first-of-its-kind seminar to teach law enforcement officers, first responders, and legal professionals how to understand and handle incidents involving people with intellectual and developmental disabilities. More than 100 individuals representing a variety of agencies, including the San Diego Police Department, Chula Vista Police Department, and the public defender's office attended the Arc of San Diego's "Pathways to Justice" training at the Handlery Hotel in Mission Valley. In recent years, law enforcement agencies from across the country have been under attack about their handling of cases involving witnesses, victims, and suspects with disabilities. Arc of San Diego hopes to bridge the understanding gap. On April 30, 2015, San Diego Police officer Neal Browder responded to a call about a man reportedly wielding a knife. He rolled into the alley with no lights, sirens, nor was he wearing a body camera. But a nearby surveillance camera caught the entire encounter. Within three seconds of opening his door, Browder fatally shot the man, Fridoon Nehad. It turned out, Nehad was an unarmed, mentally disabled man. Since this incident, the American Civil Liberties Union has questioned the officer's use of lethal force. Would this have happened if San Diego Police officers had the proper training?The Arc of San Diego hopes this never happens again, which is why they invited agencies to join their training seminar."We want to help first responders have a better understanding of what it is to interact with people with intellectual and developmental disabilities," Arc of San Diego CEO and President Anthony Desalis said.San Diego was chosen as one of four cities nationwide to run this three-pilot program. The others are Monmouth County, New Jersey, Loudoun County, Virginia, and Columbia, South Carolina. The program includes this one-day seminar where each department will create its own Disability Response Team. Finally, the departments will hire disabled individuals as intern cadets through the "Growth Through Opportunity" program. "That gives the officers at those stations a chance to interact with someone who has a disability," SDPD Sgt. Jonathan Lowe said. While his primary assignment is recruiting, he is also the Chief's Liaison for the Disabled Community. So how do you deal with a situation like Nehad's? Experts say step one is to be patient. "Don't automatically assume they are somebody who is drunk or somebody who is on drugs," Desalis said. "It may just be that it takes a moment to process what you're saying to them."Giving that person that extra moment could be the difference between life and death."No situation is ever going to be perfect in the field," Sgt. Lowe said. "But at least we can do our best to be proactive about training our officers the right way." 2871

SAN DIEGO (KGTV) - A San Diego artist wants to paint murals around the city that she hopes can help bring an end to gun violence."My concept is just something beautiful that people can take a picture in front of and just really enjoy the artwork of it but also take a message away from it," says Hanna Daly.Her concept is a series of artworks that look like colorful doorways. Each will have a message written above them, like 'Thoughts and Prayers Aren't Enough.""I thought it could be, like, a doorway to change," Daly says. "You walk away from it thinking, maybe there's a little something I can do. Like a doorway you step through it and now you're part of the cause."Daly became part of the cause last year, when her brother comitted suicide. He had shot himself in the head."Then a few weeks after that was Las Vegas," she says. "And then another shooting and another. It just kept hitting me, so I finally thought I should do something."Daly is working with with the Brady Campaign and Moms Demand Action on the project. She has the designs, just not the space to paint them."We need some people with some great walls out there that are visible, on main drags, where people are going to see it, where we can create some beautiful art, but that has a strong message," she says.She's hoping to paint the murals in high traffic areas like the Gaslamp District or along the boardwalks near beaches. SAN DIEGO (KGTV) - A local Naval officer is making a plea for tips after thieves made off with some priceless military heirlooms.On Tuesday, Gervy Alota's wife called him after she returned to their home on Linbrook Drive."Just completely ransacked my house...my heart sunk," said Alota.Since there were no clear signs of entry, Alota believes the thieves got in through the doggie door in the back of the home.Among the missing items were several dozen collectible Jordan sneakers and about 15 pieces of jewelry, including Alota's class ring from the Naval Academy.  He calls it a symbol of the start of his 20-year Navy career.  A class ring belonging to his wife - also a graduate - was also stolen. 720
